After discussion and consideration, Steve Schierer made a motion, seconded by Douglas Larson and carried with
Thomas Lee and Darren Newville voting no, to deny the variance as requested as no adequate hardship/practical
difficult unique to the property had been shown that would allow for the granting of the variance as requested. The
applicants’ site does provide a location for the propose structure that can meet the setback requirement and granting
the variance would establish precedence.

CONTRACT FOR DEED

THIS CONTRACT FOR DEED is made on the above date by Lorraine L. Gauster,
Trustee of the John W. Gauster Revocable Trust Agreement dated 4-23-03; Lorraine Gauster,
a widowed and unremarried individual; and John L. Gauster and Julie A. Gauster, husband
and wife. Sellers (whether one or more), and Robin J. Williams and Terry L. Williams,
Purchasers, (whether one or more) as Joint Tenants.
Seller and Purchaser agree to the following terms:
1. PROPERTY DESCRIPTION. Seller hereby sells, and Purchaser hereby buys,
real property in Otter Tail County, Minnesota, described as follows:
See attached “Exhibit A”
together with all hereditaments and appurtenances belonging thereto (the Property).
TITLE. Seller warrants that title to the Property is, on the date of this contract,
subject only to the following exceptions:

Covenants, conditions, restrictions, declarations and easements of record,
if any;
Reservations of minerals or mineral rights by the State of Minnesota, if

any;
Building, zoning and subdivision laws and regulations;
The lien of real estate taxes and installments of special assessments
which are payable by Purchaser pursuant to paragraph 6 of this contract;

3. DELIVERY OF DEED AND EVIDENCE OF TITLE. Upon Purchaser’s prompt
and full performance of this contract, Seller shall;!
i
(a) Execute, acknowledge and deliver to Purchaser a Warranty Deed, in
recordable form, conveying madcetable title to the Property to Purchaser,
subject only to the following exceptions;
(i) Those exceptions referred to in paragraph 2(a), (b), (c) and (d) of
this contract;
(ii) Liens, encumbrances, adverse claims or other matters which
Purchaser has created, suffered or permitted to accrue after the
date of this contract; and
(iii) The following liens or encumbrances; None
(b) Deliver to Purchaser the abstract of title to the Property or, if the title is
registered, the owner’s duplicate certificate of title.

4. PURCHASE PRICE. Purchaser shall pay to Seller, at 5223 Willow Court, Cape
Coral, FL 33904 the sum of Two Hundred Fifteen Thousand and NO/100 Dollars
($215,000.00), as and for the purchase price for the Property, payable as follows;
The sum of $25,000.00 in cash upon the execution and delivery of this
instrument, the receipt of which is hereby acknowledged; the balance of
$190,000.00 shall be paid as follows; Installments in the amount of $700.00 per
month or more at the option of the buyer, including interest at the rate of 2% per
annum computed on unpaid balances. Interest shall begin on October 3,2015.
First payment shall be due and payable on November 1,2015 and subsequent
payments shall be due and payable on the 1st day of each succeeding month.
Payments shall be credited first to interest and remainder to principal. The
entire balance of this contract shall be due and payable in full no later than
September 30, 2020. The final payment is a balloon payment
5. PREPAYMENT. Unless otherwise provided in this contract. Purchaser shall
have the right to fully or partially prepay this contract at any time without penalty. Any partial
prepayment shall be applied first to payment of amounts then due under this contract,
including unpaid accrued interest, and the balance shall be applied to the principal
installments to be paid in the inverse order of their maturity. Partial prepayment shall not
postpone the due date of the installments to be paid pursuant to this contract or change the
amount of such installments.

6. REAL ESTATE TAXES AND ASSESSMENTS. Purchaser shall pay, before
penalty accrues, all real estate taxes and installments of special assessments assessed
against the Property which are due and payable in the year 2015 and in all subsequent years.
Real estate taxes and installments of special assessments which are due and payable in the
year in which this contract is dated shall be paid as follows; Prorated to date of closing.

9 INJURY OR DAMAGE OCCURRING ON THE PROPERTY.
LIABILITY. Seller shall be free from liability and claims for damages by
reason of injuries occurring on or after the date of this contract to any person .or persons or
property while on or about the Property. Purchaser shall defend and Indemnify Seiler from all
liability, loss, costs and obligations, including reasonable attorney's fees, on account of or
arising out of any such injuries. However, Purchaser shall have no liability or obligation to
Seller for such injuries which are caused by the negligence or intentional wrongful acts or
omissions of Seller.
(a)
LIABILITY INSURANCE. Purchaser shall, at Purchaser’s own e)qpense,
procure and maintain liability insurance against claims for bodily injury, death and property
damage occurring on or about the Property in amounts reasonably satisfactory to Seller and
naming Seller as an additional insured.
(b)
10 INSURANCE, GENERALLY. The insurance which Purchaser is required to
procure and maintain pursuant to paragraph 9 of this contract shall be issued by an insurance
company or companies licensed to do business in the State of Minnesota and acceptable to
Seller. The insurance shall be maintained by Purchaser at all times while any amount
remains unpaid under this contract. The insurance policies shall provide for not less than ten
days written notice to Seller before cancellation, non-renewal, termination or change in
coverage, and Purchaser shall deliver to Seller a duplicate original or certificate of such
insurance policy or policies.
11. CONDEMNATION. If any or any part of the Property is taken in condemnation
proceedings instituted under power of eminent domain pr is conveyed in lieu thereof under
threat of condemnation, the money paid pursuant to such condemnation or conveyance in lieu
thereof shall be applied to payment of the amoutits payable by Purchaser under this contract,
even if such amounts are not then due to be paid. Such amounts shall be applied first to
unpaid accrued interest and next to the installments to be paid, as provided in this contract and
in the inverse order of their maturity. Such payment shall not postpone the due date of the
installments to be paid pursuant to this contract or change the amount of such installments,
the balance, if any, shall be the property of Purchaser.
12 WASTE, REPAIR AND LIENS. Purchaser shall not remove or demolish any
buildings, improvements or fixtures now or later located on or a part of the Property, nor shall
Purchaser commit or allow waste of the Property. Purchaser shall maintain the Property in
good condition and repair. Purchaser shall not create or permit to accme liens or adverse
claims against the Property which constitute a lien or claim against Seller’s interest in the
Property. Purchaser shall pay to Seller all amoiJnts, costs and expenses, including
reasonable attorneys’ fees, incurred by Seller to remove any such liens or adverse claims.
13 DEED AND MORTGAGE REGISTRY TAXES. Seller shall, upon Purchaser’s
full performance Of this contract, pay the deed tax due upon the recording or filing of the deed
to be'delivered by Seller to Purchaser. The mortgage registry tax due upon the recording or
filing of this contract shall be paid by the party ,whO records or files this contract; however, this
provision shall hot impair the right of Seller to collect from Purchaser the amount of such tax

actually paid by Seller as provided in the applicable law governing default and service of
notice of termination of this contract.
14. NOTICE OF ASSIGNMENT, if either Seller or Purchaser assigns their interest
in the Property, a copy of such assignment shall promptly be furnished to the non-assigning
party.
16. PROTECTION OF INTERESTS. If Purchaser fails to pay any sum of money
required under the terms of this contract or fail to perform any of their obligations as set forth
in this contract, Seller may, at Seiler’s option, pay the same or cause the same to be
performed, or both, and the amounts so paid by Seller and the cost of such performance shall
be payable at once, with interest at the rate stated in paragraph 4 of this contract, as an
additional amount due Seller under this contract. If there now exists, or if Seller hereafter
creates, suffers or permits to accrue, any mortgage, contract for deed, lien or encumbrance
against the Property which is not herein expressly assumed by Purchaser, and provided
Purchaser is not in default under this contract. Seller shall timely pay all amounts due thereon,
and if Seller fails to do so. Purchaser may, at Purchaser’s option, pay any such delinquent
amounts and deduct the amounts paid from the installment(s) next coming due under this
contract.
DEFAULT. The time of performance by Purchaser of the terms of this contract
is an essential part of this contract. Should Purchaser fail to timely perform any of the terms
of this contract, Seiler may, at Seller’s option, elect to declare this contract canceled and
terminated by notice to Purchaser in accordance with applicable law. All right, title and
interest acquired upon the Property and all payments made by Purchaser pursuant to this
contract shall belong to Seller as liquidated damages for breach of this contract. Neither the
extension of the time rights to declare this contract forfeited by reason of any breach shall in
any manner affect Seiler's right to cancel this contract because of defaults subsequently
occurring, and no extension of time shall be valid unless agreed to in writing. After service of
notice of default and failure to cure such default within the period allowed by law. Purchaser
shall, upon demand, surrender possession of the Property to Seller, but Purchaser shall be
entitled to possession of the property until the expiration of such period.
16.
17. BINDING EFFECT. The terms of this contract shall run with the land and bind
the parties hereto and their successors in interest.
18. HEADINGS. Headings of the paragraphs of this contract are for convenience
only and do not define, limit or construe the contents of such paragraphs.
19. ASSESSMENTS BY OWNERS’ ASSOCIATION. If the Property is subject to a
recorded declaration providing for assessments to be levied against the Property by any
owners’ association, which assessments may become a lien against the Property if not paid,
then:

(a) Purchaser shall promptly pay, when due, all assessments irhpdsed by the
owners’ association or other governing body as required by the provisions of the declaration
or other related documents; and
(b) So long as the owners'association maintains a master or blanket policy of
insurance against fire, extended coverage perils and such other hazards and in such amounts
as are required by this contract, then;

i. Purchaser's obligation in this contract to maintain hazard
insurance coverage on the Property is satisfied; and
ii. The provisions in paragr;aph 8 of this contract regarding
application of insurance proceeds shall be superseded by the
provisions of the declaration or other related documents; and
ill. In the event of a distribution of insurance proceeds in lieu of
restoration or repair following an insured casualty loss to the
Property, any such proceeds payable to Purchaser are hereby
assigned and shall be paid to Seller for application to the sum
secured by this contract, with the excess, if any,; paid to
Purchaser.

20. ADDITIONAL TERMS:
?'A) Purchaser shall pay real estate taxes and insurance premiums directly as
they become due and furnish Seiler with paid, receipt of same.
B) Purchaser shall not during the term of this contract cause any material to
be delivered or labor to be performed upon any part of the property
covered by this contract which exceeds the cost of $10^000.00 unless
Purchaser first obtains the written consent of Seller.
C) Purchase further agrees to indemnify and hold harmless Seller against all
claims for labor and materials or^ services made against the Property
covered by this Contract for. Deed and for the costs of enforcing this
indemnification, including reasonable attorney’s fees.

The Otter Tail County Board of Adjustment met Thursday, July 12, 2018, with the following persons in attendance;

Called to Order - Steve Schierer, Chair called the meeting of the Board of Adjustment to order at 6:30 p.in.
Minutes Approved - fhe Board of Adjustment approved the minutes of the June 14, 2018 meeting as mailed.
The Board of Adjustment considered the following applications for variance:
Eugene and Linnea Strand - Variance application approved as requested with a condition. (6:33 p.m.)
Eugene and Linnea Strand, part of Government 7 and 8, Section 22 of Dunn Township by Franklin Lake, requested the following:
1 would like to divide my 9.35 acres lot into two lots of 4.65 acres to have another dwelling for my mother built on this property.
Minimum metes and bounds tract size requirement is 5 acres. Survey will be done upon recording. Eugene Strand represented
the application at the public hearing. The audience was polled with Beverly Greenwald and Gary Barta speaking to the variance
as requested. Ms. Greenwald spoke in opposition to the variance as requested and Mr. Barta discussed the access road to the
proposed site. An email from Kent and Jenny Heiinark in support of the variance as requested, with conditions, was read for the
record. An email from Beverly Greenwald in opposition to the variance as requested was noted for the record. After discussion
and consideration, Darren Newville made a motion, seconded by Kenneth Vorderbruggen and earned with Thomas Lee and Steve
Schierer voting no, to approve the proposed subdivision as described in the variance application dated May 31,2018 and as
depicted on the drawing submitted with the application with the condition that a registered surveyor's drawing must be provided
at the time of conveyance/separation. Those voting in opposition noted that the property could be platted. Those voting in
support of the motion noted that the Board has approved similar requests and approval would be consistent with past actions of
the Board. It was also noted that the wetlands are not an issue that will significantly impact the proposed subdivision. The
variance as approved does not directly or indirectly grant any other variances for future development.
Rob and Terry Williams - Denied. (6:47 p.ni.)
Rob and Teiry Williams, part of Sub Lot 3 of Government Lots 2 and 3, Section 34 of Star Lake Township by Dead Lake,
requested the following Dead Lake is an NE lake where setback is 200’. This building would be approximately 111’ setback
from lake front. This lot will not allow 200’ without using wetland. Building 24’ by 40’ by 10’ metal pole frame. 1 would like a
variance for 89’ from the ordinary high-water level to place building at 111’ from lake for storage. Rob Williams represented the
application at the public hearing, fhe audience was polled with no one speaking for or against the variance as requested. After
discussion and consideration, Steve Schierer made a motion, seconded by Douglas Larson and carried with Thomas Lee and
Darren Newville voting no, to deny the variance as requested as no adequate hardship/practical difficult unique to the property
had been shown that would allow for the granting of the variance as requested, fhe applicants’ site does provide a location for
the propose structure that can meet the setback requirement and granting the variance would establish precedence.
Robert and Rachel Posch - Variance application approved as modified with a condition. (6:58 p.m.)
Robert and Rachel Posch, part of (iovemment Lots 3 and 4, Section 16 of Hobart Township by Rose Lake, requested the
following: A variance of 2,440 square feet over the allowed 260 square feet of impervious surface within the shore impact zone -
for existing deck, patio and pathway. A variance for the setback for a 10’ by 10' deck. Would like to maintain location
approximately 5’ from shoreline. A variance for the bluff impact zone - earthmoving completed to improve existing pathways.
(Approximately 70 yards). Robert and Rachel Posch represented the application at the public hearing. The audience was polled
with no one speaking for or against the variance as requested.

place building at 111’ from lake for storage.
