Conditional Use Permit - Marin Bay Condominium Association: Land & Resource Director, Bill Kalar, reported that this request was originally denied and then, referred back to the Planning Commission on October 18, 2005. After further consideration, the Planning Commission agreed that the additional information submitted at the County Board meeting was not the reason for their recommended denial and reaffirmed their original recommendation. Applicants Don Gronbeck and John Bunnell provided a letter from Attorney Brant Beeson along with two dock configuration maps referred to as Exhibit 3A and Exhibit 3B. Lengthy discussion took place including a history of the CUP requests relative to the Marin Bay Condominiums. Motion by Block, second by Nelson, and unanimously carried to approve a Conditional Use Permit for the Marin Bay Condominium Association for their docking configuration as presented in Exhibit 3A and dated 11-9-05. Extension Requests Motion by Nelson, second by Froemming, and unanimously carried to extend Conditional Use Permit #6203, until July 1,2006, for Richard E. Peterson, Peterson’s Point, as presented. Motion by Nelson, second by Froemming, and unanimously carried to extend Conditional Use Permit #6330, until December 1, 2005, for a road project for Olaf Lake Shores with the condition that appropriate temporary erosion control measures are applied. Fiber mat should be placed over all disturbed areas. This approval is given because this particular project is 800’ from the lake and impact to the wetland should be minimal because the terrain is fairly level. ^ Planning Commission ft November 9, 2005 Page 3 ^ * Secluded Land Co., LLC — Approved As Presented. Rer^ove 233 cu. yds. top soil; grade, place class 5 gravel over 12 ft. top width of dhveway. Provide silt fence as needed. Floerish had questions regarding the notification of other roads that were built in the area. Motion: A motion by Estes, second by Maske to approve as presented, provided the road on the final plat is identified as “Dedicated to the Public”; reason for the cul-de-sac not extending to the end of the property is that it is impractical due the amount of land owned by the property owner. Voting; All Members in favor. Marin Bay Condominium Association - No Motion: On October 18, 2005 the County Board of Commissioners passed a motion to send the Conditional Use Permit request back to the Planning Commission because the letter submitted by Mr. Florey contained erroneous information and the applicants felt that they did not have an opportunity to address the issues at the Planning Commission Meeting. The Commissioners also felt that something should be worked out and questioned the meaning of an “appropriate centralized docking system” and whether or not that can be different based on the situation. After discussing the request, the Planning Commission indicated that the proportion of Marin Bay Condominium owners requested to approve a centralized docking system was not relevant to the decision, therefore a motion to recall the previous motion is not justified. .sca;:.:i
