I would like to give you a brief history regarding that building project. Prior to Patricia’s decision to purchase a log home in the winter of 2003,1 had been working on a two story plan and/or modifications for 1/1/2 years. Patricia’s constant focus was a home that was a compliment to the shoreline of Battle Lake, hence the log home. Being the log home did not have a garage, Patricia’s focus for the garage was again, two fold, 1...being a compliment to the log home itself, and 2...a garage structure that was pleasing to the neighborhood. After two months of design work, we decided on the present size with a ’^normal 4/12 pitched roof. With the building permit issued for a log home and garage, the garage slab was poured. It was at this time that I had surgery for cancer and while at Merit Care hospital, Patricia phoned me to ask if the garage roof could be “steeper” to match the log home roof, so she could use the area above the garage for storage and an exercise area. After some discussion with Eric,we applied for a variance and that was denied in spite of ‘‘no objections” from the neighbors, and even after a neighbor who attended the meeting spoke on how he thought the garage complimented the log home and both structures were a plus to the lake itself. Again after the variance denial, 1 reviewed my options with Eric, and he informed me that I finally had two choices, 1...lower the roof, and 2...appeal my situation to the court system and possibly pay a fine. I have been building in the Fergus Falls Lake jurisdiction for years, and this is the first time I have not been in compliance, and for this 1 sincerely apologize. Considering the integrity of the log home and garage, 1 would prefer not to lower the garage roof and instead pay a fine, but I will also listen to the courts decision. Site Permit 20207 was issued for the garage structure on April 30, 2003, and indicated that the maximum proposed height was 14 feet. On November 19, 2003, complainant was on the property of defendant and inspected Permit 20207. Complainant found that the detached garage was 22'7" high, in excess of the 20 foot maximum allowable height. On December 16, 2003, a letter was sent to the contractor advising that the property owner needed to lower the detached garage by 2'7" or apply for a variance. The defendant did apply for the variance on February 23, 2004. The Otter Tail County Board of Adjustment did deny the variance as there was no adequate hardship shown on April 1, 2004. On April 20, 2004, complainant sent a letter to the defendant advising that the structure must be lowered by July 2, 2004, according to the decision of the Board of Adjustment. On November 5, 2004, Violation #2207 was sent to defendant advising that she was in violation of the Otter Tail County Shoreland Management Ordinance by failing to comply with the 20 foot height setback for a non-dwelling. Defendant was advised to contact the office by November 12, 2004. Defendant has chosen not to comply with the order of the Otter Tail County Board of Adjustment.
