It has one small window facing the lake (north) and the door faces east. The building sits on a foundation of cement blocks that are not cemented together. Through the years the foundation has settled and as a result the structure is not straight or plumb. Due to the before mentioned foundation and structural defects, the best solution would be to remove the existing structure, solidy the foundation and reconstruct the 10x12 building|ln the same location. The greatest percentage of all wall areas will be glass/screen with a door to be located on the east side of the structure. The use of the building is to be a free standing porch type structure. X ^nat^ Of Applicant 19 Time:^^Date of hearing: ____ MOTION AS FOLLOWS: Motion was made by Cecil Femling, seconded by Randall Mann and unanimously carried, to deny the variance as requested and to grant the attachment of a water - oriented accessory staicture, to the lake side of the existing dwelling, being constructed of at least 80 percent glass and/or screen, being no more than 10’ in height and having an area of 260 square feet or less with the condition that the 10’ by 12’ structure must be removed. It was noted that the removal of the existing 10’ by 12’ structure and the attachment of a water - oriented accessory structure to the front of the existing dwelling will be an improvement over the current situation. Pfeffer, Battle Lake, MN, requested the following: “The present 10 x 12 wood frame building use is as a storage building, it has one small window facing the lake (north) and the door faces east. Due to the before mentioned foundation and structural defects, the best solution would be to remove, the existing structure, solidy the foundation and reconstruct the 10 x 12 building in the same location. The greatest percentage of all wall areas will be glass/screen with a door to be located on the east side of the structure. The use of the building is to be a free standing porch type structure. Replacement of the structure in the requested manner will improve visibility by 80 to 90%.” A variance of 8’ from the required ordinary high water level setback of 20’ and a variance of 63' 4” from the required side lot line setback of 65’ would be necessary for the construction of the proposed stmcture in the same location as the existing stmcture (12’ from the ordinary high water level and 20” from the side lot line). The property is described as Lot 1, Dursch’s Silver Bay, Silver Lake in Everts Township. The audience was polled with no one speaking for or against the request. After consideration, motion was made by Cecil Femling, seconded by Randall Mann and unanimously carried, to deny the variance as requested and to grant the attachment of a water - oriented accessory stmcture, to the lake side of the existing dwelling, being constmcted of at least 80 percent glass and/or screen, being no more than 10’ in height and having an area of 260 square feet or less with the condition that the 10’ by 12’ stmcture must be removed. Gerald and Debora Olafson - Denied/Aprpoved Gerald and Debora Olafson, Bismarck, ND, requested a variance to constmct an approximately 30’ by 30’ deck, on the North side of the existing dwelling, being closer than 30’ to the ordinary high water level and exceeding 36” in height. The property is described as part of Government Lot 2 (Called Tract C and adjacent to Lot 37, Lake View Beach), Section 11 of Scambler Township by Pelican Lake. The audience was polled with Floyd Lecy speaking in favor of the request. After consideration, motion was made by Cecil Femling, seconded by John Everts and unanimously carried, to deny the variance as requested and to grant the attachment of a water - oriented accessory stmcture to the existing dwelling with the condition that it must be setback at least 20’ from the ordinary high water level, be no more than 10’ in height and have an area of 260 square feet or less. Pier Hospitality Corp. ■ Denied Pier Hospitality Corp, Ottertail, MN, requested a determination that the boat/bar is not a stmcture as defined in the Shoreland Management Ordinance and if it is determined to be a stmcture that it be allowed to remain in its present location. The boat/bar is presently located approximately 40 to 45’ from the ordinary high water level. The property is described as part of Government Lot 3, Section 21 and the Northwest Quarter of the Northwest Quarter of Section 28 of Otter Tail Township by Otter Tail Lake. Dennis Hagstrom, Attorney, appeared along with Landis Weaver at the public hearing. The audience was polled with Deb Weaver speaking in favor of the request. Letters in favor of the variance request from Debra TJaden and Glen McDowell were read for the record. After much discussion and consideration, motion was made by Cecil Femling, seconded by Robert Schwartz and earned with Randall Mann and George Walter voting no, to deny the variance as requested.
