Kevin Biffert, Lot 3 Block 2 Summer Haven Beach First Addition, Pelican Lake in Scambler Township,
requested the following: Structure to be setback 1 ’ from property line. Property next to mine is fully treed
and no site from others buildings or premise. 30’ by 75’ canopy with top only for parking. Kenny Biffert
represented the applicant at the public hearing. The audience was polled with Laurie and Sue Ishaug
speaking against the variance as requested. Letters and emails from the following individuals in opposition
to the variance as requested were read for the record: George and Sharon Gorton, John Gorton and John
Savre. After discussion and consideration, Steve Schierer made a motion, second by Richard Gabe and
unanimously carried, to deny the variance as requested as no hardship/practical difficulty unique to the
property had been shown that would allow for the granting of the variance as requested and there are other
alternatives available that will provide the applicant with a reasonable use of his property.
Jay and Stacey Stibbe- Variance applieation approved as requested with a condition. (8:27 p.m.)
Jay and Stacey Stibbe, part of Government Lot 3, Section 10 of Dunn Township by Pelican Lake, requested
the following: I am asking to replace an existing deck. In doing so I would like to make it all one height
and include rail for safety and aesthetic purposes. Federal building code does not support current structure
and design. This is a concern from a liability and insurance standpoint. We are requesting a variance of 54’
for deck to be placed 21’ from ordinary high water level. Existing deck is 16’ from ordinary high water
level. Additionally, because we are giving up deck space towards the shoreline I would like to widen deck
to make a practical space and better match cabin. This also would give our neighbors a better site line.
Current impervious surface is at 37% and proposed will be 37.6%. Current impervious surface is 694
square feet in Shore Impact Zone. Proposed is 740’ square feet. Requesting a variance to increase
impervious surface coverage in the shore impact zone by 46’ square feet. The audience was polled with
Jack Young speaking in favor of the variance as requested. A letter from Duane and Winne Ulschmid in
support of the variance as requested was read for the record. After discussion and consideration, Thomas
Lee made a motion, second by Paul Larson and unanimously carried, to approve the proposed development
as described in the variance application dated April 20, 2016 and as depicted on the drawing submitted with
the variance application with the condition that impervious surface coverage cannot exceed 35% upon
completion of the proposed project. The variance as approve does not directly or indirectly grant any other
variances for the proposed development. It was noted that the proposed development will be further back
from the ordinary high water level than the existing development.
Scott and Chris Zeleny - Variance application approved as requested. (8:35 p.m.)
Scott and Chris Zeleny, part of Government Lots 3 and 4, Section 6 of Gorman Township by Silver Lake,
requested the following: We are asking for 100’ setback from the 200’ for a 40’ camper, outhouse and 12’
by 12’ shed. We have a total of 175’ from the ordinary high water level to the township road. 75’ behind us
is considered low land. Note - 8’ by 8’ water oriented accessory structure 65’ from ordinary high water
level. The audience was polled with no one speaking for or against the variance as requested. After
discussion and consideration, Paul Larson made a motion, second by Thomas Lee and unanimously carried,
to approve a variance of 100’ from the required ordinary high water level setback of 200’ for the placement
of a 40’ camper, outhouse and 10’ by 12’ shed 100’ from the ordinary high water level as depicted on the
drawing submitted with the variance application. Hardship/practical difficulty is the lot size. The variance
as approved will provide the applicants with a reasonable use of their property. The variance as approve
does not directly or indirectly grant any other variances for the proposed development.

This email is in regard to the "Notice of Hearing for Variance"
concerning the Biffert property on Pelican Lake.
Due to a prior commitment, we will be unable to attend the meeting scheduled for May 12th... however we would like
to voice our opposition to the entire
project as proposed. With the size of the 30’ by 75' canopy
structure, deck, shed, and large paved area, it appears as if this project would be better suited for a resort, and totally
out of line for this location.
A project of this magnitude is completely out of proportion for the size of the lot, and shows a lack of consideration as to
how it will affect the neighbors and other beach
residents. We are also puzzled as to why the structure has to be so
large, and so close to the neighbors lot line... it certainly isn't meant to accommodate public parking? For these
reasons we are opposed to this application for variance.

Thank you Wayne for the information. I am totally against this projeet. He has already ruined my view of the
lake with his massive docks. I'm worried about what he is going to put on all this cement. How will this cement
change the flow of water? Where will the water go draining from the cement? My cabin is low and I would
have water problems if the water flows toward my cabin. I don't think it is fair to Mr. Ishaug if you let him put
the project one foot from the property line. I think it will be an eye sore from my lot. If I could vote? I would

Wayne, my name is John Savre. I am Kevin Biffert's neighbor on Pelican Lake West of him. I would like you to
explain what he is building and where he is putting it. We have not had a very good relationship. I don't trust
anything he does. You probably know about our dock problems. His attitude is: he does what he wants and if
he gets caught he will pay the fine. If I were allowed to vote I would vote no. I don't want something that big
next door to me. If Mr. Ishaug decides to cut down the trees on the East end of his lot, Bifferts project would
be very visable from my cabin. Wayne, dad bought our lot in the mid 40s. Our cabin was originally a Sears
garage. Dad said you couldn't get wood to build because of the war. We would always use the land behind us
to store our boat trailers, dump lake weeds and grass clippings. When we had a dry summer we would park
our cars there. When Mr. Ishaug bought the land behind us he had h;is lawyer send a letter to dad telling him
to stop using the land. Mr Ishaug then put a fence along the road and stopped our access to the land. The
fence was so close the the road we had a hard time backing our car up to leave. A couple years later I went to
Land Management to check on if Mr Ishaug was given permission to buy the land behind us that was
designated for a road. They said no, and nobody could buy it because it was designated for a road. After telling
Dad that Ishaug did not own the land he told us he didn't want to cause trouble. The fence after a couple years
got knocked down and I've been storing burning wood, dumping lake weeds and putting other things back
there. Wayne Johnson had mentioned he thought the lake owners could apply to get the land. I don't know if
the land was my Dad's and he donated for the road. It's really hard to keep everything on a 50 foot lot. Having
the land behind me that was donated by land owners for a road would help me allot. Wayne, do you know

Unfortunately, due to a schedule conflict I am unable to attend.
I'm having a hard time figuring out why a structure of that size would be needed for parking? Is he planning on
operating a trucking company from that address? The proposed 30'x75' parking structure is big enough to park three
full size semi tractor / trailer units side by side.
In addition, much like the dock fiasco of 2015, why would his neighbors want something of this magnitude as close as
possible to them??
I am not in favor of this variance as it is proposed.

I will send you an application for the Planning Commission to request to pave the road. You can ask for anything you
want on the variance, just keep in mind the closer to compliance you are the better your odds of approval are. I have
attached the cutoff and meeting dates for the upcoming variance meetings. If the application gets to us by the cutoff
date you can expect about a 3 to 4 week wait until the meeting.
The variance request looks OK. I will discuss the Grade and Fill with our resident expert once I receive the original.

Hi Kyle,
For item #2 below, I contacted Mike Johnson, (218-849-0480) Scambler Township for approval and he said that anything
1000 feet or less from lake shore is in county control for any approvals as long as this is not a township road, and it is not
a township road.
So how do I get Planning Commission approval to pave the road and easement?
I am going to send in the Application for Variance first for the canopy to ask for approval and if approved then I would
add it to the site permit I need anyways for the deck addition and shed. I will not do the shed if I can get approval for the
Canopy.
Can I ask to be up to the property line since there is only woods next to my property or is 5' the closest?
How long does the Variance approval typically take?

Hi Kyle,
For item #2 below, I contacted Mike Johnson, (218-849-0480) Scambler Township for approval and he said that anything
1000 feet or less from lake shore is in county control for any approvals as long as this is not a township road, and it is not
a township road.
So how do I get Planning Commission approval to pave the road and easement?
I am going to send in the Application for Variance first for the canopy to ask for approval and if approved then I would
add it to the site permit I need anyways for the deck addition and shed. I will not do the shed if I can get approval for the
Canopy.
Can I ask to be up to the property line since there is only woods next to my property or is 5' the closest?
How long does the Variance approval typically take?

met. If they cannot be met a variance would be needed to do the work.
The paving of the road would require Dunn Township approval. If they do not claim jurisdiction over the road
then the County is the approval authority. Planning Commission approval would need to be obtained.
Paving the easement would be the same as #2. It appears you have a 66' wide Right of Way thru your
property.
The canopy would require a variance as it would not meet structure setbacks. If variance is approves a site
permit would be required.
The shed on the back lot would need a permit. Same conditions as #1.

Hope your winter was a good one.
My property 20705 Summer Haven Road, Pelican Lake and the back lot is what I am asking questions about today.

■,1)‘ Do I need a new permit for the addition to my deck? I had it on the request last year, just did not get to it but
would like to do it this spring. See attached document "ADDITION TO DECK 2016" The addition is 120 square
feet (10' X 12').
2) I would like to pave the road (my 75' in length about 14' wide). Do I need a permit? I calculated about 120 cubic
feet of pavement if it was 6" deep. I have asked beach captain if others would do it also but have not heard
back yet.
3) I would like to pave the easement (we put gravel in for parking) just next to the road up to the property line.
Who do I get permission from for this area? The area is about 41' x 75' shown on the print attached called
"PAVING OF ROAD AND GRAVEL PARKING".
4) This is in reference to the above question, if I can pave the easement area where we park, can I put a portable
roof over top of it? These are common in Arizona and saw them in Vegas also to keep sun off, no sides to this
type of canopy.
5) Can I put a portable shed in the back lot on top of the gravel area we got approval for last year? See the
attached print "PORTABLE SHED ON BACK LOT" The shed is shown in magenta color, 10' x 20'. I am going to use
it for lawn tractor to keep out of sun. This is fully enclosed when zipping the door shut in front.
I can call you if that is easier or please reply to this email so I know what to do from this point forward.
