MDate of hearing: MOTION AS FOLLOWS: Motion was made by Cecil Femling, seconded by Robert Schwartz and unanimously carried, to approve a variance to subdivide an existing 4.6 acre parcel into three parcels as shown on the applicant’s drawing with the following conditions; 1.) that no roads will be placed through any wetland areas, 2.) a letter stating that there are no boundary line disputes must be filed at the time of conveyance, and 3.) a registered surveyor’s drawing must be provided at the time of conveyance. It was noted that the three parcels have access to a dedicated public road and that the three parcels will meet or exceed the minimum size requirements (frontage and area) for platted lots on a general development lake. The minimum size required for platted back lots on a recreational development lake is 80,000 square feet of area and 300’ of lake frontage/lot width. After consideration, motion was made by George Walter, seconded by Cecil Femling and carried with John Everts voting no, to deny the applicant’s request as no adequate hardship had been shown. It was noted that unawareness of the requirements of the Shoreland Management Ordinance, by a property owner and/or a property owner’s legal counsel, is not sufficient hardship for the Board to consider when hearing a variance request. Matt and Margarett Winkels - Approved Matt and Margarett Winkels, Perham, MN, requested a variance to subdivide an existing 4.6 acre tract into three parcels. The minimum size required for metes and bounds parcels in the shoreland area is 5 acres. The property is described as part of Government Lot 10 and part of Sub Lot 1, Section 14 of Star Lake Township by Star Lake. The audience was polled with Louis Stoll speaking in favor of the variance request. After consideration, motion was made by Cecil Femling, seconded by Robert Schwartz and unanimously carried, to approve a variance to subdivide an existing 4.6 acre parcel into three parcels as shown on the applicant’s drawing with the following conditions: 1.) that no roads will be placed through any wetland areas, 2.) a letter stating that there are no boundary line disputes must be filed at the time of conveyance, and 3.) a registered surveyor’s drawing must be provided at the time of conveyance. The audience was polled with Eric Boe objecting to the variance requested due to a disputed boundary line. Eric Boe was representing Nathan Boe an adjacent property owner. After consideration, motion was made by Randall Mann, seconded by Craig Anderson and unanimously carried, to approve a 3’ variance from the required side lot line setback of 10’ for the placement of a 26’ by 32’ garage 7’ from the side lot line. Douglas Millaway - Denied Douglas Millaway, Dent, MN, requested a variance to subdivide a parcel of approximately .4 acre from an existing parcel of approximately 2 acres. The property is described as part of Sub Lot B of Government Lot 2, Section 9 of Star Lake Township by Star Lake. Gary Sheldon, a potential purchaser, represented the applicant at the public hearing. After consideration, motion was made by John Everts, seconded by Craig Anderson and unanimously carried, to deny the variance as requested as no adequate hardship had been shown. It was noted that the .4 acre parcel is not contiguous to the proposed buyer’s parcel and that the granting of the variance would create a substandard lot and would also create a precedence. Arral Helgerson - Denied Arral Helgerson, Grand Forks, ND, requested a variance to subdivide a parcel of less than 5 acres from an existing 11.5 acre parcel. The property is described as part of Government Lot 2, Section 24 of Dora Township by West McDonald Lake. The audience was polled with no one speaking for or against the request. After consideration, motion was made by George Walter, seconded by John Everts and unanimously carried, to deny the variance as requested as no adequate hardship had been shown and the granting of the variance would create a substandard lot.
