Marlys J. Madsen and Melanie Greene, part of Outlet A and part of Lot 23 Inglewood, Blanche Lake in Everts
Township, requested the following: Modification of property lines between two lake lots. There are no substandard
setbacks created by this proposed adjustment. The audience was polled with no one speaking for or against the
variance as requested. Christopher Greene and Emil Madsen appeared with Melanie Greene. A letter from Carl E.
Malmstrom in support of the variance as requested was read for the record. A letter from Roland Mann, Administrator
of the Otter Tail Water Management District regarding the septic system was also read for the record. After
consideration and discussion, Michael Harris made a motion, second by Thomas Lee and unanimously carried, to
approve the proposed property line modifications as described in the variance application dated May 9, 2013 and as
depicted on the submitted drawing with the condition that a registered surveyor’s drawing must be provided indicating
the location of the modified property line and with the condition that the requirement stated in Mr. Roland Mann’s letter

Richard and Colleen Kuhn - Variance application was approved as requested. (7:00 p.m.)
Richard & Colleen Kuhn, Lot 15 and Reserve Lot A, Block 1 Deerpath at Crystal, Crystal Lake in Lida Township,
requested a variance to have Lot 15 and Reserve Lot A Block 1, Deerpath at Crystal declared bulldable for residential
purposes. These lots were originally created in 1977. Kevin Solberg, Contractor appeared with the applicant. The
audience was polled with no one speaking for or against the variance as requested. After consideration and
discussion, Steve Schierer made a motion, second by Rick Wilson and unanimously carried, to declare Lot 15 and
Reserve Lot A Block 1 Deerpath at Crystal a single (combined) bulldable lot for residential purposes. The variance as
approved does not directly or indirectly grant any other variances for current or future development. The variance as
approved will provide the applicants with the ability to enjoy their property in a manner similar to other properties in
this immediate neighborhood.
Glen Mills - Variance application was approved as requested. (7:07 p.m.)
Glen Mills, Lot 1 and part of Lot 2, Deer Lake Beach, Deer Lake in Everts Township, requested a variance of 24’ from
the required ordinary high water level setback of 100' for the construction of a detached garage 76’ from the ordinary
high water level. The audience was polled with no one speaking for or against the variance as requested. After
consideration and discussion, Thomas Lee made a motion, second by Ward Uggerud and unanimously carried, to
approve a variance of 24’ from the required ordinary high water level setback of 100’ for the construction of a
detached garage as described in the variance application dated May 12, 2013 and as depicted on the submitted
drawing 76’ from the ordinary high water level. The proposed development is behind the existing development. The
variance as approved will provide the applicant with a reasonable use of his property and will allow the applicant to
enjoy the same rights and privileges as other property owners within this immediate neighborhood.
Raymond P. Baumler Et. Al. - Variance application was approved as requested. (7:10 p.m.)
Raymond P. Baumler Et. Al, Lots 84 and 85 Nedberg Nye Survey Lots of Government Lots 1,2 and 3, Section 1 of
Edna Township by Dead Lake, requested the following: The cabin is approximately 20’ from ordinary high water level.
The required setback if 75’. Requesting a variance of 55’. Also requesting a 4’ variance from road right-of-way.
Variance request to add a second story on east end of previous approved variance in July 7, 2011. To rebuild the first
story. Second story will be 24’ by 32’. The audience was polled with no one speaking for or against the variance as
requested. After consideration and discussion, Michael Harris made a motion, second by Rick Wilson and
unanimously carried, to approve a variance of 55’ from the required ordinary high water level setback of 75’ and a
variance 4’ from the required road right-of-way setback of 20’ for a 24’ by 32’ second story addition to a rebuilt first
story (approved by variance on July 7, 2011) as described in the variance application dated May 14, 2013 and as
depicted in the submitted drawing 20’ from the ordinary high water level and 26’ from the road right-of-way. The
proposed development will not obstruct the view from the adjacent properties and is similar to other structures within
this immediate area.

some type of easement agreement for the on site septic system that the 2 lots share. Both the lots must be

AND
MAINTENANCE AGREEMENT
THIS AGREEMENT is made this
between and Marlys J. Madsen and Emil M. Madsen, wife and husband, hereafter
"Madsen"; and Melanie A. Greene, a single person, hereafter "Greene".

WHEREAS, Marlys J. Madsen is the fee owner of property located in the
County of Otter Tail, State of Minnesota, described as follows:
Part of Lot “A” of the Subdivision of Madsen’s Outlots to Blanche Lake
Beach, according to the Subdivision Plat of public record in the Office of
the Register of Deeds in and for Otter Tail County, Minnesota, and of
Government Lot 6, Section 1, Township 133, Range 40 lying southerly of
the right of way of State Trunk Highway No. 78 and lying Easterly of the
following described line: Commencing at the Northeast comer of Lot 1 of
the Subdivision Plat of Blanche Lake Beach as of said public record;

(hereafter the "Greene Property"); and
WHEREAS, the Greene Property and Madsen Property share a septic system
with portions and components of the system located on the Madsen Property and on the
Greene Property, which has components which benefit only the Madsen Property or the
Greene Property, and which has components which benefit both properties; and
WHEREAS, the parties are desirous of defining an easement benefiting the Greene
Property and the Madsen Property for use of the Septic System and providing for the
maintenance of the same.
AGREEMENT
NOW, THEREFORE, IT IS AGREED AS FOLLOWS:
1. Madsen grants to Greene, and Greene grants to Madsen, an easement for septic
system purposes and for ingress and egress to said septic system for its maintenance and
repair.
A diagram of the system is set forth on attached Exhibit A.2.
Each party shall be responsible for the maintenance and repair of that part of the
septic system which benefits only their property at that party's sole expense.
3.
Both parties shall be responsible for the maintenance and repair, including
replacement, of that part of the septic system which benefits both the Madsen
Property and the Greene Property. Each party shall contribute equally to the
expenses incurred under this paragraph. Prior to incurring any maintenance, repair
or replacement cost the party undertaking the work shall use his or her best efforts
to obtain the consent of the other party. So long as an owner of a property has
consulted with and obtained, or reasonably attempted to obtain the consent of the
other property owner, then all such common expenses shall be paid one half each.
The property owner incurring an expense shall present the other property owner
with invoices and receipts and the property owner receiving the same shall
promptly pay and reimburse their share of the expenses.
4.
All maintenance, repair and replacement of the septic system, or other
improvements must comply with all applicable governmental regulations and
requirements.
5.
If either party damages the septic system, then such party shall bear the entire
expense of repairing such damage.
6.
Each party shall indemnify, defend, and hold the other harmless from and against
any and all liability, loss, damage, claim or act based upon or arising out of

damage to persons or property caused by or sustained in connection with the
negligent or willful acts of such indemnifying party, or the indemnifying party's
use of the easement. The foregoing indemnity shall bind and benefit the owner of
a property only with respect to events and claims occurring or accruing during
said owner's tenure of ownership of the subject property.
This agreement shall be binding upon, and inure to the benefit of the parties, their
successors and assigns, and shall be appurtenant to the lands described herein.
8.
It is the intention of the parties that the rights and easements created and granted
are to be used and maintained in a manner consistent with the best interests of the
owners of both properties. To this end, whenever a matter arises that is not
covered specifically by the terms of this agreement, the parties covenant that they
will deal fairly and attempt to resolve the matter in good faith, and in keeping with
the spirit of the agreements contained herein.
