(8:30 p.m.) After consideration, Steve Schierer made a motion, second by Carl Zick and unanimously carried, to approve the proposed deveiopment/remodeling with the condition that no portion of the proposed development/remodeling can be within the shore impact zone. All new construction and remodeling must be setback at least 50’ from the ordinary high water level. Practical difficulty/hardship is the terrain of the applicants' property. Assessor and the MN DNR bk 0407-001 329.512 - Vidor Lundeen Company, Fergus Falls. Minnesota The Owner requests a variance of 27’-0” from the 75-0” Building setback from the OHW requirement. Also requests a variance from the newly revised Shore Impact Zone setback requirement. The Owner requests a building setback of 48’- 0” from the OHW where the Shore Impact Zone now extends to 50’-0” from the OHW. This property has an existing home, (non-conforming structure) located at 35’-0” from the OHW at its closest point. The Owner requests to remodel and add onto this home to fit his growing family. The portion of the home closest to the lake will be removed and the new addition will be attached there, extending southward, decreasing the non-conformity and increasing the setback from 35’-0” to 48’-0” at its closest position. The existing home will be remodeled to make the most use of its space. The existing garage space, at the west end of the home, is presently over the setback on the west side of the point. The proposed layout will be remodeling it into living space, moving the garage to a proposed location fully behind the setback line. This property, although extensive in area and shoreline has a number of practical difficulties: □ The existing home is a non-conforming structure, it is in very good condition, and not worthy of complete demolition. It is positioned at a location where it is considered non-conforming. Any work done to this home requires this variance application. □ Because the home is located on a point it has practical difficulties with the setback requirements from the OHW on two sides of the point (the west and the east) rather than the usual one side. □ Other site related difficulties are due to site elevation. The steep slope directly behind the proposed home prevents the home from being located further to the west. Some area between the home and the hill has been left to divert the run-off from that slope into the ground and away from the building. □ Although the lot area is extensive, the location where the home is located is the best building site on the property. Areas to the west are not buildable, requiring extensive excavation (into the hill) and extensive tree removal (it is fully forested). Areas further to the east of the proposed location are very low (having water table issues). Further to the east are low lands and forest, both unlikely locations for building sites. This proposed location is the only flat building pad where the elevation is high enough above the water table. □ Adding on to the existing home has some practical difficulties regarding interior spaces, door and window locations, roof lines, etc. This proposal has added on at an obvious break in the building’s shape, structure, and interior spaces without disrupting the uses of the existing interior spaces.
