After discussion and consideration, Randall Mann made a motion, second by Thomas Lee and unanimously carried, to approve
the removal of the entire existing structure (not including the deck(s) which the applicants indicated will remain in their current
location), to permit development/construction on the existing foundation and to allow the gap between the existing deck(s) and the
new construction to be connected to the new development/construction with additional deck(s) not exceeding 3’ in height with the
condition that no new construction can occur within the shore impact zone except for the decking noted above and with the
condition that no more than 25% of the total eligible lot area can be covered with impervious surfaces. Practical
difficulty/hardship is the terrain of the applicants’ property.

This is the second Variance Application for this home addition on this property. The first
variance was granted on August 7*^ 2008, with a condition. The Condition was to move
the home back an additional 2’-0”, to meet the Shore Impact Zone setback of 50’-0”.
The home addition was redesigned to meet that condition. The OHWL setback has been
increased to 50’-8”. The home addition is now a different footprint from the original
application. Because the dimensions are not what was originally requested and approved,
this application is for the new home dimensions. The new home addition is approximately
5T X 72’ irregularly shaped, (the original request was for a 46’ x 92’ irregularly shaped
addition). The new attached garage is 28’ x 48’. (The original attached garage was 28’ x
40’)
Additionally the remodeling work to the existing home is more extensive than the original
application. Because the home is in good condition, and the remodeling would remove
the roof, rebuild the walls, new doors and windows, etc., it made more sense to move the
home from this site. The home owner has the opportunity to relocate the existing home
and move it to another property for use by another owner. The existing foundation would
remain. The home would be rebuilt on the existing foundation to the exact footprint of the
original home (less the portion that is being removed completely).
All of the same practical difficulties exist today for this application as were present in the
granted application from August 2008.
The existing home is positioned at a location where it is considered non-
conforming. Any work done to this home requires this variance application.
Because the home is located on a point it has practical difficulties with the setback
requirements from the OHWL on two sides of the point (the west and the east)
rather than the usual one side.
Other site related difficulties are due to site elevation. The steep slope directly
behind the proposed home prevents the home from being located further to the
west. Some area between the home and the hill has been left to divert the run-off
from that slope into the ground and away from the home.
Although the lot area is extensive, the location where the home is located is the
best building site on the property. Areas to the west are not buildable, requiring
extensive excavation (into the hill) and extensive tree removal (it is fully forested).
Areas further to the south-east of the proposed location are very low (having water
table issues). Further to the south are low lands and forest, both unlikely locations
for building sites. This proposed location is the only flat building pad where the
elevation is high enough above the water table.

The terrain remains the main practical difficulty/hardship for this request, as it was for the
original granted variance request.

C. THE GRADE OF THE SLOPE FROM THE TOE TO THE BLUFF TO A POINT 25FT. OR MORE ABOVE THE
OHWL LEVEL AVERAGES 30% OR GREATER.
D. THE SLOPE MUST DRAIN TOWARD THE WATERBODY.
IF THE SOFT, SEGMENT ON EITHER SIDE OF THE POINT AT WHICH A FEATURE IS 25FT, ABOVE THE
OHWL HAS A SLOPE OF 30% OR MORE, IT IS A BLUFF.
