Call to Order
The Otter Tail County Board of Commissioners convened at 11:04 a.m. Tuesday, October 16, 2018, at the
Government Services Center in Fergus Falls, MN, with Commissioners Wayne Johnson, Chair;
John Lindquist, Lee Rogness, and Doug Huebsch present. Commissioner Roger Froemming was absent.
Approval of Agenda
Chairman Johnson called for approval of the Board Agenda. Motion by Rogness, second by Lindquist and
unanimously carried to approve the Board of Commissioners Agenda of October 16, 2018, with the following
modifications.
Public Works Committee - Canceled at 11:30 a.m.
Public Works Committee Scheduled at 1 ;50 p.m. moved to 11:30 a.m.
Resolution Vacating Abandoned Right of Way
Consent Agenda
Motion by Lindquist, second by Huebsch and unanimously carried to approve Consent Agenda items as
follows:

Planning Commission Recommendations
Conditional Use Permit - Robert James Loots:
Motion by Huebsch, second by Rogness and unanimously carried to approve a Conditional Use Permit for
lot alterations as presented. The proposal is located in Pt GL 1, Section 26 of Everts Township; West Battle
Lake (56-239), GD.
Preliminary Plat - “Olson Acres”/Olson Living Tmst:
Motion by Rogness, second by Lindquist and unanimously carried to approve a Preliminary Plat titled “Olson
Acre” consisting of 3 single family residential non-riparian lots. The proposal is located in Pt Government
Lot 3 (10.6 acres). Section 4 of Pine Lake Township; Big Pine Lake (56-130), General Development (GD).
Conditional Use Permit - Jerry & Cindy Humphrey:
Motion by Lindquist, second by Huebsch and unanimously carried to deny this after-the-fact request for a
Conditional Use Permit for the following reasons: 1) the work took place in a bluff; and 2) the existing retaining
wall has not been engineered and does not appear to provide stabilization. The Applicant will work with the
Land & Resource office and the Soil & Water Conservation District (or similar agency) to determine methods
of stabilization. The proposal is located on Lot 51 & 52 of Oak Manor Shores, Section 02 of Dora Township;
Loon Lake (56-523), Recreational Development (RD).
Conditional Use Permit - Bryan & Vicki Severson:
Discussion took place regarding this Conditional Use Permit request to replace one 18” culvert with one 36”
culvert under the driveway at 23247 Severson Lane, Underwood, MN. Chuck Worum, Secretary of the South
Turtle Lake Improvement District (STLID) presented a letter requesting engineering data be provided to the
STLID to show the effect on South Turtle Lake. Commissioner Lindquist indicated that underneath
Highway 122, there is an 18” culvert which is a restrictive flow factor. Commissioners encouraged the LIDs
to monitor water quality. Public Works Director Rick West stated that the County would monitor and manage
the outlet from North Turtle to South Turtle as appropriate. The outlet has been in place since 2007.

P.M. in the Commissioner's Room, Government Services Center, Fergus Falls, Minnesota.
Roll Call:
Members Present: Loren Bailey, Rod Boyer, Richard Gabe, Bert Olson, Jack Rosenthal,
Bruce Stone, David Trites, David Wass and Rick Wilson.
Members Absent: Brent Frazier.
Michelle Eldien represented the County Attorney's Office and Kyle Westergard represented
the Land & Resource Management Office.
Minutes of September 12, 2018: A motion by Wass, second by Gabe to approve the
September 12, 2018 Minutes as presented. Voting: All members in favor.
Bert Olson recused himself from the Meeting.

A Conditional Use Permit Application (as stated by the Applicant on the Application): After-
the-Fact Request. Remove rotted landscaping timbers on sand/grass edge. Replace with
retaining wall block and fabric. 56’ long with a curve on each end that is 8’ total length. Fill in
approx. 15 yards of black dirt on grass area to level out and hold fabric so no erosion. Block
will be 15’ farther from lake than the old timbers. Seed all dirt, add irrigation system. The
proposal is located in Pt GL 1, Section 26 of Everts Township; West Battle Lake (56-239),
GD.

Written correspondence was read into the record.
Richard Richter commented on the location of the railroad ties versus the existing retaining
wall. Pat Rademacher expressed concerns on setting precedence when After-the-Fact Permit
requests are approved.

I hope this letter finds you well. I represent Defendant, Robert Loots, in the above-
referenced case. This case regards a violation of Otter Tail County Ordinance 4.3.B “Grading and
Filling or Alteration of an Existing Topography in a Shore Impact Zone, Bluff’ as Mr. Loots
repaired, and better secured, his property’s shoreline without first obtaining a conditional use
permit. The Otter Tail County Attorney’s Office has agreed to continue the case for dismissal
conditioned on Mr. Loots’s ordinance compliance by obtaining an after-the-fact conditional use
permit and payment of the associated fines and fees. Therefore, please find enclosed a copy of the
perfected Continuance for Dismissal in the above-referenced case, Mr. Loots’s Application for an
After-the-Fact Conditional Use Permit, and a check in the amount of $1,500.00 for the fine and
fee amount for the after-the-fact permit.

Conditional Use Permit After-the-Fact Request

We are the property owners to the west of Robert Loots and his brother, James Loots, property. We are
requesting that Robert Loots not be granted the After-the-Fact Permit; because the work he has done is
graded so that the drainage will flow onto our property and his neighbor's property to the east. Also it is
stated on Robert Loots permit request that the blocks are 15 feet farther from the lake than the old
timbers, which we feel is incorrect. In fact the blocks are closer to the lake than the timbers were. We
request that Rob Loots return the lawn to its original condition.
On September 1, 2018, James Loots informed us that he was not aware that his brother, Rob, had made
changes to the lake frontage and that he did not like it and wanted it returned to its original condition.
The Loots family has had past experience with failing to get a permit for a gazebo on their property on
the lakeside and was required to move the gazebo North away from the lake.
Thank you for your consideration in this request not to grant Robert Loots an After-the-Fact Permit.

Planning Commission and the Board of Commissioners agree to issue one may be a different story. I will let you know if
they do not issue a permit. He would then be required to restore the topography to its original state.

Hi Denise,
I wanted to give you a heads up on this case. The Defendant's attorney contacted me right when it was charged that he
wanted to resolve it because he knows he violated the conditional use permit ordinance. He has agreed to pay a $300
fine plus the court costs and to apply for an after the fact conditional use permit within 30 days and follow whatever
procedures need to be done to get the after the fact permit. Rather than continue the hearing out until he complies, I
am going to agree to a continuance for dismissal so that I can get him to pay the fine upfront and then if he doesn't
follow through with he after the ta fact permit we can resume prosecution and ask for a jail sanction. Wanted to give
you a head sup on the plan for this one and to expect him to get in contact with you or someone from L&R about an
after the fact permit.
