Sterling and Patricia Tucker - Approved with condition.
Motion was made by Steve Schierer, second by Mark Steuart and unanimously carried, to approve the placement of a
new roof on an existing dwelling located 22’ from the ordinary high water level, with the condition that the portion of
the roof within the shore impact zone cannot exceed a 4/12 pitch, and noting that the portion of the roof outside of the
shore impact zone can be designed as depicted on the applicants’ drawing. It was noted that the variance as
approved will provide the applicants with an ability to maintain there existing property and will provide the applicants
with a reasonable use of their property. Hardship is a substandard lot of record.

Ambrose Zeller - Approved with condition.
Ambrose Zeller, Et. Al., Edina, MN, requested a variance to subdivide, by metes and bounds description, an
existing 9.36-acre parcel into two tracts. One tract would be approximately 4.48 acres and the other tract
would be approximately 4.88 acres. The property is described as part of Government Lot 7, Section 1 of Dora
Township by Lake Sybil. Clem Hendrickson, Surveyor, represented the applicant at the public hearing. The
audience was polled with no one speaking for or against the request. After discussion and consideration,
motion was made by Steve Schierer, second by David Holmgren and carried with Mark Steuart voting no, to
approve the proposed subdivision with the condition that before the conveyance of either parcel can be
recorded each parcel must have an approved and installed septic system. Hardship is the high water level,
which has reduced what was an existing 10.7-acre parcel, as noted on an older registered surveyor’s drawing,
to a 9.36-acre parcel as has been determined by a fairly recent survey. It was also noted that it is in the best
interest of the lake to allow two metes and bounds parcels verses requiring the platting of the applicant’s
property which in all probably would result in more than two parcels thereby increasing the density on the lake.
Curtis J. Winter - Denied
Curtis J. Winter, Dilworth, MN, requested a variance of 8’ from the required side lot line setback of 10’ for the
replacement of a 12’ by 24’ garage with a 28’ by 28’ garage 2’ from the side lot line. The property is described
as Lots 5 and 6, Bowery Beach, Pelican Lake in Dunn Township. The audience was polled with no one
speaking for or against the request. After discussion and consideration, motion was made by Mark Steuart,
second by Steve Schierer and unanimously carried, to deny the variance as requested as no adequate
hardship unique to the property had been shown that would allow for the granting of the variance as
requested. It was also noted that there appears to be adequate room to place the structure in a location,
which will meet the required side lot line setback of 10’. It was also noted that this action is consistent with
prior actions of this board.

Sterling and Patricia Tucker, Battle Lake, MN, requested a variance of 78’ from the required ordinary high
water level setback of 100’ for the placement of a new roof on the existing dwelling located 22’ from the
ordinary high water level. “The property we own on Silver Lake has a flat roof over the entire area. The roof
is in bad condition and needs to be replaced. Instead of putting a new, flat roof on it we would like to put a 12-
foot peak roof on. The new roof would be built of wood rafters, plywood decking and composition shingles.
Both gable ends would be enclosed with wood or vinyl siding. We would also like to enclose the entire
structure with siding to make it more winter proof so we will be able to spend more time there. The present
roof has an irregular shape. To save cost on the replacement roof and to make the property look better we
would like to “square up” the roof so it will cover the irregular areas.” The property is described as Lot 15,
Silver View Park, Silver Lake in Everts Township. The audience was polled with no one speaking for or
against the request. Greg Barry appeared with the applicant at the public hearing. After discussion and
consideration, motion was made by Steve Schierer, second by Mark Steuart and unanimously carried, to
approve the placement of a new roof on an existing dwelling located 22’ from the ordinary high water level,
with the condition that the portion of the roof within the shore impact zone cannot exceed a 4/12 pitch, and
noting that the portion of the roof outside of the shore impact zone can be designed as depicted on the
applicants’ drawing. It was noted that the variance as approved will provide the applicants with an ability to
maintain there existing property and will provide the applicants with a reasonable use of their property.
Hardship is a substandard lot of record.
