James Venaas, Lots 8, 9 and 10 Oak Haven Beach, Tamarac Lake in Scambler Township, requested a
variance to place a drain field up to and into the road right-of-way. Scambler Township has approved the
placement of the drain filed in the road right-of-way. July 13, 2006 Meeting - A letter from Vincent Floberg

Matt Amundson - Approved a building site area based on the submission of a revised drawing with
a condition. (9:30 p.m.)
Matt Amundson, Lot 3 Block 1 Coney Island Acres Second Addition, West Battle Lake in Girard Township,
requested variances from the required ordinary high water level setback of 75’ for the location of a structure
less than 75’ from West Battle Lake. July 13, 2006 Meeting - Jim Peterson, Surveyor, appeared with the
applicant at the public hearing. The audience was polled with no one speaking for or against the variance
as requested. A letter from Jim Davis in support of the variance as requested was read for the record.
After discussion and consideration, Steve Schierer made a motion, second by Paul Larson and
unanimously carried, to table this variance application until the August 3, 2006 meeting for a more
specific/detailed development plan. August 3, 2006 Meeting - Jim Peterson, Surveyor, appeared with the
applicant at the public hearing. After discussion and consideration, Michael Harris made a motion, second
by Steve Schierer and unanimously carried, to approve the proposed building footprint as identified on the
revised drawing dated July 21, 2006 with the condition that whenever construction/development should
occur the applicant must comply with the impervious surface coverage requirement in affect at that time, as
well as, any other setback requirements in affect except for the setback from the ordinary high water level
which has been established by the building footprint identified on the drawing referenced above.
Keith and Michelle Coalwell - Approved the variance as requested. (9:35 p.m.)
Keith and Michelle Coalwell, Lot 12 Block 1 Blyberg’s Point First Addition, Fish Lake in Dunn Township,
requested a variance of 20’ from the required setback from a wetland of 50’ for the placement of a septic
system (tank and drain field) 30’ from the wetland. The audience was polled with no one speaking for or
against the variance as requested. July 13, 2006 Meeting - After discussion and consideration, Randall
Mann made a motion, second by Steve Schierer and unanimously carried, to table this variance hearing
until the August 3, 2006 meeting to allow the applicants an opportunity to consider other alternative which
would not require a variance from the wetland for the installation of a septic system. August 3, 2006
Meeting - Wayne Johnson, System Designer, appeared with the applicant at the public hearing. Mr.
Johnson stated that this is the best location if perhaps not the only location. After discussion and
consideration, Steve Schierer made a motion, second by Paul Larson and unanimously carried, to approve
a variance of 20’ from the required setback from a wetland of 50’ for the placement of a septic system (tank
and drain field) 30’ from the wetland as depicted on the drawing submitted with the variance application
dated June 13, 2006. Hardship is the terrain features of the applicants’ property.
Ivesdal Tst - Approved the variance as requested with conditions. (6:49 p.nn.)
Ivesdal Tst, Lot 2 Block 2 Silent Haven, West Silent Lake in Dora Township, requested a variance to have
Lot 2 Block 2 Silent Haven, a substandard back lot, declared buildable for non residential uses. Roger
Ivesdal represented the applicant at the pubic hearing. The audience was polled with no one speaking for
or against the variance as requested. After discussion and consideration, Cecil Femling made a motion,
second by Steve Schierer and unanimousiy carried, to deciare Lot 2 Biock 2 Silent Haven a buildable lot for
non residential use with the following conditions: 1.) the back lot must be permanently attached to the
applicant’s lake lot and 2.) the area contained within the back lot cannot be used when determining
impervious surface coverage for front lot development.
Michael A. Trutko-Approved the variance application as requested. (6:53 p.m.)
Michael A. Trutko, Lot 10 Nelson’s Oakwood Park Beach, Jewett Lake in Elizabeth Township, requested a
variance of 5’ from the required road right-of-way setback of 20’ for the placement of a 24’ by 32’ garage
15’ from the road right-of-way. The audience was polled with no one speaking for or against the variance
as requested. After discussion and consideration, Cecil Femling made a motion, second by Michael Harris
and unanimously carried, to approve a variance of 5’ from the required road right-of-way setback of 20’ for
the placement of a 24’ by 32’ garage 15’ from the road right-of-way. Hardship is a substandard lot of
record. The Board noted that the variance as approved does provide the applicant with a reasonable use
of his property and also the ability to enjoy the same rights and privileges as others in this immediate area.
Thomas L. Ulmer - Approved the variance application as requested with a condition. (6:57 p.m.)
Thomas L. Ulmer, Lot 6 Kapler’s Second Addition to Grand View Heights, Big Pine Lake in Pine Lake
Township, requested a variance of 15’ from the required ordinary high water level setback of 75’ and a
variance of 6” from the required side lot line setback of 10’ for the placement of a 7’ by 12’ dormer on the
south side and for the placement of a 7’ by 18’ dormer on the north side of an existing roof located 60’ from
the ordinary high water level and 9.5’ from the north lot line. The audience was polled with no one
speaking for or against the variance as requested. Letters from Richard and Linda Swenson and Dennis
and Diane Kragnes in support of the variance as requested were read for the record. After discussion and
consideration, Steve Schierer made a motion, second by Cecil Femling and unanimously carried, to
approve a variance of 15’ from the required ordinary high water level setback of 75’ and a variance of 6”
from the required side lot line setback of 10’ for the placement of a 7’ by 12’ dormer on the south side and
for the placement of a 7’ by 18’ dormer on the north side of an existing roof located 60’ from the ordinary
high water level and 9.5’ from the north lot line with the condition that no more than 25% of the total lot area
can be covered with impervious surfaces. Hardship is a substandard lot of record. The Board noted that
the proposed development will not obstruct the view from the adjacent properties.

RE: Jim Venaas Septic System
The Tamarac Lake Association has assisted the Minnesota DNR with many projects, and
one of them has been septic systems on our lake. When we first started encouraging lake
front landowners to update their septic systems to current standards, there were over 20
systems in question. As far as I know, everyone is in compliance right now. Jim Venaas
has contacted Egge Construction to test and determine the best possible location for his
septic system. They are a reputable company and know what they are doing. The location
that they have decided upon is the BEST suited based on elevations and percolation
tests. I trust Egge to make this decision to be of the best interest of all agencys involved.
As acting president of the Tamarac Lake Association, 1 feel it would be a mistake to force
this septic system to a second or third best possible site. As far as there being an old road
drawn on the original plot map, if the tovraship has given approval of never using this
property, then it should be available to the legal land owner to have and to hold as any
other property that he or she owns. The road that was built years ago is not at all where
the original plot shows it to be and the township is never planning on building a new road
on the plotted positions. The township has abandoned this property. They have never
controlled the noxious weeds or have done any improvements to it. Jim Venaas is taking
care of this by clipping and it is sure nice to see the improvement by our lake. Please
consider that the township has abandoned this property and like other cases when they
abandon property, all rights go back to the adjacent land owners.

Scambler Township has no objection to installing a drainfield in the dedicated public road ROW

The Owner, and not Scambler Township will be held responsible for any damages that may

I am requesting the Boards approval to install a drain Held on what
was originally platted out as Tamarac Drive right-of-way.
Tamarac Drive is presently and has always been on land owners
property from Lots #1 through Lot #12. This came about years ago
because of the large number of Oak trees that are on the platted
Tamarac Drive so the original trail was then located on owners lots to
avoid having to remove the Oak trees.
On June 2, 2006 Steve Egge of Egge Construction took soil samples and
surveyed the height above lake level of my property to ascertain a
suitable site to locate my drain field. His determination was that the
only area that I could install a drain field on would be across the present
Tamarac Drive. If approved, it will be installed away from Tamarac
Drive in such a manner that it would not interfere with graveling,
grading or snowplowing.
It is noted that there presently are two property owners with drain
fields located on this road right of way and those lots are Lot #6 and Lot
#13.
I have a picture of the proposed area and also a drawing done by Steve
Egge, on my survey map, that shows the area where I am requesting
your approval to install a drain field.
Your favorable consideration to my request would be greatly
appreciated.

County Shoreland Management Ordinance, the Otter Tail County Set Back Ordinance and/or the Subdivision Controls
