Minnesota V Motion was made by Craig Anderson, seconded by John Everts and unanimously carried, to approve a variance to construct a 14' addition along the South (Marina) side and up to the full length of the existing cabin and being no closer to the lake (53'), not less than 35' from the Marina and being not less than 8' from the side lot line service drive at the Southeasterly corner of the addition. After additional consideration, motion was made by Craig Anderson, seconded by Dan Oehler and unanimously carried, to approve a water - oriented accessory structure (screened porch), not to exceed 260 square feet in area or 1 O' in height, being 65' from the lake on the west side. After further consideration, motion was made by Dan Oehler, seconded by Craig Anderson to approve a 26' by 30' garage with no RV attachment and with the condition that the existing 14' by 22' garage will be removed. A motion to amend the above motion to a 24' by 24' garage was offered by John Everts and seconded by George Walter. The motion to amend carried with Dan Oehler and Craig Anderson voting no. The Board proceeded to take action on the amended motion which states to approve a 24' by 24' garage having no attachment for an RV and with the condition that the existing 14' by 22' garage will be removed. The amended motion carried with Dan Oehler and Craig Anderson voting no. The granting of the amended motion allows the applicant a reasonable use of his property. The Board then had a discussion as to where the 24’ by 24' garage would be located. It was suggested that the garage be located as far away from both bodies of water as possible. At least a minimum of 10’ from the Marina and Canal. A motion was made by John Everts, seconded by George Walter and carried with Craig Anderson voting no, to locate the 24' by 24’ garage as depicted on the applicant's drawing (Starting at the north corner of the garage as depicted on the original drawing extending 24’ to the Southwest and 24' to the Southeast). After consideration, motion was made by Bert Olson, seconded by Dan Oehler and carried with John Everts abstaining, to approve a variance of approximately 20' from the required side lot line setback for cluster developments of 50' for the construction of a 6' by 8' addition to an existing cabin. This is an existing resort. # ‘ 10202 Mystic Oaks Circle Austin TX, 78750 (512) 331 7114 (home) (512) 984 3188 (work) September 8, 1993Board of Adjustment Shoreland Management County of Otter Tail Fergus Falls MN, 56537 S£P 1 3 1993 (I ncGOC^CEDear Sirs: In April of 1984 I appeared before your board and under permit number 6588, was granted permission to add a 12'x20' addition to the West side of our cabin. This was built the same year. Also granted under this permit was permission to add a 14'x20' addition to the South or Marina side of the cabin at any location along the cabin length. This addition has not been built and as I get closer to retirement and as our family grows, we find the size will not meet our changing family needs. We also find that we have a need for a larger garage-work shop building. In order to meet our updated needs we would like to begin a three step expansion as follows: (Note; all dimensions are from the foundations.) 1. Replacement of an existing elderly metal sided single car garage that is too small for most boats and pickups. This structure is located about 4' from the Marina, into the 10' setback, about 55' from the canal and 60' from the lake-canal junction. This garage would be replaced with what is basically a two car garage-shop with room on the end for crosswise boat storage. It is further enlarged and heightened to allow attachment of a covered storage for a Motorhome or other Recreational Vehicle or covered parking. The size of the garage portion would be would be up to 26'x38' and the attached RV covered parking area would be up to 12'x38' with 12' sidewalls for clearance. The RV port may have an end wall toward the canal but would not have side walls to enable access to the crosswise boat storage at the rear of the garage. Height of this building would be less than the 17' or 18' height limitations. This building is projected to be built using pole building techniques with metal roof and sides but may use conventional construction or a combination of both. Every attempt would be made to have this structure and the cabin color coordinated. While the building can be kept within the 10' setbacks, having water on three sides of the lot means a variance is required for the distances to water. The northwesterly corner of the building would be about 35' from the lake-canal junction, about 27' from the canal and about 10' from the Marina. These distances are not inconsistent with distances of other structures both in the Marina and at other places around the Lake GE? i 2 1993 and the inlet area of the Otter Tail river. . U'Variance requested is for 30' from the lake, 22' from the canal, and 8' from the Marina-all subject to the 10' setback. A question does exist as to what the reading is of having an RV stored for extended periods of time in a carport-garage type structure and how this is affected by the 22 day rule. 2. Addition of a 14' by up to 38' addition along the South (Marina) side of the Cabin. While this is an extension of the previously approved 14'x20' addition, it should be noted that the property line tapers in and the southeasterly corner of this addition would be about 8'8" from the line in the area at the end of the service drive. This corner is also about 46' feet from the Marina. It is proposed to have two bedrooms and a Utility room with possibly a stool in this addition. The main cabin will be redone to provide a larger living area and enlargement of the kitchen. These distances are in keeping with distances of other structures around the Marina and elsewhere on the lake. Approval is implied from the 1984 grant. Variance requested is fm a^14' addition along up to the full length of the South side of the cabin and oerngMo'^ir^om the water in the Marina, no closer to the lake (53') than the present cabin and being 8' from the side setback at the SE corner. 3. It is desired to build at some future time a 3 season porch of up to about 14' by up to 26' beginning at the easterly end of the cabin. This would be subject to not intruding into the 10' sewer tank distance. The present deck would be relocated westerly. A deviation allowing this addition to be 65' (53'+ 12') from the lake on the westerly side is needed but none is needed to the north since the lake would be more than 75'. No deviation is requested for the sewer tank 10' requirement. The attached sketches should help to clarify what we'd like to do. All Dimensions noted are from the foundation of the structure. I would like to be placed on the October 7, 1993 board of Adjustment meeting to consider these requests. Enclosed is a check for 45 dollars and the application. Since I will be making a special trip from Austin for this purpose (and to determine if we have lake frontage or lake bottom) we would appreciate verification that we are on the agenda.
