Roger Warren Lillemon - Approved Roger Warren Lillemon, Fergus Falls, MN , requested a variance of 17' from the required ordinary high water level setback of 100’ for the replacement of an existing 12' by 46' mobile home with a 16'by 80'mobile home. The property is described as Lot 18, Block I.Timberlane Hill, Otter Tail River in Everts Township. The audience was polled with no one speaking for or against the request. A letter from Elmer Berg was read for the record, Mr, Berg expressed in his letter that he was not opposed to the variance request, but desired to have the same building setback rights as requested by the applicant and expressed a concern regarding the view by adjacent property owners of the river and the surrounding area. After consideration, motion was made by Dan Oehler, seconded by Cecil Femling and carried with John Everts voting no, to approve a variance of 1 7' from the required ordinary high water level setback of 100' for the replacement of an existing 12' by 46‘ mobile home with a 16' by 80’ mobile home. The granting of this variance does not change substantially the conditions of this lot and the granting of this variance will allow the applicant to make the best use of the existing property. Roger Galbreath - Denied Roger Galbreath, Fergus Falls, MN, requested a variance of 41' from the required ordinary high water level setback of 75' for the construction of a 12' by 24' addition to the north side of an existing dwelling. The property is described as part of Government Lot 4, Section 4 of Dane Prairie Township on Wall Lake. The audience was polled with no one speaking for or against the request. After consideration, motion was made by Cecil Femling, seconded by John Everts and unanimously carried, to deny this variance request as other alternatives do exist for the applicant. The parcel will be approximately 39,300 square feet of which 14,561 square feet lies within the township road right-of-way. At the November 7th, 1991, Board of Adjustment meeting the following action was taken; approved the subdivision of a 40,347 square foot parcel from the existing farmsite and approved a 40' variance from the required 100' setback from the ordinary high water mark for the construction of a 26' by 32' cabin, provided that the following conditions are met; New structure cannot be any closer to the lake than the neighbors on either side, a surveyor's drawing must be provided and any requirements of the Everts Town Board must be « ' J' MINUTES OF THE MEETING OF THE OTTER TAIL COUNTY BOARD OF ADJUSTMENT May 6th, 1993 The Otter Tail County Board of Adjustment met Thursday, May 6th, 1993, with the following persons in attendance: Craig Anderson John Everts Cecil Fern ling Dan Oehler Berton Olson George Walter Tim Griep, Land and Resource Management Kyle Westergard, Land and Resource Management Wal ly Senyk, County Attorney CALL TO ORDER - The meeting was called to order at 6:00 p.rn, by Chairman George Walter. MINUTES APPROVED-April 8th. 1993 Hearing no corrections or additions the minutes of the April 8th, 1993 meeting were declared approved as mailed. The following variance requests were heard: William L. Weitzel -Tabled William L. Weitzel, Wahpeton, ND, requested a variance of 5’ from the required ordinary high water level setback of 75’ and a variance of 120' from the required ordinary high water level setback of 200' for the construction of a 24' by 24' wood frame boat storage and utility building on property located between West Battle Lake and Beauty Shore Lake. The new structure would be placed in line with the existing trailer home and an existing metal utility building will be removed. The property is described as part of Government Lots 2 and 3, Section 20 of Girard Township on West Battle Lake/Beauty Shore Lake. The audience was polled with no one speaking for or against the request. After consideration, motion was made by Craig Anderson, seconded by Cecil Femling and unanimously carried, to table this variance request for additional information and measurements. Russell Allen Hansen - Approved Russell Allen Hansen, Inver Grove Heights, MN, requested a variance of 9' to screen in an existing deck located 21' from the top of a bluff. The property is described as Lot 70, Girard Beach, West Battle Lake in Girard Township. The audience was polled with no one speaking for or against the request. After consideration, motion was made by Bert Olson, seconded by Craig Anderson and unanimously carried, to approve the variance as requested with the condition that there will be no additional construction in the bluff area and that the water from the eaves will be channelled to the west away from the bluff. It should be noted that the applicant is well . behind the building line; andthe deck and the foundation work was completed prior to the enactment of the bluff impact zone requirements and the lot shows no signs of erosion. 4 ‘ May 6th, 1 QQ3 3 met. She expressed concerns regarding the road right-of-way and snow removal. After consideration, motion was made by Dan Oehler, seconded by Craig Anderson and unanimously carried, to deny this variance request due to the substantial change in the area of this parcel from the original application. When the request was originally approved it was thought that this parcel would be 40,347 square feet. The surveyor determined that this lot contained 39,300 square feet of which 14,561 square feet lies within the township road right- of-way. Gary R. Anderson -Tabled Gary R. Anderson, Crete, NE, requested a variance to subdivide a parcel of less than 2.5 acres from an existing 4.96 acre parcel. The parcel will have approximately 230' of lake shore and approximately 2.45 acres of area. The property is described as part of Government Lot 6, Section 21 of Tordenskjold Township on Long Lake. The applicant was represented at this hearing by Jack Hubeny, Otter Tail Real Estate Services. The audience was polled with no one speaking for or against the request. After consideration, motion was made by Craig Anderson, seconded by John Everts and unanimously carried, to table this variance request so the applicant can discuss with the township the existing easement road. John and Janice Thielman - Approved John and Janice Thielman, West Fargo, ND, requested a variance of 31' from the required ordinary high water level setback of 75' for the construction of a 26' by 36' addition to an existing cabin. The property is described as Lots 1 and 2, Merryland Park, Marion Lake in Rush Lake Township. The audience was polled with no one speaking for or against the request. After consideration, motion was made by Bert Olson, seconded by Craig Anderson and unanimously carried, to approve a variance of 31' from the required ordinary high water level setback of 75' for the construction of a 26' by 26' addition to an existing cabin. The addition will be no closer to the lake than the existing structure and the addition will meet all other setback requirements. Dorothy M. Gallagher - Approved Dorothy M. Gallagher, Fargo, ND, requested a variance of 7' from the required side lot line setback of 10' for the construction of two bathrooms to an existing structure. The property is described as Lot 45 and the west 25' of Lot 44, Broadwater Beach, Pelican Lake in Dunn Township. The audience was polled with no one speaking for or against the request. A letter received from William Boyd in favor of this variance request was read for the record. After consideration, motion was made by John Everts, seconded by Craig Anderson and unanimously carried, to approve a variance of 7' from the required side lot line setback of 10' for the construction of two bathrooms to an existing structure. Hardship being a substandard lot of record. There are no structures on the adjacent lot in the immediate area and exceptions from the setback requirements for these types of additions have been granted in the past. ^SCANNED ' * • May 6th, 1993 4 Merlyn E. Ordal - Approved Merlyn E. Ordal, Faribault, MN, requested the following variances. 1,) to enclose a car port under an existing porch, 2.) move the garage doors to the front of the enclosed car port, 3.) add a front entrance door and window, 4,) enclose the existing screen porch with windows and sliding glass door (move the center 8' of the porch out 4' - giving the front a bay window appearance.), 5.) make a 6' cantilevered deck in front of the windows, 6.) move existing stairway 6' forward to meet the deck and creating a new entrance to the home, 7.) have this substandard lot declared a buildable lot, and 8.) to allow the structure to remain in its current location. The property is described as part of the SE1 /4, Section 28 of Otter Tail Township on Round Lake. The audience was polled with no one speaking for or against the request. A letter from La Roche's A- 1 Services regarding the existing sewer system was presented for informational purposes. After consideration, motion was made by Craig Anderson, seconded by John Everts and unanimously carried, to approve the following variances 1,) to enclose a car port under an existing porch, 2.) move the garage doors to the front of the enclosed car port, 3.) add a front entrance door and window, 4.) enclose the existing screen porch with windows and sliding glass door (without the bay window affect), 5.) modify the open deck to permit the entry with the stairs and to place the deck in the position to modify the entrance to give full height and level entrance (permitting a deck for entry purposes only), and 6.) to move the existing stairwell to meet the deck. Hardship being a substandard lot of record. Zorba's II. Jeffrey I. Tweeton - Approved Zorba's II, Jeffrey I, Tweeton, Perham, MN, requested a variance to construct a 12' by 12' deck on the north side of an existing structure. The deck will be located 27' from the ordinary high water level and will be used for the location of a walk-in cooler. The property is described as Lots 3 and 4, Otter Tail River Park and adjacent strip. Otter Tail Lake in Everts Township, The audience was polled with no one speaking for or against the request. After consideration, motion was made by Craig Anderson, seconded by Cecil Femling and unanimously carried, to approve the construction of a 12' by 12' deck, to be used for the location of a walk-in cooler, 27' from the ordinary high water level. The granting of this variance will not alter the view or the lake shore. Hardship being a substandard lot of record. This is a commercial establishment with a need for additional kitchen facilities, Inspiration Point Bible Camp -Approved Inspiration Point Bible Camp, Clitherall, MN, requested a variance of 30' from the required ordinary high water level setback of 200'; a variance of 17' from the required ordinary high water level setback of 200' and a variance of 4,5' from the required drain field setback of 20' for the construction of a 36' by 45' storage building. The applicant's lot is on a peninsula resulting in the need for two variances from the ordinary high water level setback. The property is described as a 20 acre tract in Government Lot 5. Section 17 of Leaf Mountain Township on Spitzer Lake, Mr, Greg Anderson represented Inspiration Point Bible Camp at this hearing. After consideration, motion was made by George Walter, seconded by Craig Anderson and unanimously carried, to approve a variance of 30' from the required ordinary high water level setback of 200' and a variance of 1 7' from the required ordinary high water level setback of 200' for the construction of a 36' by 45' storage building. The hardship being the terrain features of the property.
