Bryan and Cynthia Olson. Lot 10 Block 2 of Peach's Shady Shore, Star Lake in Star Lake Township, requested the
following: We are requesting to add a 4' by 8' balcony on our second floor to be used as a fire escape. This structure
would extend 4’ from the building, which is 8.5' from the propeity line. Requesting a 1.5' variance from the lot line.
Required setback is lOL The audience was polled with no one speaking for or against the variance as requested. After
consideration and discussion, Thomas Lee made a motion, seconded by Paul Larson and unanimously earned, to
approve a variance of 1.5’ from the required 10' side lot line setback of 10' for the placement of a 4' by 8' balcony
8.5' from the side lot line. The balcony will be used as a fire escape for the second floor bedrooms.
Hardship/practical difficulty is a substandard lot of record. The development as approved will address a public safety
issue by providing egress from the second floor. The variance as approved does not directly or indirectly grant any
other variances for the proposed or future development.
ivin and Janii Haiigstad - Denied. (8:12 p.m.)
Revin and Jami Haugstad, Lot 6 Block 1 of Stalker Lake Golf View Shores, Stalker Lake in Tordenskjold Township,
requested the following;
1. A site pennit is needed for the boat house and deck.
2. Boat house is 11 'A' tall (rather than 10').
3. Setback from bluff is 25’ (rather than 30’).
The audience was polled with no one speaking for or against the variance as requested. After consideration and
discussion, Steve Schierer made a motion, seconded by Rick Wilson and unanimously cairied with Rick Wilson and
Ward Uggerud voting no, to deny the variance as requested as no adequate hardship/practical difficulty had been
shown that would allow for the granting of the variance as requested, the applicants can obtain a reasonable use of
their property without the granting of the requested variance and the applicants can comply with the requirement of
the ordinance. The members of the Board stated that the property must be brought into compliance by October 1,
2016.

concern with drainage and road access. An email from DeLyle and Lori Ishaug, Diane Moderow and Susan
Schroeder expressing concerns with the applicant's request was read for the record. An email from John Savre in
opposition to the variance as requested was read for the record. After consideration and discussion, Steve Scluerer
made a motion, seconded by Thomas Lee and cairied with Ward Uggemd voting no, to declare Lot 3 Block 2
Summer Haven Beach First Addition a buildable lot. The variance as approved does not directly or indirectly grant
any other variances for this property. Declaring this lot as a buildable lot will provide the applicant with the ability to
enjoy the same right and privileges as others in this immediate area.
Timothy Stoll - Denied. (8:57 p.m.)
Timothy Stoll, part of the Northwest Quarter of the Northwest Quarter and part of the Southwest Quarter of the
Northwest Quarter, Section 28 and part of Goverrmient Lot 1, Section 29, Edna Township by Big McDonald and
Tenter Lakes, requested the following: Proposing to create 3 non-residential lots without platting. Each lot being

Mr. Wayne Stein,
We are property owners on Pelican Lake - Summer, Haven Beach. At this
time, we are uncertain if we will be able to attend the meeting scheduled for Thursday, July 14th.
We have several questions or concerns regarding the variance.request by Mr. Biffert and would appreciate your time
and consideration of the following items:
What will be the size of the structure Mr. Biffert is planning to construct?I.
See attached drawing as submitted by the applicant.
What will be the exact location of the new structure, and what will be the distance from the beach road which is
basically a narrow gravel road, and hot very conducive to having two.cars going opposite directions at the same time.
There is already a'fairly new home that was just completed a couple of years ago which is extremely close to the road,
and causes problems when meeting an oncoming vehicle.

the only information I have available is what was submitted by the applicant, which you will find in the two
attached documents.

Has Mr. Biffert made provisions for adequate parking?3.
Please see the attached documents.
This area is already congested and seems like parking could become an issue If he is going to replace the
existing dwelling, deck, shed, and gravel with a new structure. At times there can be as many as 10 or more vehicles
parked in the graveled section, which is not a problem currently, since that is the purpose of that area, but how will this
be handled if it he is also going to replace the graveled area with a dwelling?
I cannot answer this questions other than to refer you to the attached materials. Perhaps this question will be
discussed at the meeting tonight.
We have also been led to believe that each lot can consist of only one dwelling. Are the front lot and back lot
owned by and titled, in the

considered to be one piece of property, or are they actually two separate parcels,
name of two separate individuals?
Parcel 55-000-99-0444-000 (Lot with Lake Frontage) and Parcel 55-000-99-0714-000 are separate lots for
development purposes and for conveyance purposes. They are both title in the same name; however, they are not
substandard contiguous lots as they are separated by a dedicated public road.
We would appreciate any information you would be able to share with us.

Wayne, 1 am against Mr. Biffert's project on his back lot. Years ago most of that area and surrounding area was
a pond; The land was all filled in with fill. When my parents owned the cabin we had over 100 oak trees on our
3 lots. Ten to fifteen years after the back lots were filled we lost all our oak trees. Many tipped over during a
wind storm. The roots were pulled out of the ground which was full of water. Somehow filling in the back lots
changed the flow of underground water. Wayne Johnson might remember when he fixed my holding tank. I had
to run a sump pump to pump out the water that was flowing from the back lots under the road. If you can drive
to Summer Haven Beach. Check out the trees on the 2 lots East of mine and the 4 lots West of mine. All 7 lots
,lost almost all their trees. Last year Mr Biffert had rock put on about the first 40 feet South of our road behind
his cabin and the width of his lot(75 feet). This is the land that was donated years ago for a new road.. As far as I
know, not his land. As you know we had lot of rain on Saturday,Sunday and Monday. The water normally flows
West to the culvert3-4 cabins West of me and into the lake. Much of the water was backed up because Mr.
Biffert's rocks darned up much of the water. Mr Biffert's lake lot, Lucy Tabbot's lake lot and Vem Smith's Lake
lot were under water. Lucy's, Vem's and Greg Butler's back lot south of the road were also under water. If Mr
■ Biffert builds on the back lot, he is going to want to build up the land so he will be high and dry. I'm.not an ,
expert on the flow of water but I know allowing Mr. Biffert to build on the back lot will cause lots of water
trouble for many of us neighbors. Wayne, try to come out and look-around. Walk on the lots East of Biffert and
see how boggy they are. I know when Mr. Buttler sees the water on his back lot you will hear from him. Also, if
you come out stop at Vem and Alice's cabin. They are 2 East of Biffert. Please stop and talk with them. Ask
them what Biffert said to them when they said they would'nt vote yes for his first project. Vern and Alice are in
their mid 80s and I don't think they dare to object. They are the ones that will be constantly flooded if Biffert
fills in the back lot and builds. I'm sorry for rambling but Biffert has taken a lot of the fun from my lake life.

October 7, 2015. As you will note in this email Mr. Scott Savre had communication with Wayne Johnson County
Commissioner prior to contacting me. I reviewed my October 7, 2015 response and my opinion of the process would be
the same today.

Wayne, my name is John Savre. I am Kevin Biffert's neighbor on Pelican Lake West of him. I would like you to
explain what he is building and where he is putting it. We have not had a very good relationship. I don't trust
anything he does. You probably know about our dock problems. His attitude is: he does what he wants and if
he gets caught he will pay the fine. If I were allowed to vote I would vote no. I don't want something that big
next door to me. If Mr. Ishaug decides to cut down the trees on the East end of his lot, Bifferts project would
be very visable from my cabin. Wayne, dad bought our lot in the mid 40s. Our cabin was originally a Sears
garage. Dad said you couldn't get wood to build because of the war. We would always use the land behind us
to store our boat trailers, dump lake weeds and grass clippings. When we had a dry summer we would park
our cars there. When Mr. Ishaug bought the land behind us he had h;is lawyer send a letter to dad telling him
to stop using the land. Mr Ishaug then put a fence along the road and stopped our access to the land. The
fence was so close the the road we had a hard time backing our car up to leave. A couple years later I went to
Land Management to check on if Mr Ishaug was given permission to buy the land behind us that was
designated for a road. They said no, and nobody could buy it because it was designated for a road. After telling
Dad that Ishaug did not own the land he told us he didn't want to cause trouble. The fence after a couple years
got knocked down and I've been storing burning wood, dumping lake weeds and putting other things back
there. Wayne Johnson had mentioned he thought the lake owners could apply to get the land. I don't know if
the land was my Dad's and he donated for the road. It's really hard to keep everything on a 50 foot lot. Having
the land behind me that was donated by land owners for a road would help me allot. Wayne, do you know

To whom it may concern:
We are writing in regards to the variance request by Mr. Biffert. One of his requests is to have his lot declared
residential, which concerns us.
With the large structure and concrete apron that is being requested, if his lot is declared buildable we are concerned
how that will affect our property and other property owners. We feel with the high water table that exists on his
property and the natural flow of the water, we will take on more water to our property. If he builds a large structure and
has to bring in fill, all the water will be pushed.down the road to the other properties. After last weekend's major storm,
with all the rock he brought into his property, he did not have much standing water, but the properties on either side:of
. him had large pools of standing water.
Having the property adjoining Mr. Biffert, we are concerned that our property may be affected with excessive water
flow. Because of this real possibility of excessive water flow to Mr. Biffert's neighbors to the west of him, we urge you to
consider this when making your decision.

Your proposed deck will need the variance also. Basically any improvement that requires a site permit will require the
variance. I just put the variance application in the mail.

Hi Kyle,
I currently have a trailer house on the back lot that is 14' x 66' or about 924 square feet.
If I built a storage building on the back lot and stayed within the Impervious Surface numbers of 25% for building and
sidewalks or driveway, what kind of approvals do I need for this?
I would stay 10' within all boundaries of the lot. Do I need a special approval from the neighbors?
Can I put 924 square feet of living quarters in this building? What if any different approvals are needed for this?
How tall can I go without having to get special approvals from neighbors?
I did a rough sketch below of the property with a 50' x 90' building and a 50' x 10' concrete apron out front.
