After consideration and discussion, Paul Larson made a motion, second by Michael Harris and carried with David Wass voting no,
to approve the placement of deck, dwelling and attached garage no closer to the ordinary high water level than the existing
building line with the condition that an approved septic plan, which does not require any variances, must be provided prior to the
issuance of a site permit. The variance as approved will provide the applicant with the ability to enjoy the same rights and
privileges as others in this immediate area. The variance as approved does not directly or indirectly grant any other variances the
proposed project or for any future development.

Thursday, July 10, 2014
The Otter Tail County Board of Adjustment met Thursday, July 10, 2014, with the following persons in attendance:

Called to Order - Thomas Lee, Vice-Chair called the meeting of the Board of Adjustment to order at 6:30 p.m.
Minutes Approved - The Board of Adjustment approved the minutes of the June 12, 2014 meeting as mailed.
The Board of Adjustment considered the following applications for variance:
Carol Malmberg - Application partially approved with conditions. (6:32 p.m.)
Carol Malmberg, Lot 6, 7 and 8, Sah-Kah-Tay Beach and part of Government Lot 1, Section 32 of Lida Township by
Lake Lida, requested the following: Subdivide an existing 1.46 acre lot into two tracts for nonresidential use without a
registered survey. Build a 24' by 24’ garage 15’ from the road right-of-way on proposed Lot B. Proposed Lot B will be
permanently attached to Lot 4 SAH-KAH-TAY Beach and Proposed Lot A will be permanently attached to Lots 6, 7
and 8 SAH-KAH-TAY Beach. Appearing with the applicant were Jill and Peter Preston and two neighbors. The
audience was polled with no one speaking for or against the variance as requested. After consideration and
discussion, Michael Harris made a motion, second by Paul Larson and unanimously carried to approve the proposed
subdivision to create two nonresidential use tracts, as depicted on the drawings dated June 2, 2014, and to deny the
variance as requested for the proposed garage with the condition that a registered surveyor’s drawing must be
provided, with the condition that the proposed structure must be placed at least 20’ from the road right-of-way and
with the condition that the area within the proposed subdivision cannot be used when calculating impervious surface
coverage for front lot development. The variance as approved is consistent with past actions of the Board of
Adjustment. The variance as approved does not directly or indirectly grant any other variances for future
development.

Cari Ulrich, Lot 20 Block 1, Birghtwood Shore Line, Dead Lake in Star Lake Township, requested a variance of 138’
from the required ordinary high water level setback of 200’ for the placement of deck, dwelling and attached garage
62’ from the ordinary high water. The applicant was represented at the public hearing by Jay Weiher. The audience
was polled with no one speaking for or against the variance as requested. After consideration and discussion, Paul
Larson made a motion, second by Michael Harris and carried with David Wass voting no, to approve the placement of
deck, dwelling and attached garage no closer to the ordinary high water level than the existing building line with the
condition that an approved septic plan, which does not require any variances, must be provided prior to the issuance
of a site permit. The variance as approved will provide the applicant with the ability to enjoy the same rights and
privileges as others in this immediate area. The variance as approved does not directly or indirectly grant any other
variances the proposed project or for any future development.
BtYan and Joyce Folson - Application approved as requested with a condition. (6:48 p.m.)
Bryan and Joyce Folson, easterly half of Lot 13 Plainview Sandy Beach First Addition, Little McDonald Lake in Edna
Township, requested the following: We are proposing to place a holding tank 4’ into the road right-of-way. The
required setback is 10' from road right-of-way. By putting the holding tank in the proposed spot we will be 50’ from
our fresh water well, which meets the setback requirements for holding tank to well. Our lot’s dimension is 50’ wide by
110’ long. This location will resolve sewage system abatement. The audience was polled with no one speaking for or
against the variance as requested. After consideration and discussion, Michael Harris made a motion, second by
Paul Larson and unanimously carried, to approve the variance as described in the variance application dated June 16,
2014 with the condition that the applicants must obtain a letter of approval from the township. It was noted that the
variance as approved is consistent with past actions and there is perhaps no other location available.
Hardship/practical difficulty is a substandard lot of record. The variance as approved does not dira grant any other variances for the proposed project or for any future development. A 0

I have attached a photo of what 1 am looking to build on this lot.
The only change is that all of the deck would
be on the side of the cabin and nothing in front towards the lake. I
am looking at somewhere around a 26X30
to a 28X36 with the basement and the one level on top so you could
walk in level on the top and walkout level
on the bottom to the lake. Anyway that's the dream be it
possibility or not....that’s your call. I know you have
boundaries and guidelines that you have to work within and I trust
you will give me a fair appraisal of the lot.
You do what you do best and know what you decide is good with me
however it turns out. If you would like me
to drive up and meet you at the lot I surely could do that if I had a
little notice and explain my intensions in case
the drawing I sent to you is too confusing. You should have the
drawing by today or tomorrow at the latest.
