Planning Commission August 13, 1997 Page 2 Eric Canfield - Approved With Provisions: A Conditional Use Permit Application stating; The roadway is planned to be a private road with a 66 ft. wide right-of-way. I have met with the Town of Edna and have presented them our plans. They have indicted that the roadway and lots meet their standards. The road builder will be in touch with Town Board as to their specifications. The road will not be impacting any wetlands. The property is described as S 1100' of GL 7 in Section 29 excluding trail & roadway & Sublot 1 of GL 6 excluding trail & roadway in Section 30 of Edna Township; McDonald Lake (56-386), RD. Eric Canfield represented the Application. Motion: A motion by Estes, second by Olson to approve as presented provided proof of access to property owners to the north and proof of vacation of the existing property is forwarded to the Land & Resource Office prior to issuing the Permit. (This Application is to request the rental use, if approved, a Site Permit would be required.) The property is described as Lot F Ex Hwy R/W of Dursch's Silver Bay, Section 33 of Everts Township; Unnamed Lake (56-305), GD. Russell & Audrey Thompson (buyers) represented the Application. John Matteson (representing COLA) expressed concerns as to why the lake is classified GD and also indicated that this is a holding area for run-off from the surrounding area. Voting: All members in favor. uner i an ooumy Duaru oi vuiiiiiiiiiiuncia August 19, 1997 Page 4 Planning Commission Recommendations Conditional Use Permit - Walt Schmidt/Beatrice Richardson: Land & Resource Director, Bill Kalar, reported that this Conditional Use Permit request is an after- the-fact request for a tubing business. Mr. Kalar noted that the permit request was approved by the Planning Commission with the condition that private access to the river is obtained for the tubers. A letter received from Delores and Larry Johnson was presented. The letter stated concern about this business and concern regarding the fact that Johnson’s CUP allows only one 4x4 sign while Mr. Schmidt has large signs all over his property. Motion by Portmann, second by Lee, and unanimously carried to approve the Conditional Use Permit for Walt Schmidt/Beatrice Richardson (Section 1, Twp. 133, R. 41, Otter Tail River) with conditions as recommended by the Planning Commission and subject to the same restrictions regarding signage that Mr. Larry Johnson’s (neighboring tubing business) CUP allows. Conditional Use Permit - Eric Canfield: Motion by Nelson, second by Stone, and unanimously carried to approve the Conditional Use Permit of Eric Canfield (Section 29 & 30, Twp. 136, R. 40, McDonald Lake) with conditions as recommended by the Planning Commission. Preliminary Plat - “West Otter Shores": Mr. Kalar presented a preliminary plat of “West Otter Shores”. Mr.- Kalar recommended the following clarification: The Preliminary Plat indicates Lot 3, Block 1, is not intended for building purposes, however, this should read Lot 1, Block 1, since Lot 1, Block 1, does not have sufficient size for building purposes. Motion by Lee, second by Portmann, and unanimously carried to approve the Preliminary Plat of “West Otter Shores” (Section 31, of Candor Township, Otter Lake) as presented with the above clarification. Conditional Use Permit - Gloria Bates/Russell Thompson: Motion by Stone, second by Portmann, and unanimously carried to deny the Conditional Use Permit of Gloria Bates/Richard Thompson (Section 33, Twp. 133, R. 40, Unnamed Lake) as recommended by the Planning Commission. Motion by Lee, second by Portmann, and unanimously carried to authorize the Land & Resource Director to request that the DNR review this lake for possible reclassification of this body of water. Conditional Use Permit - Shorma Family Trust: Motion by Stone, second by Nelson, and unanimously carried to approve the Conditional Use Permit of Shorma Family Trust (Section 10, Twp. 134, R. 41, Pickerel Lake) with conditions as recommended by the Planning Commission. We object to construction on this site for several reasons: • This lake (known locally by some as "Brickyard Slough") is an ecologically sensitive natural area. This lake provides homes to many nesting birds and other wildlife species. This lake has served as a nesting area for loons the last three years. We believe the construction of this building will negatively affect this wetland area. • The size of the building will mean significant clearing of this wooded lot, obviously changing the landscape in a negative way. We feel this type of building will be a visual detriment as one enters the Battle Lake city limits • We feel there will be increased noise and traffic caused by the use of this building. • While we don't wish to discourage the development of local business interests, we believe that there are far more appropriate sites for such a development. This is a beautiful natural area, and we would like to keep it as undeveloped as possible. This kind of building shouldn’t be on lakeshore anyway. 2. There will be increased traffic and noise to this area because of this building. 3. This storage building will be like these buildings often are - notoriously ugly and owned by someone who doesn’t live near there and doesn’t have to look at it. 4. Also, this property has been zoned residential/agricultural. We don’t believe this property should be re-zoned commerial and this building constructed on lakeshore. Here's our input to this public hearing: We object to construction on this site for several reasons: • This lake (known locally by some as "Brickyard Slough") is an ecologically sensitive natural area. In fact, this lake has served as a nesting area for loons the last three years. This year (though unsuccessful), a pair nested on the shoreline of the property of the proposed storage building. As members of the Minnesota Ornithologists Union, we have tracked bird life on this lake for many years, and we believe the construction of this building will have a negative impact environmentally. • The large size of this building will necessitate significant clearing of this wooded lot because the building will likely require a row of entrances on both sides of its 206' length. Additional clearing of land would also occur if a septic tank/drain field is installed. At any rate, there will a loss of a large number of trees. • Also, "Brickyard Slough" has some local historical value. We suggest and, if given a reprieve, will work toward city or public purchase of this land as a historical/natural area adjoining Battle Lake. This lake has, so far, escaped noticeable development, and we believe this site could serve as a natural, visually- welcoming entrance to the Battle Lake city limits. While we don't wish to discourage the development of local business interests, we believe that there are far more appropriate sites for such a development. I have met with the Town of Edna and have presented them our plans. They have indicted that the roadway and lots meet their standards. The road builder will be in touch with Town Board as to their specifications. The road will not be impacting any wetlands. The property is described as S 1100’ of GL 7 in Section 29 excluding trail & roadway & Sublot 1 of GL 6 excluding trail & roadway in Section 30 of Edna Township; McDonald Lake (56-386), RD. Julie Thom expressed to the Commission that she had a concern with the number of lots, and felt they should be kept to a minimum - she also asked if they were planning on having any covenants on the plat. Gloria Bates/Russell Thompson -Denied: A Conditional Use Permit Application to construct and operate a storage rental building. (This Application is to request the rental use, if approved, a Site Permit would be required.) The property is described as Lot F Ex Hwy R/W of Dursch’s Silver Bay, Section 33 of Everts Township; Unnamed Lake (56-305), GD. Russell & Audrey Thompson (buyers) represented the Application. John Matteson (representing COLA) expressed concerns as to why the lake is classified GD and also indicated that this is a holding area for run-off from the surrounding area. The availability of commercially zoned land within one mile of this site. 4. The designation of Hwy 78 as a State Scenic Highway. 5. The land lies too close to residential properties for the construction and operation of such a facility. (It should be noted that items 2-4 were reasons cited by the Everts Townboard.) Also, the Commission recommends that the DNR review the classification this Unnamed Lake (56-305) and reclassify it as NE. 1. The area is currently zoned residential/agricultural. 2.
