I understand that I have applied for a variance from the requirements of the Shoreland Management Ordinance of Otter Tail
County. I understand I must contact my township in order to determine whether or not any additional variance and/or permits
are required by the township for my proposed project.

MOTION AS FOLLOWS:
Motion was made by John Everts, seconded by Bert Olson and carried with Cecil Femling and
George Walter voting no, to deny the request as no adequate hardship had been shown. The
ordinance requires that these types of structures be centered on the lot.

!Robert Edward Toelle-Approved
Robert Edward Toelle, Breckenridge, MN, requested a variance of 20' from the required shore
impact zone setback of 100' and a variance of 120' from the required ordinary high water level
setback of 200' for the construction of a 30' by 36' dwelling. Also, requesting a variance of 5'
from the required 10' setback for the placement of a holding tank 5' from the garage and a
variance of 1 O' from the required setback of 20' for the placement of a drain field 1 O' from the
garage. The property is described as Lot 9 of the 2nd Addn to Minnkota Beach, Dead Lake in
Maine Township. Theaudience was polled with Mr. Toelle's daughter speaking in favor of
granting this request. After consideration, motion was made by Cecil Femling. seconded by Craig
Anderson and unanimously carried to approve a 20' variance from the required shore impact
zone setback of 100' and a variance of 120' from the required ordinary high water level setback
of 200' for the construction of a 30' by 36' dwelling; to approve a variance of 5' from the
required 1 O' setback for the placement of a holding tank 5' from the garage and to approve a
variance of 10' from the required setback of 20' for the placement of a drain field 1 O' from the
garage. The hardship being a substandard lot of record. Width of this lot does not lend itself to
the placement of the garage on line with the home.i

Donald W. Stuart - Denied
Donald W. Stuart. Battle Lake, MN. requested a variance of 55' from the required side lot line
setback of 65' for the replacement of a 6' by 6' utility shed with a 8' by 10' utility shed 1 O'
from the lot line. The property is described as Lot 1 7 of Northview, Deer Lake in Everts
Township. The audience was polled with no one speaking for or against the request. After
consideration, motion was made by John Everts, seconded by Bert Olson and carried with Cecil
Femling and George Walter voting no, to deny the request as no adequate hardship had been
shown. The ordinance requires that these types of structures be centered on the lot.

Norman Otheim - Approved
Norman Otheim, Lisbon, ND. requested a variance of 3' from the required setback of 10' for the
placement of a new addition 7' from the holding tank. The property is described as Lot 7 of
Linden Grove, Clitherall Lake in Clitherall Township. The audience was polled with no one
speaking for or against the request. After consideration, motion was made by Dan Oehler,
seconded by Craig Anderson and unanimously carried, to approve a 3' variance from the
. required setback of 1 O' for the placement of a new addition 7' from the holding tank. Hardship
being a substandard lot of record and the applicant will have adequate room to service the
holding tank. It should be noted that the new addition will not have a basement and having a
holding tank with a setback of 7' from the addition should not present a health problem.
