After consideration and discussion, Paul Larson made a motion, second by Steve Schierer and unanimously carried,
to approve a variance of 18’ from the required ordinary high water level setback of 100’ for the placement of a
structure 82’ from the ordinary high water level as depicted on the applicants’ drawing dated August 26, 2005 with the
condition that an existing 10’ by 20’ shed must be placed in a location that complies with the setback requirements of
the ordinance.

The variance approved on October 6, 2005 had the following condition; “that an existing 10’ by 20' shed must be
placed in a location that complies with the setback requirements of the ordinance.” Kyle Westergard, Land and
Resource Department, stated that the applicants cannot comply with this condition as there is no location on the
applicants’ property where the 10’ by 20’ shed can be placed which will meet all of the setback requirements. After
discussion and consideration, it was the general agreement of the Board of Adjustment that the applicants can place
I :the 10' by 20’ shed in a location that is at least 20’ from the road right-of-way and behind the front (lakeside) of the
lissdwelling.
July 14, 2005 - Gregory Flack -
The July 14, 2005 minutes indicate that the proposed development would be 78’ from the ordinary high water level.
The shortest actual distance to the ordinary high water level is 67’. Kyle Westergard, Land and Resource
Department, noted that the proposed development was constructed in the location as depicted on the drawing
submitted with the applicant’s variance request; however, one distance from the proposed development to the
ordinary high water level was measured incorrectly. After discussion and consideration, it was the general agreement
of the Board of Adjustment to change the measurement in the previously approved variance minutes from 78’ to 67’
since the proposed development was constructed in the approved location.
With no further business, Randall Mann, Chairman declared the meeting adjourned at 7:45 p.m.

The Otter Tail County Board of Adjustment met Thursday, October 6, 2005, with the following persons in

Called to Order - Randall Mann, Chair called the meeting of the Board of Adjustment to order at
6:30 p.m.
Minutes Approved -
The Board of Adjustment approved the minutes of the September 8, 2005 Board of Adjustment meeting as
mailed.
The Board of Adjustment considered the following applications for variance:
Cheryl Wersal - Approved Part A and Denied Part B. (6:31 p.m.)
Cheryl Wersal, Lots 1 and 3 Block 3 Pischke and Taylor Addition, Spitzer Lake in Leaf Mountain Township,
requested the following: A.) Requesting variance of 128' from the ordinary high water level to build 225
square foot addition between garage and house, and B.) Requesting variance of approximately 142' from
the ordinary high water level and variance of 10' from side lot line to build a screen porch addition. Greg
Wersal appeared along with the applicant at the public hearing. The audience was polled with no one
speaking for or against the variance as requested. After consideration and discussion, Steve Schierer
made a motion, second by Cecil Femling and unanimously carried, to approve a variance of 128' from the
required ordinary high water level setback of 200' for the construction of a 225 square foot addition
between the garage and house as depicted on the drawing dated August 5, 2005 and to the deny
variances as requested in Part B for the screen porch addition. The variance approved for the addition
between the garage and house is behind the main portion of the dwelling. The Board noted that the
variance as approved does provide the applicant with a reasonable use of her property and a reasonable
use can be obtained without the granting of a side lot line variance. The variance as approved applies only
to Lot 3 Block 3 of Pischke and Taylor Addition. Hardship is a substandard lot of record.
Ron and Sonya Huesman - Approved the variance as requested with a condition. (6:50 p.m.)
Ron and Sonya Huesman, Outlet A Sunset Bay and part of Government Lot 1, Section 26 of Tamarac Lake
by Scambier Township, requested a variance of 18' from the required ordinary high water level setback of
100' for the placement of a structure 82' from the ordinary high water level. The applicants' proposed cabin
and basement plans meet all other setback and ordinance requirements, but the lot is not deep enough to
meet the ordinary high water level setback requirement. The applicants' proposal complies with the
guidelines for issuing a permit for a structure with less than the required ordinary high water level setback
under Section V.2.E (administration) except that there is no structure on the adjacent lot to the South,
therefore, the applicants cannot apply the string line test to determine the allowed setback. The applicants
proposed location is about 8' further back from the lake than other existing cabins in this immediate area.
The audience was polled with no one speaking for or against the variance as requested. After
