Motion was made by Randall Mann, second by Cecil Femling and unanimously carried, to approve a 45’ variance from the required ordinary high water level setback of 100’ for the placement of a dwelling, having a deck less than 3’ in height, 55’ from the ordinary high water level. It was noted that the proposed location of the dwelling at 55’ from the ordinary high water level would place the dwelling behind the string line and the applicants also noted that the design of the proposed dwelling would eliminate the need for the addition of a porch in the future. Hardship is a substandard lot of record. Loots, Roseville, MN, requested a variance of 19’ from the required ordinary high water level setback of 75’ for the location of a gazebo 56’from the ordinary high water level. The property is described as part of Government Lot 1, Section 25 of Everts Township by West Battle Lake. A letter from James S. and Patricia A. Donelan opposing the applicant’s request was read for the record. The audience was polled with no one speakjng for or against the request. After consideration, motion was made by Randall Mann, second by David Holmgren and unanimously carried, to deny the variance as requested as no adequate hardship had been shown, other locations for the placement of the gazebo are available and a reasonable use of the property can be made without the granting of a Variance. The gazebo must be placed in compliance with the requirements of the ordinance by June 1,2000. Gary and Deborah Stone - Approved with modifications. Gary and Deborah Stone, Fergus Falls, MN, requested a 60’ variance frorh the required ordinary high water level setback of 100’ for the placement of a deck 40’ from the ordinary high water level. It should be noted that the deck would be in line with the decks on the adjacent properties to the east aihd to the west. The variance is necessary for only that portion of the deck, which is within the 50’ shore impact zone. The property is described as Lot 4 and the east half of Lot 5, Deer Lake Beach, Deer Lake in Everts Township. The audience was polled with no one speaking for or against the request. After consideration, motion was made by Randall Mann, second by Cecil Femling and unanirhdusly carried, to approve a 45’ variance from the required ordinary high water level setback of 100’ for the placement of a dwelling, having a deck less than 3’ in height, 55’ from the ordinary high water level. It was noted that the proposed location of the dwelling at 55’ from the ordinary high water level would place the dwelling behind the string line and the applicants also noted that the design of the proposed dvyellihg would eliminate the need for the addition of a porch in the future. Hardship is a substandard lot of record. Lee and Shirley Krump - Withdrawn Lee and Shirley Krump, Battle Lake, MN, requested a variance of 6’ from the required side lot line setback of 10’, a variance of 6.5’ from the required road right-of-way setback of 20’ and a variance of 19% from the maximum allowable imperious surface coverage of 25% for an attached single car garage on a tarred driveway being 4’ from the property line, 13.5’ from the road right-of-way and resulting in 44% of the total lot area being covered with imperious surfaces. The property is described as Lot 11, Block 1, Bakers Addition to Sand Beach Park, Otter Tail Lake in Everts Township. Prior to the meeting the applicants provided written notice to the office of their desire to withdraw their request.
