conditions: 1. There be only 1 (maximum of 36 square feet in size) lighted sign allowed, must be
located on the existing building. 2. The hours of operation shall be limited to 10:00 am. To 8:00
p.m. 3. The parking must be limited to the existing impervious surfaces (no more additional
impervious surface can be established). 4. The food sales are limited to pre-packaged frozen
treats, with no alcohol sale or consumption. 5. A vision obstructing fence barrier must be created
adjacent to the Mahrer property. Rationale being that it appears that this change of use for the
Buckmeier property will slightly reduce the impact the current restaurant operation has on the
residential neighborhood.

Neighbor, Tim Chisholm, also speaking for the Taylor family, requested that Zorbaz stay the same
because there is no room to grow in this residential area.
Owner of Zorbaz, Tom Hanson, spoke to the fact that he was told about 10 years ago to acquire more
land in the area when possible. This purchase would create 6-8 more staff parking spaces. The
primary purpose of the entire purchase is to obtain more parking and mitigate an expensive piece of
property. He responded to commissioners’ questions regarding traffic, safety, congestion, and the ice
cream/clothing store adding to the problem.
Motion by Lindquist, second by Froemming, to remand the CUP Application of Al Buckmeier back to
the Planning Commission for review and consideration of solutions suggested by surrounding
property owners. County Attorney, David Hauser, stated that the applicant would be required to waive
the 60-day notice period. The applicant was not present at the meeting; therefore, the motion was
rescinded. Motion by Rogness, second by Froemming, to deny the Conditional Use Permit request of
Al Buckmeier to allow Zorbaz to purchase the property and use the existing structure for ice
cream/clothing sales for the following reasons: 1) the request is not compatible with the surrounding
residential area, 2) the request creates a safety hazard by adding a business across Highway 72,
3) the request is not suitable for the area, 4) parking is inadequate and 6 additional parking spaces
will not mitigate the increased parking need when adding a business - the ice cream/clothing store
exacerbates the situation, and 5) precedence has been set by requiring the Graystone to acquire
more property for parking purposes in a similar situation. Chairman Erickson called for a roll call vote

Deterttion Facility Booking Fees
Motion by Huebsch, second by Rogness, and unanimously carried to increase Booking Fees at the
Detention Facility from $10 to $25 effective January 1, 2010.

Conditional Use Permit - Al Buckmeier fPurchaser-Thomas Hanson. Zorbaz:
Land & Resource Director, Bill Kalar, stated that this Conditional Use Permit request consists of the
purchase of property next door to Zorbaz on Otter Tail Lake with intent to use the house as a
business selling ice cream and clothing. The purchase would increase parking by 6 spaces. Letters
of opposition to the request from John Mehl, Marcia Williams, Don Hopper, and the Taylor and

The following is a summary of comments made by the public against the CUP request:X

Rick Bleichner, speaking on behalf of property owners along County Highway 72, expressed concern
regarding inadequate parking which leads to safety issues and the continuing practice of parking on
County Highway 72 in this area. He offered solutions to the issue such as removing the cabin after
purchase and using the complete lot for parking and removing the video games in the current Zorbaz
building and putting ice cream and clothing sales in that area. Keeping the sales in one building
avoids the safety issue of running back and forth across the highway. He stated that property values
in this area are an issue because of Zorbaz with the noise level late at night and the litter that occurs.
He requested that the Board not allow additional businesses without sufficient parking space. A
petition with twenty-nine signatures opposing the CUP was submitted.

entitled "Bal-View Estates 2"'' Addition" consisting of 17 non-shoreland lots and a Conditional Use
Permit to construct a cul-de-sac to service the plat, with an extension to build the cul-de-sac as
recommended by the Planning Commission. The property is described as Lot 1 BIk 1 & Lot 1 BIk 2
Bal-View Estates & that part of the NW1/4 SE1/4, which lies Nwly of the dedicated public road in Bal-
View Estates & adjoins the W line of said NW1/4 SE1/4, Sec 31, Otter Tail Township; Otter Tail Lake
(56-242), GD /.Non-Shoreland.
Conditional Use Permit - Phillio & Patsi Douglas:
Motion by Erickson, second by Lindquist, and unanimously carried to approve a Conditional Use
Permit to build a driveway to a building site with conditions as recommended by the Planning
Commission. The property is described as Pt of GL 4 & SW1/4 NW1/4 (43.92 acres). Section 11,
Friberg Township; High Island Lake (56-697), NE.
Conditional Use Permit - James & Pamela Hauoen:
Motion by Rogness, second by Lindquist, and unanimously carried to approve a Conditional Use
Permit to construct a road with a condition as recommended by the Planning Commission. The
property is described as SI/2 SE1/4 of Sec 18, and NE1/4 NE1/4 of Sec 19, Eagle Lake Township;
Jolly Ann Lake (56-370), NE.
Property Owner, Marcia Williams, expressed concern about safety and increase in traffic and parking
that the additional business will create in an already congested area. She expressed concern that
pizzas may be delivered across the road to the ice cream store which would create further congestion.
Supervisor of Everts Township, Marlyn Krushke, stated that parking has been an issue for a number
of years on Highway 72 and the new request would make the situation worse. He noted that in 2011,
a britjge will be installed at the outlet of Otter Tail Lake causing greater traffic issues at that time.
Karen Zell, previous owner of the Graystone, expressed concern about pedestrian safety and stated
that, when the Graystone restaurant requested expansion, they were required to purchase additional
property for increased parking spaces based on projected traffic created by the new business. She
requested that this requirement be applied to this business as well.

Otter Tail Beach Club / Gary Fluto - Approved As Presented:
A Conditional Use Permit Application {as stated by the Applicant): Remove current mobile home
14’ X 66’ X 12’ (Unit I) Remove wooden deck - 12’ x 18’. Build on cement slab wooden
structure 15’ x 70’ x 12’. To comply with Board of Adjustments as agreed on to move site
over 10’ from property line and back from existing site approx. 8’ in line with existing
trailers. Property is currently at 25% impervious surface - existing structure and deck at
1140 sq. ft.; proposing 1050 sq. ft. Therefore, impervious surface will be decreased by 90
sq. ft. The property is described as 2.5 acre tract in GL 3 & 5, Section 12 of Amor
Township: Otter Tail Lake (56-242), GD.
Gary Fluto & Stacy Rindy represented the Application.
Motion: A motion by Schwartz, second by Gill to approve as presented. Voting: All
members in favor.
Al Buckmeier (Purchaser - Thomas Hanson. Zorbaz) - Approved With Conditions:
A Conditional Use Permit Application (as stated by the Applicant): Use the house located on
the property for a Zorbaz Clothing Store, an ice cream parlor and additional parking on the
property. No exterior changes or new pavement - use existing structure as exists. Not to
be used for alcohol sales or consumption. The property is described as Lot 2 Otter Tail
River Park & strip 10’ wide SW of & adjoining Lot 2 Otter Tail River Park, Section 4 of
Everts Township; Otter Tail Lake (56-242), GD.
Thomas Hanson (Zorbaz Owner) & Tyler Currie (Zorbas Manager) represented the
Application.
Trent Mahler (Attorney representing Shirley Mahrer) expressed concerns with a
commercial business being next door (i.e. density, traffic/parking, & noise) & spoke in
opposition to the request.

A Preliminary Plat titled "Bal-View Estates 2"'’ Addition”, consisting of 17 (15 residential & 2
non-buildable/commercial) Non-Shoreland Lots, 3 Blocks; and a Conditional Use Permit
Application (as stated by the Applicant): For the construction of a 70 foot radius cul-de-sac,
approximately half of which lies within 1000 feet of Otter Tail Lake. This cul-de-sac
construction is part of a preliminary plat application for Bal-View Estates 2"“' Addition,
whose 17 proposed lots with another 70 foot radius cul-de-sac and the previously
dedicated road corridor all lay outside of 1000 feet of Otter Tail Lake.
It is estimated that approximately 250 cubic yards of cut will be required for shaping along
with approximately 350 cubic yards of fill for shaping and graveling. The property is

The property at 36102 County Road 72 will be used for a Zorbaz clothing store and
ice cream store.
The application for conditional use will serve as and adjunct to the existing Zorbaz
business to provide additional parking primarily for staff and customers of the
clothing and ice cream store. It will also provide additional parking in the back of
the property for staff parking for both Zorbaz businesses.
As was recommended by the board to me, when the property became available
adjacent to Zorbaz I should attempt to acquire it to increase my parking.
No liquor or beer will be sold or consumed on the property. There will be no kitchen
or food preparation on the premises.

Hi David,
I believe the " directive" that Mr.Bleichner references was the County Board's 1st motion which would
have referred this matter back to the Planning Commission for reconsideration (specifically parking
concerns). This motion was rescinded due to the 60 day rule (the applicant was not at the County Board
meeting). The County Board's 2nd motion denied this request for 5 reasons including parking concerns.

Attached is a letter the County Board received regarding parking and traffic near Zorbaz. This comes up periodically. I am
not aware of any blanket prohibition of parking aiong county highways, MS 169.32-169.36 . We can post for no parking.
Are you aware of anything we can or should do?
Zorbaz has a conditional use permit, and so long as they meet those conditions they are entitied to operate.
The License apparently is issued by the township. I think any revocation of the license has to be for alcohol related reasons
340A.415.1 don't know that they have a basis to deny a permit.
Last fall he was denied a conditional use permit to add business to the area across the street. I'm not sur what "directive"
the letter writer is referring to. More parking wouid be good, but we can't mandate purchasing land.
Does any one have ideas?

Dear Otter Tail Count}' Commissioners:
v/-I am writing in reference to the situation regarding parking at Zorbaz on Ottertail Lake.
At the October 2009 County Commissioners meeting, the issue of not providing enough
parking spaces for their customers was brought before the board and Mr. Tom Hanson,
Zorbaz owner. At that meeting Mr. Hanson was directed to go back to the Planning
Commission to discuss his parking problem and his misuse of County Highway 72 as his ^
“personal parking Iot“. To this date, I am unsure if there was ever anything done to ^alleviate this problem for all of us who live along this stretch of county property and those ^
who drive on County Highway 72 during their summer business season. ^ ^ At
I have since visited with officials from Everts township and they too are wondering what is C
to come of this situation. It is my belief that Mr. Hanson may have scoffed off the idea and
will do absolutely nothing to correct this wrong. I will reiterate one more time, I am not , ^
against his business, but am totally confused as to why he can continue to do nothing and ^
get by with that. If I recollect, it is illegal to park on county highways.
I have offered some remedies and will continue to do so again:
1. Purchase the cabin that is for sale adjacent to his property, raze the cabin
and make that into a parking lot.
2. Remove the cabin that currently sits on his property and make that into a
parking area.
3. Put up “No Parking” signs along County Highway 72, (This may be
unfair to those who own cabins and have limited parking on their lots
when friends and family visit). Maybe a better idea is to put
“No Business Parking”.
4. Hold back his liquor license until he complies with your directives last fall.

These are just a few ideas that come to mind and I am sure that there are a number of
other options. I am interested in learning what he has done and what be intends to do. I
