Motion was made by David Holmgren, second by Steve Schierer and unanimously carried, to approve a variance of
37’ from the required ordinary high water level setback of 100’ and a variance of 4’ from the required septic tank
setback of 10’ for the location of a 12’ by 17’ deck 63’ from the ordinary high water level and 6’ from the septic tank.
Hardship is a substandard lot of record.

David and Carol Place - Approved
David and Carol Place, Battle Lake, MN, requested a variance to build a 10’ by 40’ addition to the south
side of the existing cabin (far side from the lake). The existing cabin, which is approximately 28’ from
the lake and 22’ wide, was built within the current shore impact zone. The addition will be
approximately 50’ from the lakeshore. The southwest corner of the new addition would be 2’ from the
edge of the easement road. It should be noted that the easement road could be moved 4 to 5’ to the
south. The property is described as part of Government Lot 4, Section 11 and part of Government Lot
1, Section 14 of Eagle Lake Township by Eagle Lake. The audience was polled with no one speaking
for or against the request. After consideration, motion was made by Steve Schierer, second by David
Holmgren and unanimously carried, to approve a variance to build a 10’ by 40’ addition to the south
side of the existing cabin (far side from the lake) as depicted on the applicant’s drawing. Hardship is a
substandard lot of record.
Jeffrey and Judy Lopez - Approved
Jeffrey and Judy Lopez, Moorhead, MN, requested a variance of 20’ from the required ordinary high
water level setback of 100’ for the replacement of a roof on an existing structure 80’ from the ordinary
high water level. The property is described as Lots 1 A, 4 and 5, Jerry - Marg Beach First Addition,
Scalp Lake in Hobart Township. The audience was polled with no one speaking for or against the
request. After consideration, motion was made by David Holmgren, second by Steve Schierer and
unanimously carried, to approve a variance of 20’ from the required ordinary high water level setback of
100’ for the replacement of a roof on an existing structure 80’ from the ordinary high water level. The
granting of the variance as requested will allow the applicant the ability to maintain his property and to
enjoy the same rights and privileges as others in the immediate area. It was noted that the applicants
have submitted a realistic request. Hardship is the terrain of the applicants’ property.

Tom and Virginia Kueppers - Denied
Tom and Virginia Kueppers, St. Paul, MN, requested a variance of 1.5’ from the required side lot line
setback of 10’ for the placement of a dwelling, with an attached garage, 8.5’ from each side lot line.
The property is described as part of Government Lot 6, Section 21 of Hobart Township by Rose Lake.
The audience was polled with Gerald McKenzie requesting that the 10’ side lot line separation be
maintained. After consideration, motion was made by Cecil Femling, second by Richard Sha and
unanimously carried, to deny the variance as requested noting that this is new construction that should
be designed to fit the lot and noting that other alternatives that do not require the granting of a variance
should be considered by the applicants.
