The narrative below defines our understanding of the project, presents anticipated geotechnical conditions at the site, provides an outline of our proposed "scope of services", and presents fee for our work. Background Information We understand you intend to remove a portion of existing rip-rap at shoreline and replace such with granite stone and native plantings. MNDNR has indicated such removal occurs from and above boundary defined as three feet above the ordinary "high water" level of lake. Conditional permit from Otter Tail County requires review of proposed project with respect to stability. We have provided past geotechnical exploration at your property for construction of Beach Residence. Primary soils associated with this exploration included sandy lean clay / lean clays extending to depth with lesser alluvium stratum. It is our opinion proposed site improvements may use this past geotechnical exploration as basis for conditions at site. Scope of Services We propose the following scope of services as geotechnical consultant for site activities. • NTI will obtain from project landscape architect drawings defining existing conditions and proposed improvements. We will use this information as basis for development of NTI recommendations. • NTI will assess local stability of rip-rap system to remain on site. Such analysis will provide opinion as to global stability of immediate shoreline and whether remaining / augmented rip-rap system installed at site should remain stable under typical seasonal ice action. • NTI will develop an erosion control plan to limit loss of topsoil to lake. • NTI will provide a guidance document on transport of material to and from site. This document is intended to reduce adverse impact to private property adjoining roadway. The Department regulates the area of work below the Ordinary High Water Level of Pelican Lake. An official permit decision cannot be made until after the application comment period is over on April 12, 2018. However, following are my thoughts on the application. The shoreline is currently riprapped for protection from wave erosion. Riprap protection is appropriate along the water's edge at this site because of the large fetch across the lake capable of generating waves of medium to high energy. State Rules for public waters work require the minimal impact solution be employed and that projects result in minimal impact and change to the waters. The Department therefore recommends and may require that the existing natural field stone riprap remain in place to a height of 2.5-3 feet above the lakebed. Excavation of the existing rock and replacement with a different style of rock results in unnecessary impact to public waters. State Rules also encourage the restoration of shorelines to preserve the natural character of the shoreline, improve fish and wildlife habitat, improve the diversity of habitat, and prevent erosion and sedimentation while maintaining natural processes. The rules encourage the use of natural and native materials in shoreland areas and limit the removal of natural materials from the beds of public waters. The work proposed above the water's edge includes natural resource enhancements that are consistent with Department goals. I am very concerned about the stability of the hill side, lake property, and soil under and around my lake home at 50412 Anderson Beach Trail. Over the last 2 summers there has been considerable traffic, activity and movement of trucks and material on the narrow hillside road that passes within 12 to 15 feet of the west wall of my lake home. There is a steep grade and substantial vertical drop approx. 50 feet from the narrow road down to lake shore. Since the increased traffic and weight carried on the narrow, hillside road began 2 years ago the foundation, footings and frame of my residence have shifted. The north door frame is no longer square and the door is un-useable. The floor near the north end of the residence has moved and is noticeably not level. We are concerned about the integrity and stability of the entire hillside. There is a history of large scale slumping where an entire hillside let go and slide in-mass down toward and into Pelican Lake at a location very near (less than 100ft away) from my lake home. This could happen again as we are observing some landscape movement and shifting triggered by traffic carrying heavy loads on the narrow hillside road. If such an event were to occur, even on a smaller scale, the economic consequence's and risk to human life could be catastrophic. I am proposing several options for the Planning Commission to consider: 1.) Do most of the heavy hauling in and out during the winter months on a lake that is frozen with ice thick enough to be safe, or 2.) Consider requiring the use of a crane to lift out the old material and to deliver from above the new material needed for the project, thus eliminating the heavy. repeated, hammering, and flexing of the road bed on the narrow hillside road, or 3.) Require the applicant to post bond in a large enough amount (one million dollars) to cover damages that may result from the heavy use of the road to lake homes and property adjoining the road. 4.) Require that a certified land surveyor conduct a before and after survey of selected survey points a long and below the road bed elevation to determine if the hill side is or has moved. Upon completion of the project. 5.) Require a certified real estate appraiser to provide an estimate of the scope, extent, and dollar amount of damage that occurred because of shifts in landscape identified in"3". Above, to be paid from the bond. It should be noted that the last 2 summers have been relatively dry through approximately mid to late July. When the rains came in late summer the narrow hillside was in good shape, quite solid, not rutted or soft. This construction season is starting with a cold, wet April. If the road is used when it is wet and soft the pushing out effect on the lakeside road could cause noticeably more damage that what we have seen thus far. I have no interest or desire to obstruct or limit property improvements that Mr. Brandt or any applicant may want to accomplish on their property. I am only raising these issues to alert the Otter Tail Planning Commission that the consequences of their action could have far reaching implication for nearby properties and the lake itself. If any damage should occur as a result of your action then the question of who should be liable for such damage could be difficult to sort out if the Commission has not put in place some policy to address such losses. As a property owner who could be effected by the project, the only protection that I have, at this point, is the good judgment of your Commission and your ability to plan for all possible outcomes.
