Nordgaard SUBJECT: Apllication For Variance PROBLEM: The problem which makes this "Application For Variance" necessary was reported to me in a letter dated June 11, 1986, in which inspector Dave Houkos stated that it had been called to the attention of the Department of Land and Resource Management that I had constructed a '•Vision Obstructing Fence" on ny property, understand the problem and grant the "Variance".that I hereby request. It is hoped that the information provided herein will enable you to EXCEPTIOML CIRCUi‘lSTAi^CES CAUSE HARDSHIPS—As you consider the information that I will pBsent, please keep in mind the following details: My property is located adjacent to the very popularPublic Access located at the West end of Otter Tail Lake, A fence is an absolute necessity, so that the "Public" will know the location of the property line. 1, The fence that was replaced was a type that provided no privacy what-so- ever and did nothing to conceal the lack of of maintenance and control that exists there. As a result, I have mowed the lawn and picked up the dead fish and litter on the Public Access since purchasing une property in 1966, My new fence provides the privacy desired and elimated the need to main­ tain the Public Access. I am still doing maintenance on the Public Access, even though the same need is not present. 2. I cannot meet Shore Management requirements, because my lot is located on a narrow strip of ground tetween a major highway (72) and Otter Tail lake. The lot has SO feet of lake shore and a depth of 100 feet. 3. u.The heavily travelled highway at the rear of my cottage produces much dust and noise. REASaiB- WHY THE HIGH FENCE WAS SELECTED OVER Ai\iY OTHER TYPE: Since my property is located adjacent to Public Highway 72 and the West end Public Access on Otter Tail Lake, it is very difficult to have complete priv­ acy of any kind. The high fence provides a privacy that has not been possible before. 1, The new fence is high enough to make it difficult to enter my property from the access side and the road side. The result is less trespassing and more privacy. tyWlien the new sewer system was constructed on my prope/, several trees were removed. The trees provided some protection over dust and noise. The new fence now provides that proection and in a much better manner. 2. 3. PLACEMEi^T OF NEw FEi'jGE—Explanation as to why the new fence cannot corM’orm to the Shoreland Management Ordinance: 1. Fence should be 75 feet from the lake. Such a fence would nou provide the needed separation between my property and the Public Access, 2, Fence should be 20 feet from the public high way. When we constructed the fence,we put it 6 feet further from the highway than that of my neighbor to the South. I assumed that she had placed hers properly. There is only 6 feet from the North property line and ny cottage. Furtherrabre, if I were to conform to this requirement, such a fence would not protect my property from tresspassing by the" piiblic when using the Public Access. QUESTIONS THAT I WOULD LIKE TO ASK THOSE WHO STATE THAT M FENCE IS ''VISION OBSTRUC- TING'!'. 1. Just what is it that you are unable to see because of my fence? 2.
