Please consider this application for topographical alterations for landscape related work with
relation to new home construction. The improvements propose to excavate or fill 660 cubic yards
of soil with regard to the installation of boulder outcropping primarily for storm water retention
and the installation of a garden level entry patio and stairwell. The project also proposes to
remove the existing dilapidated creosote railroad tie steps and install a more sensitively designed
grade level stone or concrete access walkway to the dock and resurface the existing deck located
down by the lakeshore.

On August 11, 2010 the Planning Commission passed a motion to recommend approval of
your request. Their motion is as follows:
A motion by Wilson, second by Schwartz to approve as presented, with the following
conditions: 1. The retaining walls must have a 10’ setback from the lotline (Applicant
must work with Land & Resource and provide them a new plan). 2. The Applicant must
provide confirmation to Land & Resource regarding the purchase of the backlot, which will

On August 17, 2010 the County Board of Commissioners passed a motion to approve the
request as recommended by the Planning Commission.
As you can see, there are conditions placed on this approval. Since this is the case, please
find that I have returned your Site Permit Application, drawing and $275 Fee (Check #6526).
Once these conditions are met, our Office will process your Conditional Use Permit, and at
that time you can file your Site Permit Application for processing.

6:30 P.M. in the Commissioner's Room, Government Services Center, Fergus Falls,
Minnesota.
Roll Call:
Members Present: Rod Boyer, Ken Erickson, Marion Gill, Bert Kinzier, Joe Maske, Robert
Schwartz, David Trites, Rick Wilson and Leona Zimmerman.
Members Absent: Bert Olson.
David Hauser represented the County Attorney's Office and Tim Griep represented the
Land & Resource Management Office.
Minutes of August 11, 2010: A motion by Schwartz, second by Maske to approve the
August 11, 2010 Minutes as presented, with a correction to the numbering on the motion
for the Tom & Georgia Dawson, Pelican Lake (56-786) application as follows:

Public Meeting - Burkel Turkey Farms. Inc.
At 11:42 a.m., Chairman Froemming opened a public meeting for comment(s) regarding a permit
request from Burkle Turkey Farms, Inc. to increase animal unit capacity at their feedlot located in the
W!/2 of Section 19 in Gorman Township. County Attorney, David Hauser, stated that this public
hearing is held on behalf of the Minnesota Pollution Control Agency. The MPCA is responsible for
issuing the permit. No comment, either at this public meeting or in writing previous to the meeting,
was received.

13D.05 Subd. 3b. Present were all five seated commissioners. County Attorney, County Coordinator

At 12:08 p.m.. Chairman Froemming declared the meeting of the Otter Tail County Board of
Commissioners recessed for lunch break. The meeting was reconvened at 1:35 p.m.
Detention Center Exhaust Air
Physical Plant Manager, Rick Sytsma, discussed how the air from the Detention Center is exhausted.
He discussed the mechanical changes needed to exhaust the air to the outside. A bid of
approximately $50,000 for the work has been submitted. Mr. Sytsma recommended waiting a couple
of weeks to accept the bid as more information will be available from the dispatch study.

Motion: A motion by Wilson, second by Schwartz to approve as presented, with the foilowing
conditions: 1. The retaining walls must have a 10' setback from the lotline (Applicant must work
with Land & Resource and provide them a new plan), 2. The Applicant must provide confirmation
to Land & Resource regarding the purchase of the backlot, which will allow for the location of a septic system (design to be submitted to Land & Resource) & a parking are'^’4. Appropriate
temporary erosion control measures must be installed prior to starting the projectVS^. Land &
Resource must be notified prior to beginning' the project. Note: The Applicant is aware that he is
responsible for drainage. Voting: All members in favor.

A Conditional Use Permit Application (as stated by the Applicant on the Application): This request for land
alteration has two projects on the same property. The two parts include: (I) an "After-the-Fact"
permit involving a walking path (passable for persons with physical limitations), four feet wide, from
and around our home to the lake; and (II) a service path, nine feet wide along the northern-most lot
line, starting from our existing driveway to the lake - wide enough to accommodate vehicles such
as a snowmobile/service trailer, portable fish house, or small 14-foot boat and trailer. We
respectfully ask that the planning commission consider both projects, as they will serve different
