Motion was made by David Trites, second by Steve Schierer and carried with Cecil Femling and Mark Steuart voting no, to allow the placement of a structure on Tract B-1^37.5' from the ordinary high water level noting that the granting of this portion of the applicant’s request will allow the applicant the ability to enjoy the same rights and privileges as other in the immediate area and will place the proposed structure in the same general building line as other structures in this immediate area. Hardship is the terrain and topography of the applicant’s property. After additional consideration and discussion, motion was made by Steve Schierer, second by Cecil Femling and unanimously carried, to deny the variance for the gazebo as requested noting that the proposed location is within the bluff impact zone. (2 stories) 37.5 ft. from the OHWL of Pelican Lake. This means that the Board of Adjustment clearly allowed a structure to be placed landward of the Shore Impact Zone (SIZ). Under today's standard, the SIZ has been increased to 50ft. landward of the OHWL which means that a 50ft. setback would be needed to meet the Board of Adjustment's intentions. 2) The aforementioned Variance also requires that the structure be placed outside of the Bluff Impact Zone (BIZ) which includes the toe of the bluff to a point 30ft. from the top of the bluff. 3) Include with the aforementioned Variance was a drawing (attached) which shows the proposed structure footprint (greater detail than the overview you received). In order to use the 12/14/00 Variance, a similar structure to that which was proposed (discussed) would have to be built. If you have any further questions, please contact me. In your email below you suggested that any structure built in the same size and location should fall under the previously approved variance. Based on the site plan that was submitted along with the variance application it seems to me that the size and location are extremely vague. I know that we are planning to place the proposed Beach House in the same general location but I don't see any specific information on the site plan or from the approved application other than that the structure would be no closer than 37.5 feet from the OHW line. Obviously any house designed for that location would still need to meet the sideyard setback and stay within the height limitations. Do you see any concerns with the rough site plan that I have attached? We would actually hold the building back as far as possible from the OHW line and start it at the toe of the bluff. Just hoping for some direction before we invest more time and effort into developing a more detailed Beach House concept.
