OF THE
OTTER TAIL COUNTY BOARD OF ADJUSTMENT
May 2tid, 1996
The Otter Tail County Board of Adjustment met Thursday, May 2nd, 1996, with the following persons in attendance:
Craig Anderson
John Everts

Wally Senyk, County Attorney
Call to Order - The meeting was called to order at 6:00 p.m. by Chairman George Walter.
Minutes Approved - March 28th, 1996 and April 4th, 1996
Hearing no corrections or additions the minutes of the March 28th, 1996, meeting and the minutes of the April 4th, !
1996, meeting were approved as mailed.
The following variance requests were heard:
Wayne and Janice Ward - Tabled
Wayne and Janice Ward, Mooreton, ND, requested a variance of 63’ from the required side lot line setback of 65', a
variance of 29' from the required side lot line setback of 65’ and a variance of 18!.from the required ordinary high
water level setback of 20’ for the repair of a water - oriented accessory structure located.2’ from the west lot line, 36’
from the east lot line and 2’ from the ordinary high water level. The property is described as Lot 24 and a triangular
tract 15’ on the north and 0’ on the south of Lot 25, Deer Lake Beach in Everts Township. The audience was polled
with no one speaking for or against the request. A letter from Robert and Eileen Tolbert in favor of the applicants’
variance request was read for the record. After consideration and upon a written request frorri the applicants, motion
was made by Randall Mann, seconded by Craig Anderson and unanimously carried, to table this variance request
until the June 6th, 1996, meeting for a determination by the Land and Resource Management Department as to
whether the proposed project is a remodeling project or a replacement of an existing structure.
Tim T. Schmitz - Approved
Tim T. Schmitz, Perham, MN, requested a variance of 1’ 10” from the required side lot line setback of 10’ for the
cpnstruction of a 51’ by 24’ addition to an existing dwelling 8’ 2” from the side lot line. The property is described as
Lot 7, Brooklyn Addition to Belka Beach, Little Pine Lake in Gorman Township. The audience was polled with no one
speaking for or against the request. After consideration, motion was made by Craig Anderson, seconded by Robert
Schwartz and unanimously carried, to approve a variance of T 10” from the required side lot line setback of 10’ for
the construction of a 51’by 24’addition to an existing dweiling 8’2” from the side lot line. It was noted that an existing
garage on the property line will be removed resulting in'an overall net improvement to the applicant’s property. It was
also noted that even with the addition less than 25 percent of the total lot area will be covered with Impervious
surfaces.

The Otter Tail County Board of Adjustment met Thursday, June 6th, 1996, with the following persons in attendance:

Call to Order - The meeting was called to order at 6:30 p.m. by Chairman George Walter.
The following variance requests were heard:
Martelle B. Sherman - Denied
Martelle B. Sherman, Richville, MN, requested a variance of 4’ from the required side lot line setback of 10’ for the
placement of a 12’ by 20’ garage 6’ from the side lot line. The property is described as Lot 7, Beauty Beach, Otter
Tail Lake in Amor Township. The audience was polled with no one speaking for or against the request. After
consideration, motion was made by John Everts, seconded by Craig Anderson and unanimously carried, to deny the
variance as requested as no adequate hardship had been shown. The applicant was granted until August 1st, 1996,
to remove that portion of the garage that is closer than 10’ to the side lot line.
Larry O. Johnson - Tabled
Larry 0. Johnson, Waconia, MN, requested a variance of approximately 100’ from the required ordinary high water
level setback of 200’ for the placement of a travel trailer approximately 100’ from the ordinary high water level, a
variance of approximately 50’ from the required ordinary high water level setback of 200’ for the installation of an
underground sewage receptacle and a variance of 34’ from the required ordinary high water level setback of 200’ for
the construction of a 24’ by 30’ metal-clad pole storage shed 166’ from the ordinary high water level. The property is
described as part of Government Lot 3, Section 36 of Effington Township by Twin Lake. Prior to the meeting the
applicant submitted a letter requesting that his variance request be tabled until the June 13th, 1996 meeting. After
consideration, motion was made by John Everts, seconded by Cecil Femling and unanimously carried, to table the
applicant’s request until the June 13th, 1996, meeting.
