Paul R. Johnson - Approved the variance for the proposed development with a condition. (8:18 p.m.)
After consideration and discussion, Michael Harris made a motion to approve the placement of the proposed development at least
50’ from the ordinary high water level. No portion of the proposed addition and or deck could be any closer to the ordinary high
water level than 50’. This motion died for lack of a second. Randall Mann made a motion, seconded by Paul Larson and
unanimously carried, to approve the proposed development as described in the variance application with the condition that no
portion of the proposed development can be any closer to the ordinary high water level than the existing structure. The existing
structure is currently behind the existing building line.

Paul R Johnson, part of Government Lot 1, Section 5 of Everts Township by Round Lake, requested a variance of 42'
from the required ordinary high water level setback of 100’ for the placement of a dwelling 58’ from the ordinary high
water level. The audience was polled with no one speaking for or against the variance as requested. After
consideration and discussion, Michael Harris made a motion to approve the placement of the proposed development
at least 50’ from the ordinary high water level. No portion of the proposed addition and or deck could be any closer to
the ordinary high water level than 50’. This motion died for lack of a second. Randall Mann made a motion, seconded by Paul Larson and unanimously carried,[T^pprove the proposed development as described in the
variance application with the condition that no portion of the proposed development can be any closer to the ordinary
high water level than the existing structure^he existing structure is currently behind the existing building line.
Robert and Laurel Ritter - Approved the variance as requested with a condition. (8:25 p.m.)
Robert and Laurel Ritter, part of Government Lot 4, Section 11 of Eagle Lake Township by Eagle Lake, requested the
following: We are requesting permission to replace the existing, aged and failing, retaining wall system with a
professionally engineered retaining wall system that is located within the 100’ setback area and also within a bluff.
This retaining wall system will be 429 LF in length and will be 3000 square feet in size. We also proposed replacing
the existing elevated deck with an equally sized deck made of wood and composite wood materials. At its closest
point, the existing retaining wall is 34’ from the high water mark. The new wall system will be 34’ or greater from the
high water mark. As part of the project we intend to become compliant with our lakeside portable storage building by
moving this structure off of the property. The audience was polled with no one speaking for or against the variance as
requested. Kurt Maethner, property caretaker, Jeremy Anderson, Engineer with Design Tree Engineering Inc. and
Matt a representative with Outdoor Renovations represented the applicants at the public hearing. After consideration
and discussion, Steve Schierer made a motion, second by Joe Maske and unanimously carried, to approve the
variance as requested/described in the variance application dated July 12, 2010 and as depicted in the “Construction
Plans for Retaining Walls and Lot Improvements’’ submitted with the variance application with the condition that no
more than 25% of the total eligible lot area can be covered with impervious surfaces. The proposed development will
be no closer to the ordinary high water level than the existing. The proposed development would be considered
normal maintenance which is necessary at this time to protect both the property and the lake.
David Braton - Approved the variance application as modified with a condition. (8:33 p.m.)
David Braton, part of Government Lot 4, Section 27 of Lida Township by Lake Lida, requested the following:
- House will require 29’ variance for a 46’ setback from lake (ordinary high water level) and a 4.7’ variance for a
5.3’ setback from the North and South Property lines.
- West garage will require an 8’ variance for a 12’ setback from road right-of-way.
- East garage will require a 13.T variance for a 6.9’ setback from the South line.
A representative from Moore Engineering Inc. appeared with the applicant. The audience was polled with no one
speaking for or against the variance as requested. After consideration and discussion, Steve Schierer made a
motion, seconded by Michael Harris and unanimously carried, to approve a variance of 29’ from the required ordinary
high water level setback of 75’ for the placement of a dwelling 46’ from the ordinary high water level and at least 10’
from the side lot lines, to approve a variance of 8’ from the required road right-of-way setback of 20’ for the placement
of the west garage 12’ from the road right-of-way as depicted on the drawing submitted with the variance application
and a variance of 13.T from the required road right-of-way setback of 20’ for the placement of the east garage 6.9’
from the road right-of-way/south line as depicted on the drawing submitted with the variance application with the
condition that no more than 25% of the total eligible lot area can be covered with impervious surfaces. The variance
as approved does not directly or indirectly grant any other variances for the proposed development.
