SILVER LAKE HUNTING PRESERVE
The start of this Preserve is to provide a place for the average
sports person to have an affordable place to bring his or her sons and/or
daughters to hunt and target practice.Now with the price of gas it will
be that much more difficult to afford this sport.
A place for the many people who come from out of state or out of this
county that stay at many of the resorts or camp grounds to hunt and target
practice.
There are many businesses in this county that depend on the tourism
This would provide them with one more form of recreation.that come here.
With urban encroachment taking over our farm land and no trespassing
signs going up, we need to preserve our large open areas for the sportsmen
and their children that cannot afford to go to North Dakota or South Dakota,
or any place else.To have a place to hunt and shot and to have them keep
their money in this county rather than to have spent it in other states.
This is part of our culture and heritage and all sportsman and their
sons and daughters have the right to be able to afford this great sport.
SILVER LAKE HUNTING PRESERVE
Operations will consist of pheasant, quail, and chukar hunting.
which will run from September 1st.through April 31st.The hours for
hunting will be from 9A.M. to dark, Monday through Saturday and
1P.M. to dark on Sunday and Holidays.
At this point in time, I am projecting to release approximately
1,000 to 1,500 birds the first year, in a time frame of five years.
I project to release approximately 4,000 or more birds.
Sporting Clay Course.
At this point in time, I have a course that would accommodate
approximately 1 to 7 shooters at a time, open all year round.
I am projecting on a busy day approximately 20 people.
The hours for the course will be as follows:
Monday through Saturday - 9A.M. to 7P.M. or 9A.M. to dark
Sunday and Holidays 1P.M. to 7P.M. or 1P.M. to dark
There will be safety signs with rules posted around the shooting
area.
There will be parking signs in the designated areas.
SILVER LAKE HUNTING PRESERVE
ENVIRONMENTAL PLAN
Restoration:
2002 Planted 7,000 trees.
2004 Planting 28 acres (14 of pasture) in grasses and herbs.
2005 Plan to plant 2,000 trees for buffer along roads.
Non-toxic shot will be used for all bird hunting.
Sporting Clay Course:
Use bio-targets, sulfer based.9

The Otter Tail County Board of Commissioners convened Tuesday, May 25, 2004, at
11:01 a.m. at the Otter Tail County Government Services Center with Commissioners
Sydney Nelson, Chair; Bob Block, Vice-Chair, Dennis Mosher, Malcolm Lee and
Roger Froemming present.
Approval of Agenda
Motion by Mosher, second by Lee, and unanimously carried to approve the County Board
agenda of May 25, 2004, as mailed:
Approval of Minutes
Motion by Froemming, second by Block, and unanimously carried to approve the County
Board minutes of May 18, 2004, as mailed.
Approval to Pay Bills
Motion by Mosher, second by Block, and unanimously carried to approve payment of the
County Board bills per Attachment A of these minutes.
Planning Commission Recommendations
Conditional Use Permit - James J. Stans:
Land & Resource Director, Bill Kalar, stated that this CUP request is for a hunting preserve
and sporting clay course. The Planning Commission denied the request for three reasons as
stated in the Planning Commission minutes of May 19, 2004. Applicant, James Stans,
addressed the County Board stating that he would drop his request for a sporting clay course
and request just the hunting preserve. Motion by Mosher and second by Block to deny the
Conditional Use Permit request for reasons as recommended by the Planning Commission.
Lengthy discussion followed regarding the applicant’s proposed change in plan from the initial
application and the notification process. Motion carried unanimously. The property is
described as W 133.1 Ac of Lots 1, 2 & 3 SWA UEVa & WA and EVz WA (160 AC) and
WA NW% & NWV4 SWA (85.73 AC), Section 18 of Everts Township: Silver Lake (56-302).
Conditional Use Permit - Russell & Elaine Alberp:
Motion by Mosher, second by Block, and unanimously carried to approve a Conditional Use
Permit to excavate to allow for a walkout basement as presented. The property is described

E.B. Floerish Jr. stated that the petition may be in error regarding the damage to
environment; he expressed concerns regarding safety (his chiidren), noise and the fear of
the unkno\wn.
Ned Richeo expressed concerns regarding the lack of detail of the plan and drawing.
Mike Nelson expressed concerns with noise, safety (owner may be concerned with safety,
how can we be assured the clients are), being operated 365 days a year and the effect on
property values.
Motion - Failed: A motion by Maske, second by Schwartz to approve with the following
conditions: 1. No portion of the sporting clay range is to be less than 500' from the
property lines. 2. The shot in the sporting clay area is limited to 7.5 - 9 and no magnum
rounds are allowed in the sporting clay area. 3. Lead shot is not allowed in the Hunting
Preserve. 4. Sanitary facilities must be provided onsite for men and women. 5. Three (3)
rows of trees (7' between) must be planted around the property lines. 6. The Permit is to
be reviewed in 2 years. Voting Yes: Maske, Sha & Schwartz. Voting No: Boyer, Estes,
Lachowitzer, Olson & Zimmerman.
Motion: A motion by Estes, second by Boyer to deny for the following reasons: 1. Not
compatible to land and water. 2. Hazards to be created. 3. Amount of noise generated.
Voting Yes: Boyer, Estes, Lachowitzer, Olson & Zimmerman. Voting No: Maske, Sha &
Schwartz.
Break: At 8:20 P.M., the Commission took a 10 minute break.
Russell & Elaine Alberq - Approved As Presented:
A Conditional Use Permit Application as stated by the Applicant. Conditional Use Permit
requested to excavate a 20’ wide cut with sloping sides into the 6' high bank of the building
site to allow for a walkout basement. Cut will begin 75’ back from lake front and extend 25’
into sloping bank to allow for 100’ setback of house. Cut will be 12’ above ground water
table. Also, request permit to exceed 300 cubic yard limit for excavating/fill on subject
parcel. Would like to level a 100’ x 100’ building site for a 42’x 60’ post frame building
which will include disposing of fill from basement around post frame bldg. The property is
described as Pt GL 1, Pt GL 2 & Pt SE1/4 NE1/4 ...(2.5 AC), Section 13 of Clitherall
Township; Clitherall Lake (56-238), RD.
Russell & Elaine Alberg represented the Application.
Motion: A motion by Boyer, second by Lachowitzer to approve as presented. Voting; All
Members in favor.
Jacob Hoffman and Robert & Julane Meyer - Denied:
A Conditional Use Permit Application as stated by the Applicant Riprap using fieldstone at
5 ft. setback from Ordinary High Water Mark no greater than 3 to 1 grade. Repair blowout
area of bluff by use of fieldstone retaining walls with a passage to top of bluff. The property

Marlyn Kruschke (Chairman Everts Township) indicated that the Township concerns were
addressed in their letter and indicated that they have not seen a plan.
Tom & Linae Avant expressed concerns regarding safety (their house is only 100 yards
from their fence line and children get on the bus in this area), noise and that the request is
for 365 days a year,
Mary Jimmerson expressed concerns regarding the lack of a plan, the effects on wildlife,
and the decrease in land values if approved: she also Indicated that they are planning on
building a home directly across from Mr. Stans driveway.
Doug Dietman expressed concerns regarding noise pollution (noise travels well over water).
Barb Nelson expressed concerns regarding noise (carries over water) and the effect on
property values.
Les Bensch (Viking Valley) indicated noise is a problem and that they are working on ways
to reduce it; he also indicated he is currently working with the legislature to create
measures for noise control; he stated he does not believe it affects property values.

RE: PROPOSED HUNTING PRESERVE AND SPORTING CLAY COURSE
BY JAMES J. STANS
As residents in close proximity to the Hunting Preserve and Sporting Clay Course proposed by
James J. Stans, we have real concerns against this proposal that we would like the Planning
Commission to address.
COMPATIBILITY - DENSITY OF HOMES
With concerns about safety and noise pollution, we feel the 378-acre site of the proposed
Hunting Preserve and Sporting Clay Course is an inappropriate use of the land in this
area with the density of residents surrounding it.
■ There are five homes within 300 feet of the proposed Hunting Preserve and
Sporting Clay Course property line. Minnesota Law prohibits hunting within a
500-foot distance of an occupied building.
■ There are an additional five homes within 1,000 feet of the proposed Hunting
Preserve and Sporting Clay Course property line.
■ And within a one-mile radius of the proposed Hunting Preserve and Sporting Clay
Course there are 42 year-round homes, plus many seasonal homes.
SAFETY
Along with the numerous homes in close proximity to the proposed Hunting Preserve and
Sporting Clay Course, it is surrounded on three sides by township roads. Numerous
residents utilize the roads for walking, bike riding, horseback riding, etc. There are
children that get on and off the school bus very close to the property line. Remington
Arms Company web site indicates shot can carry up to 1500 feet. Third Silver Lake,
which encompasses the Southeast comer of the proposed Hunting Preserve and Sporting
Clay Course, is used for boating, kayaking, and fishing as well.

NOISE CONCERNS
■^ith the number of residents in the surrounding area, noise pollution is a large issue.
Many more homes than just the ones in the one-mile radius will be affected by the noise
pollution. If the owner of the proposed Hunting Preserve and Sporting Clay Course is
allowed to lease any additional land, this will increase the amount of affected
landowners. At an average Sporting Clay course a person shoots 50 rounds. If this course
has just ten people participating in an evening, this is 500 shotgun blasts everyone in a
two-mile plus radius will hear.
ENVIRONMENTAL IMPACT
The damage to the trees, vegetation, and soil will be tremendous, like it is at Viking
jValley and Dalton Sports Sporting Clays sites. What about all the activity that will be
taking place in the CRP fields for the hunting part of the Preserve?
TRAFFIC CONTROL
n the past the owner of the proposed Hunting Preserve and Sporting Clay Course has
expressed concerns to the Township Board and the County on safety with the increase of
traffic accessing North Turtle Lake. Now he wants to add traffic to these same township
roads. Where are his safety concerns now?
PROPERTY VALUES
If the proposed Hunting Preserve and Sporting Clay Course is allowed, there will be
negative effects on the property values of all the surrounding lands. Selling property with
a Hunting Preserve and Sporting Clay Course in the area will be very difficult.

Our main objective is for the Planning Commission to deny the request for this proposed
Hunting Preserve and Sporting Clay Course because of its incompatibility with the population
density of the area, safety issues, noise pollution, and the environmental impact on the land.
The enclosed signatures are from concerned residents and property owners within the one-mile
radius of the proposed Hunting Preserve and Sporting Clay Course.

RE: PROPOSED HUNTING PRESERVE AND SPORTING CLAY COURSE BY
JAMES J. STANS - CONDITIONAL USE PERMIT APPLICATION REQUEST
As a seasonal resident in close proximity to the proposed hunting preserve and sporting clay
course, my husband and I have concerns we would like the planning commission and county to
consider prior to making a final decision. This would be in addition to the concerns addressed in
the attached letter, with which we are in agreement. Our property is situated just outside of the
minimum requirement for notification. We strongly believe that the proposed hunting preserve
and sporting clay course will negatively affect the market value of our property.
Our main concern is that there is not enough information (at this time) for the commission or
county to make a decision regarding approval or denial of the conditional use permit or the
subsequent change in zoning from residential/agricultural to commercial.
• Is there a detailed document describing how the owner intends to implement his plan?
This would include not only how he would address environmental and sound concerns,
but the type of firearms, shot type, litter (ejected casings), increased traffic, etc. How
does he intend to mark property lines to prevent overflow into neighboring properties?
• Is there available infrastructure that can support the additional traffic? Would this result
in special assessments to other residents in the area?
• Has the potential impact on water, ground water, erosion and waterfowl been studied?
We have an abundance of waterfowl and raptors in the area. What will be done to ensure
that they do not become unintended targets? Could nesting areas potentially be disturbed
by hunters, their dogs or noise levels?
• Does rezoning for this plan (commercial) have advantages over the current designated
zoning (residential/agricultural) and what are they? Will this plan be in the best interest
of all area residents or just the applicant? Would the implementation of this plan effect
adjoining property development that may create a more significant future tax base?

• The applicant has stated that the intended business hours would be from 9:00 a.m. to 7:00
p.m., seven days a week, 365 days a year, with no restriction on personal use. We do not
believe that this is acceptable. Unlike hunting season, which is seasonal, the proposed
plan provides no respite for other area residents or wildlife. The lack of restriction on
personal use would further exacerbate the usage issue. We are hoping you would limit
the hours of operation (particularly on weekends) should the commission and county
contemplate approval.
Thank you for taking the time to consider our concerns. It is our wish that all facets of this plan
be taken account prior to the decision making process. We hope that the final decision will
reflect the needs and wants of the community as a whole. If possible, please include us in all
future communications regarding this plan.

Subject: Jim Stans Petition for Game Farm and Shooting Range
Dear Members of the Otter Tail County Board of Adjustment:
Wednesday, May 19, 2004, the Otter Tail County Board of Adjustment
will be holding a public hearing on the request by Jim Stans to establish a
game farm and a shooting range on his farm located on the west edge of
Everts Township. The purpose of this letter is to express Everts
Township’s Board of Officers opposition to the proposed business.
First: Although Mr. Stans’ farm is comprised of almost 379 acres, it is
located in an area of Everts and adjacent Sverdrup townships that hold
considerable population. Safety is of great concern to residents living
near the Stans property. Private citizens will be paying a fee to hunt
game birds and accidents can occur.
Second: Noise is also a concern to area residents. Establishing a clay
target shooting range will certainly increase the noise level caused by
constant shooting. Even if shooting hours are established, there will still
be many hours of shooting noise.

Third: It is the position of the Board of Officers of Everts Township that
although not a necessity, the first place Mr. Stans should take his
proposal is to the Everts Township Board. Everts Township does have a
zoning ordinance and Mr. Stans would need a Special Use Permit to
operate his proposed business. It would give residents in Everts Township
a chance to express their views on this proposed business.
As a representative of the Everts Township Board of Officers, I will be
present Wednesday, May 19, 2004 to address the Otter Tail County
Board of Adjustment about Mr. Stans proposed business.
