The property concerned in the application is legally described as Tract A Registered Land Survey No. 14, Property Address - 20257 Pelican Drive S Section 11, Township 137, Range 43 - Township Name - Scambler Lake No. 56-786, Lake Name - Pelican, Class - GD The variance requested is - a variance of 30’ from the required top of bluff setback of 30’ for the placement of a deck 0’ from the top of the bluff. The existing deck is being moved from the east side of the property to the west side of the property where the soil is more stable. ^ayne Stein Board of Adjustment Secretary Date: November 10, 2011 <0^ ' . December 14, 2000 Page 4 Gerald and Brenda Franklin - Approved with conditions Gerald & Brenda Franklin, Pelican Rapids, MN, requested a variance to subdivide, by metes and bounds description, an existing 5.50 acre parcel into two parcels. One parcel would have 405’ of shoreline and would contain 3.7 acres of area. The other parcel would have 310’ of shoreline and would contain 1.8 acres of area. Both tracts meet the minimum size for platted lots on a recreational development lake. The minimum size for a metes and bounds parcel within the shoreland area is 5 acres. The property is described as part of Government Lot 5, Section 31 of Dunn Township by Lake Lizzie. Al Rostad, the potential buyer, appeared along with Gerald Franklin. The audience was polled with no one speaking for or against the request. After consideration, motion was made by Randall Mann, second by David Holmgren and unanimously carried, to approve a variance to subdivide, by metes and bounds description, an existing 5.50 acre parcel into two parcels as described in the applicants’ request with the following conditions; a registered surveyor’s drawing must be provided at the time of conveyance, no additional variances will be granted for any future development of these lots, and there can be no additional metes and bounds subdivisions of these parcels. It was noted that both of the proposed parcels have access to a public road, have room for two on-site septic systems and meet or exceed the size requirements for platted lots on a recreational development lake. Brandt Properties Company - Dwelling approved as modified/Gazebo denied. Brandt Properties Company, Fargo, ND, requested a variance to separate a (minimum) five acre parcel of land and to place an approximately 2000 square foot two-level structure less than 75’ from ordinary high water level of Pelican Lake. The water and sewer systems would be tied into water and sewer systems for residence on remaining 17.69 acres and subject to two party collector system agreements. The current residence not readily accessible to lake, separated by steep bluff. The proposed structure would pass string test and would be able to be accessed by existing road. The amount of lot that would be covered by impervious material is no more than 1%. Also requesting a variance to place a gazebo on edge of bluff on remaining 17.69-acre tract in exact location and on top of existing hot tub. A structural engineer will determine whether any re-enforcement of the existing structure will be necessary to support the gazebo and to monitor the integrity of the bluff. It should be noted that the required ordinary high water level setback is 75’ and the required top of bluff setback is 30’. The property is described as part of Government Lots 3 and 4 and part of the Northwest Quarter of the Southeast Quarter, Section 11 of Scambler Township by Pelican Lake. Bob Russell, Attorney, appeared along with the Ace Brandt, applicant, at the public hearing. The audience was polled with no one speaking for or against the request. After consideration, motion was made by David Trites, second by Steve Schierer and carried with Cecil Femling and Mark Steuart voting no, to allow the placement of a structure on Tract B-1 37.5’ from the ordinary high water level noting that the granting of this portion of the applicant’s request will allow the applicant the ability to enjoy the same rights and privileges as other in the immediate area and will place the proposed structure in the same general building line as other structures in this immediate area. Hardship is the terrain and topography of the applicant’s property. After additional consideration and discussion, motion was made by Steve Schierer, second by Cecil Femling and unanimously carried, to deny the variance for the gazebo as requested noting that the proposed location is within the bluff impact zone.
