The property is described as Lot 10, Dursch Silver Bay, Silver Lake in Everts Township. The audience was polled with no one speaking for or against the request. After consideration, motion was made by John Everts, seconded by Craig Anderson and unanimously carried, to approve a variance of 1 4" from the maximum height requirement of 36" for the construction of a ramp with a railing having a height of 50". Hardship being the terrain and topography of the applicant's property. The applicant has a narrow lot. It should be noted that the railing will not obstruct the vision of the neighboring property owners. After additional consideration, motion was made by Carl Johnson, seconded by Cecil Femling and unanimously carried, to deny the variance of 8' from the required side lot line setback of 1 O' for the 4' by 12' storage area as other alternative locations do exist where the storage area could be located. After additional discussion, motion was made by Carl Johnson, seconded by Craig Anderson and unanimously carried, to allow the applicant to attach a storage area on the north side of the dwelling extending no more than 5' towards the lake and being no greater in size than 5' by 12', It should be noted that the applicant does not have any other water-oriented accessory structure on the property. MN Mr. Wayne Stein, Secretary Board of Adjustment Courthouse Fergus Falls, Minnesota 56537 Dear Members of the Board of Adjustment: I am writing to state my opposition to the variances requested by Grace and Tom Stoebe on West Battle Lake. There are several reasons why established setbacks must be adhered to: This extremely sensitive environmental area needs the protection afforded by existing lakeshore ordinances for its survival. 1. 2. The topography would have to be altered radically to accomodate construction and septic needs due to the limited elevation above water table. 3. The area provides unique habitat for numerous waterfowl. 4. No hardship exists given the amount of land available for building. The letter to the Board of Adjustment dated June 4, 1994 from the Stoebes states that they have been working on site planning since 1990. I would hope that they had been advised by Mr. Griep, at that time, the importance of building within the constraints of ordinances, rather than relying on the variance route. They further state that they do not intend to use the shoreline infront of lots 77, 78, and 79. This certainly is an acknowledgement of the fragility of the shoreline, but it in no way provides protection for the future. Current ordinances tend to limit interference with the natural state of the environment. Variances should only be given in dire circumstances, not as a convenience. AUDITOR JUL 1 2 ler/; l=EnQUSFAaS,MN July 11,1994 To; Members, Otter Tail County Board of Adjustment From: Chris Schuelke, Otter Tail County Historical Society Re; Variance for lots 77,78 and 19, addition to Stony Point I would like to express my concern fOT the application of variance from Ms. Grace A.Stoebe of Burnsville, Minnesota, for the construction of a proposed dwelling on West Battle Lake. As you are aware, an area of land on the North side of the outlet of West Battle Lake, was donated to the non-profit organization People of a Sacred Place, Inc. The purpose of the donation was to allow a spot of land were the Chippewa and Sioux could come and honor their spiritual and physical heritage. They agreed to share this ground with all people who would come for the same reasons. We are concerned that the proposed construction project would negatively affect the land and natural wildlife in the area and thereby adversely effect the Sacred Place historic site. Existing shoreline ordinances offer sufficient protection and should be enforced to prevent overdevelopment on the lake. There are very few natural areas remaining on West Battle L^e. Consider the ramifications of construction to the area. You many find the cost of development to be too great for the well-being of the lake. If you have any questions or comments, please do not hesitate to contact me.
