Conditional Use Permit - Otter Tail County Highway Dept: Motion by Mosher, second by Froemming, and unanimously carried to approve a Conditional Use Permit to replace deficient Bridge No. 56509 located on CSAH No. 83 in Everts Township over the Otter Tail River as presented with the completion date being extended to October 1, 2006. The project is located as follows: Crossing of CSAH No. 83 and the Otter Tail River in SW %, Section 5 and NW 14, Section 8 of Everts Township: Otter Tail River (56-OTR) Deer Lake (56-298). Conditional Use Permit - Paul & Martha Pfeifle: Land & Resource Director, Bill Kalar, stated that this Conditional Use Permit request is for a marine business (storage of boats, pontoons, etc.) and a maintenance and repair business. He noted that the Planning Commission recommended approval with several conditions. Neighbor, Gerald Crissler spoke in opposition of the project citing a serious drainage issue and a commercial use in a residential area. Mr. Kalar stated that there is potential for drainage concerns and that is the reason for the requirement to provide a drainage plan. Motion by Lee, second by Block, to approve a Conditional Use Permit for a proposed new building and operation of a boat, pontoon, & car storage, and maintenance and repair business, with conditions as recommended by the Planning Commission. Further discussion took place. Jim Schreiner spoke in opposition of the project and expressed concerns with the flow of the water into Lake Lida and his belief that there isn’t enough acreage for the proposed project. County Attorney, David Hauser, explained that size requirements are dependent upon when the lot of record was created. Gerry Schreiner questioned vehicles and boats being stored outside and the safety of the entrance because of the hill. Applicant, Paul Pfeifle, stated that the entrance issue was not addressed at the Planning Commission meeting: however, could be addressed by the County Highway Department requesting a reduced speed zone from the State of Minnesota. Paul & Martha Pfeifle - Approved With Conditions: A Conditional Use Permit /Kpp\\cai\on{as stated by the Applicant): Since Loghaven Resort no longer exists (as of October 2005), Conditional Use Permit #5471 is no longer valid. We would like to request a Conditional Use Permit for a proposed shed (40’ x 120’) and an (40’ x 80’) existing shed to allow storage (boats, pontoons, pwc, cars etc.), maintenance and repair. The customer hours will be 9 A.M. to 6 P.M.; 7 days a week. My max. size of an unlit sign would be 4’ X 8’. The property is described as Pt GL 4 & 8 ...(2.13 AC), Section 10 of Lida Township; Lake Lida (56-747), GD. Paul Pfeifle represented the Application. Jim Schreiner expressed concerns with traffic, the location and commercial use in a residential area. Gerald Crissler expressed concerns with commercial use in a residential area and drainage. Carl .Zick (forming a Lida Shores Loop Owners Association) commented on previous denials for commercial use in this area and stated their proposed Association will not allow commercial use. Wesley Tweeton spoke in favor, stating the access for this use is from CSAH 4 (not Lida loop) and that there is a need for this commercial use in the area. Gerry Schreiner expressed concerns regarding the location and questioned the addresses of the people who spoke in favor. Motion: A motion by Estes, second by Wilson to approve with the following conditions: 1. The Applicant must file a drainage plan with the Land & Resource Management Office prior to construction. 2. The Applicant must plant a natural screening. 3. The existing building must be for storage and in the proposed building, the repair & maintenance business must not exceed 50%, the remainder is for storage. 4. The signage must be unlit and not exceed 4’ x 8’ in size. Reasons for approval being it is a good use of the land, all issues regarding sanitation, oil & debris are covered under State Rules, and it is a seasonal business. Voting: All Members in favor.
