Minnesota July 5, 2007 Page # 2 Eugene, Sharon and Shawn Wilde - Approved the ordinary high water ievel setback variance as requested and denied the side lot line variance as requested. (6:58 p.m.) Eugene, Sharon and Shawn Wilde, Lot 42 Deer Lake Beach, Deer Lake in Everts Township, requested a variance of 4.7’ and a variance of 5.8’ from the required side lot line setback of 10’ and a variance of 35’ from the required ordinary high water level setback of 100’ for the location of an existing shed 4.2’ on the north end and 5.3’ on the south end from the side lot line and 65’ from the ordinary high water level. The audience was polled with Ken and Mona Anderson speaking for the variance as requested. A letter from Dave Reynolds and a letter from eight neighbors in support of the variance as requested were read for the record. After discussion and consideration, Michael Harris made a motion, second by Steve Schierer and carried with Paul. Larson voting no, to deny the side lot line variance as requested and to approve as requested a variance of 35’ from the required ordinary high water level setback of 100’ for the placement of an existing 6’ by 10’ shed at least 10’ from the lot line and 65’ from the ordinary high water level. The variance as granted will provide the applicants with a reasonable use of their property. James and Patti Paul - Denied. (7:20 p.m.) James and Patti Paul, Lot 9 Fawn Oaks Development, McDonald Lake in Edna Township, requested a variance of 45’ from the required ordinary high water level setback of 100’ for the purpose of remodeling an existing dwelling. Remodeling includes replacing one story structure, with a two story structure on same footprint, using same foundation. This is a 16’ by 26’ replacement addition. Eliminating rock and sidewalks as necessary to accommodate 8’ by 26’ entryway to east side of dwelling. This section of the addition passes the string test and the 25% Rule. The audience was polled with no one speaking for or against the variance as requested. After discussion and consideration. Rod Boyer made a motion, second by Michael Harris and unanimously carried, to deny the variance as requested as no adequate hardship unique to the property had been shown that would allow for the granting of the variance as requested. It was noted that the proposed two story replacement addition would be ahead of the string line and that the applicants have and/or can obtain a reasonable use of their property without the granting of the variance as requested. William and Lorrae Lindquist - Approved the variance as requested with a condition. (7:30 p.m.) William and Lorrae Lindquist, Lot 15 Birchwood Subdivision, Little McDonald Lake in Edna Township requested a variance of 21 ’ from the required ordinary high water level setback of 75’ for the repair/replacement of the existing roof and deck located 54’ from the ordinary high water level and a variance of 5’ from the required ordinary high water level setback of 75’ for the construction of a new deck and a roof overhang which will be located 70’ from the ordinary high water level. Tony Stoll, Architect, represented the applicants at the public hearing. The audience was polled with no one speaking for or against the variance as requested. After discussion and consideration, Steve Schierer made a motion, second by Carl Zick and unanimously carried, to approve a variance of 2T from the required ordinary high water level setback of 75’ for the repair/replacement of the existing roof and deck located 54’ from the ordinary high water level and a variance of 5’ from the required ordinary high water level setback of 75’ for the construction of a new deck and a roof overhang which will be located 70’ from the ordinary high water level as described in the variance application dated June 1, 2007 and as depicted on the drawing submitted with the application with the condition that no more than 25% of the total lot area can be covered with impervious surfaces. The variance as approved does not directly or indirectly grant any other variances. /-3u> I / y SCAL-E DRAWI n g form U S5c>ooH^r>^7-.'^f^)0 Tsm.
