After consideration and discussion, Darren Newville made a motion seconded by Rick West and carried to approve
the variance as presented to construct an addition across the north side of dwelling and Vi story bonus room above
the existing dwelling and proposed addition being 5’ fi-om the east lotline and 39’ from the ordinaiy high-water
level. This decision is based on the Findings of Fact and Decision Form, which contains the criteria reviewed and
the Board’s finding have been attached to and incorporated as an official part of the minutes which have been placed
file with the Land & Resource Management Department. The variance granted shall expire five (5) years from
the date of approval. The expiration date of this variance approval is June 9, 2027.

A variance may be granted only where the strict enforcement of county land use controls will result in a "practical difficulty". A
determination that a practical difficulty exists Is based upon consideration of the following criteria:
The applicant identified the following practical difficulty: Current cabin is 570 so. ft. and would like to make this a year-round home.
With the narrow size of the lot and the location of the well and septic, would like to put the addition across the whole side of the
back of the cabin. The current deck needs repair so plans are to remove the deck and replace with a smaller patio which will
decrease the shore impact zone impervious surface coveraRe to be complaint.

The Board of Adjustment may impose conditions in the granting of variances. A condition must be directly related to and must bear
a rough proportionality to the impact created by the variance. [Mitigating impervious surface with storm water management, deep
rooted vegetative buffers, rain gardens, etc.)
It is the Board of Adjustment's job to apply appropriate legal standards to a specific fact situation. Variances are meant to be an
infrequent remedy where an ordinance imposes a unique and substantial burden.

Gary & Jill Crindle -Variance Application Tabled to July BOA Meeting (6:23 p.m.)
Gary & Jill Grindle, Lot 1 Ex Platted & Lot 36 Blk 1 of Echo Ranch Riviera 7* Addition, Parcels not to be Split, Otter Tail River (56-
OTR) in Otter Tail Township requested the following: Requesting variances from current ordinance river setback of 150’ from
OHWL. On Gov’t Lot 1, remove existing substandard cabin, small shed & old concrete sidewalks equivalent to approx. 1010 sq. ft. &
replace with a new, approx. 2100 sq. ft., one level dwelling at the same distance of approx. 22 ft. from the river channel as current
cabin. Requesting setback variance on Lot 36 to build a approx. 2500 sq. ft. storage shed/workshop at 95 ft. from OHWL. Proposal
includes removal of current old septic holding tank & installing an approved new code compliant drain field septic and also drilling a
new deep well. These lots are permanently attached and were recorded prior to Oct. 15, 1971, the size, shape, and location of these
parcels makes it impossible to conform to current shoreline setback standards.
Gary & Jill Grindle, property owners, represented the variance application. The audience was polled with no one speaking for or
against the variance as requested. An email submitted from .lacquie Schneewind indicating she has no objections to the variance
request.
After consideration and discussion. Darren Newville made a motion seconded by Rick West and carried with the applicant’s
permission to table the request until the July 14, 2022, Board of Adjustment Meeting. Applicants will need to submit revised request
by June 28, 2022.
Kerry Tomlinson, Et Al - Variance Application Approved as Requested (6:45 p.m.)
Kerry Tomlinson. Lot 13ofK.B. Beach & Lot I Blk 1 of Tomlinson Oaks. Little Pine Lake (56-142) in Corliss Township requested
the follow ing: Requesting a 4” \ ariance from each side yard setback of 10’ to construct a new dwelling 9’8" from each side property
line. Past properts information notes 50’ propert\ w idth. but Certified survev shows 49.68’ width at road and 49.86’ v\ idth near lake.
Kerry fomlinson. property owner, and Kelli Wegschied. Hannonious Architecture represented the \ariance application. Nancy
Bossert spoke in opposition to the \ariance request indicating that her property will be directly impacted.
After consideration and discussion. I homas Lee made a motion seconded by Danen Nev\ ville and carried to approve the \ ariance as
presented to construct a new dwelling being 9’8” from the North property line and 9’8" from the South propeily line. This decision is
based on the Findings of Fact and Decision Fomi. which contains the criteria review ed and the Board’s finding have been attached to
and incoiporated as an official part of the minutes w hich have been placed on file w ith the Land & Resource Management

this system is compliant with all OTWMD and State Codes. This letter of compliance is valid for
5 years from the date of the inspection listed above. This system is sized for a 2-bedroom
dwelling. The OTWMD has no issue with a building permit being issued for this property as
long as the total number of bedrooms does not exceed a total of 2-bedrooms. All wells are the
owner’s responsibility.
