The land is considered a drained wetland. It does have one area of upland as shown on included map and as confirmed by Brad Mergans of SWCD and Kyle Westergard. This area w as leveled off for greenhouses back in 1981 but they have since been moved to Fergus Falls. I went through the SWCD in October of 2000 to gain permission to dig the pond but later found out the correct agency was the Land and Resource office. The pond I dug was 55 feet by 100 feet. The last day I worked on moving the fill to the upland area was Thanksgiving. The ground was too froze after that and the remaining dirt too wet to move. I would like to have until the fall of 2001 to move the rest of the dirt either to the upland area on site or completely off site. Most of it is a good quality dirt that can be used in landscaping. By September 11 propose having the whole area seeded which is a good time to establish grass. Please note there would be a net gain of wetland on my land and isn’t that the goal of the WCA?. Battle Lake, Minnesota 56515 Dear Mr. Sullivan: It has come to our attention that you have excavated a wildlife pond and sidecast the spoil materials into wetlands adjacent to Lake Blanche. Lake Blanche and its adjacent wetlands are subject to the Corps of Engineers regulatory jurisdiction pursuant to Section 404 of the Clean Water Act (CWA). A review of our records indicates- that a De5)artment of the Army permit has not been issued for this project. Army permit, this activity is in vi CWA. Without a Department of the elation of Section 301 of the Based on your discussions with Leo Grabowski, of our Brainerd Field Office, it is our understanding that this activity was also in violation of the Minnesota Wetland Conservation Act and that you have received a restoration order from the Otter Tail SWCD. That restoration order requires you to remove the spoil material from the wetland by October 1, 2001. Compliance with this restoration order would resolve your CWA violation. You should contact this office when the work has been completed so that a compliance inspection can be scheduled. Upon completion of the restoration work, we will close our violation file. Failure to complete the restoration will result in our reevaluation of this matter to determine the appropriate legal or administrative remedy to be sought. If you have any questions, contact Leo A.
