The following variance requests were heard at the August 14,1997 Meeting:
John M. Brandt-(Tabled-August 7,1997/Approved August 14,1997)
John M. Brandt, Fergus Falls, MN, requested a variance to subdivide a 1.5 acre tract from an
existing 10 acre parcel. The tract would be approximately 160’ by 400’. The property is
described as part of the Southeast Quarter of the Southwest Quarter, Section 28 of Fergus Falls
Township by an unnamed lake. The audience was not polled at this public hearing since the
application had its original hearing at the June 12,1997 meeting, and had been tabled until the
July 10, 1997 meeting at which time it was tabled until the August 7, 1997 meeting. Prior to the
August 7, 1997 meeting, the applicant had requested that the hearing be delayed until the
August 14, 1997 meeting to allow the applicant an opportunity to meet once again with the
Fergus Falls Town Board. After consideration, motion was made by John Everts, seconded by
Robert Schwartz and unanimously carried, to table the variance request for one additional
week.
At the August 14, 1997 meeting, the applicant presented additional information provided by the
Fergus Falls Town Board. After additional discussion and consideration, motion was made by
Randall Mann, seconded by Craig Anderson and unanimously carried, to approve the variance
as requested with the condition that a registered surveyor’s drawing must be provided at the
time of conveyance. It was noted that the applicant complied with the request of the Board of
Adjustment and with the requirements of the Subdivision Controls Ordinance as it concerns the
requirements for a road.
Edward Lund - Approved
Edward Lund, Dent, MN, requested a variance to subdivide a 4.5-acre parcel from an existing
7.26-acre parcel. The 4.5-acre parcel will have no lakeshore. The property is described as part
of Reserve Lot A and part of the Farmstead Lot, Peaches Shady Shores, Star Lake in Star Lake
Township. The audience was polled with no one speaking for or against the request. It was
noted that a phone call had been received from Bruce Pederson stating that he support the
applicant’s request. After consideration and discussion, motion was made by Craig Anderson, k
seconded by Cecil Femling and unanimously carried, to approve the subdivision of a 4.5 acre ,
parcel from an existing 7.26 acre parcel with the condition that a registered surveyor’s drawing /
must be presented at the time of recording. It was noted that the site would have adequate
room for a septic system and that it has public road access.
Harry Everet Thernell - Approved
Harry Everet Thernell, Battle Lake, MN, requested a variance of approximately 8’ from the
required side lot line setback of 10’ for the replacement of an 8’ by 8’ structure with an 8’ by 12'
structure located approximately 2’ from the side lot line. The property is described as Lot 9 and
the West 10’ of Lot 10, Kimber Beach, Blanche Lake in Girard Township. Cindy Thernell
represented the applicant at the public hearing. The audience was polled with no one speaking
for or against the request. A letter from Dale J. Schmidt addressing a number of concerns was
read for the record. After consideration and discussion, motion was made by John Everts,
seconded by Robert Schwartz and unanimously carried, to approve a variance of 8’ from the
required side lot line setback of 10’ for the replacement of an 8’ by 8’ structure with an 8’ by 12’
structure located 2’ from the side lot line. It was noted that the new structure is no closer to the
side lot line than the previous structure and that the granting of the variance will not establish
precedence. Hardship is a substandard lot of record.
