Planning Commission
Conditional Use Permit - John Ferguson:
Motion by Johnson, second by Froemming and unanimously carried to deny, as recommended by the
Planning Commission, an after-the-fact Conditional Use Permit for an earth moving project. The Applicant
must work with the Land & Resource Management office to develop a restoration plan that meets the
requirements of the June 8, 2017, Variance approval.

Aquatic Invasive Species (AIS) Task Force Minutes
Land & Resource Director Bill Kalar reviewed the September 11,2017, AIS Task Force minutes. Discussion
took place regarding the Decontamination Units which were not used during the summer of 2017.
Commissioners expressed an interest in collaborating with the large counties to combine dollars for AIS
prevention research.
Compliance Inspection Policy
Mr. Kalar provided suggested clarifications to the Compliance Inspection Policy. This item will be reviewed
by the Public Works Committee.
Appointment to Partnership4Health fP4H1 Community Health Board (CHB)
Motion by Johnson, second by Rogness and unanimously carried to appoint Bill Adams from Erhard, MN to
the P4H CHB effective January 1,2018, for a three-year term.
Recess & Reconvene
At 11:42 a.m.. Chair Huebsch declared the meeting of the Otter Tail County Board of Commissioners
recessed for committee meetings and lunch break. The meeting was reconvened at 1:05 p.m. with
Commissioner Roger Froemming absent.
Assistant Highway Maintenance Supervisor Position
Motion by Lindquist, second by Rogness and unanimously carried to approve an Assistant Highway
Maintenance Supervisor position as recommended.

Project; Kevin Biffert Site Improvements
To Whom it May Concern:
Mr. Biffert has retained Ulteig Engineers to conduct a topographic survey and develop a site plan to control storm water runoff and
surface the road with 6” concrete at 20705 Summer Haven Road on the south side of Pelican Lake.
Existing Conditions
Generally speaking, the property flows south to north, towards the lake shore. The adjacent properties on both the east and west sides
drain towards Mr. Biffert’s property. These elevations are shown on the attached exhibit.
Proposed Improvements
Concrete Pavement
Mr. Biffert is proposing to install 6” concrete pavement; replacing the existing road, then extending the surface south, connecting to
the concrete apron on the new building. The concrete pavement, in general, will slope towards the North East comer of the property.
The elevation of the concrete pavement will match into the existing elevations of the existing gravel surface.
Drainage will then flow along the eastern property line approximately 170 feet through the grass to the existing drain tile inlets leading
to the lake. To ensure the storm water runoff does not encroach onto the adjacent property to the east, a grassy berm will be installed
along the property edge to the inlets. However, because the existing drainage pattern flows toward Mr. Biffert’s property, the area
around the inlets remain open to allow for the adjacent property to drain through the existing drainage improvements.
Stormwater Inlets
The existing storm water inlets along both the east and west sides of the existing 50’ x 80’ building will drain through a solid 6” PVC
pipe under the existing road to a new inlet on the north side of the road. The water will then flow overland approximately 135 feet to
the existing inlets that direct the stormwater flow to the lake, reducing erosion. Berms will be built along the east side of the property
reducing mnoff encroachment onto the adjacent property. However, the adjacent property currently flows towards Mr. Biffert’s
property similar to the north side of the road. Mr. Bifferts improvements will not impede the current water draining pattern onto his
property to ensure proper drainage of the area.

At 10:20 a.m., Chair Huebsch declared the meeting of the Otter Tail County Board of Commissioners
recessed for a short break. The Board meeting was reconvened at 10:28 a.m.

Motion by Johnson, second by Rogness and unanimously carried to authorize Chairman Huebsch's
attendance at the Beegle Poverty Institute in Bloomington, MN, July 24 - 25, 2017, on behalf of the Otter
Tail Family Services Collaborative.
Committee Information
Commissioner Rogness briefed the Board on the Great Plains Natural Gas Co. transmission line that is
scheduled to be moved. Commissioner Froemming reported on the new Lakeland Mental Health Center
building in Alexandria.
Relicensinq Process for Dams - Otter Tail River
Commissioner Rogness introduced Otter Tail Power Engineer Mike Olson and the topic of relicensing the
dams in the Otter Tail River chain. Mr. Olson provided a document titled “Relicensing process for
hydroelectric plants" and indicated that this is a five year process. He described each step in the process.
Otter Tail Power Company is interested in keeping low cost green energy for their customers. Concern
was expressed that the Department of Natural Resource’s fish ladders could impact the sites for electrical
generation. A public meeting may be appropriate to gather all pertinent information on the topic.
Memorandum of Understanding fMOUl - Community Health Worker
Motion by Rogness, second by Lindquist and unanimously carried to authorize the appropriate County
Officials’ signatures to execute a MOL) between Otter Tail County and the Minnesota Teamsters Public
and Law Enforcement Employee’s Union, Local No. 320 representing Human Services Support Specialists
and Public Health Staff. The MOU approves the addition of a position assignment titled “Community
Health Worker".
Closed to the Public
At 10:51 a.m.. Chair Huebsch declared the Board meeting closed to the public for purposes of discussing
labor negotiation strategies for all bargaining unions, either at the next negotiation session or on an interim
basis by way of a Memorandum of Understanding. Present were all five seated Commissioners, Human
Resources Director, County Attorney, County Administrator and Board Secretary. Chairman Huebsch
declared the Board of Commissioaers meeting open to the,public at 11:09 a.m.
Planning Commission Recommendations

In regards to the Biffert Conditional Use Permit Application, my parents and I are NOT in favor of it being granted. We
own property on the same beach to the East. When you are in a boat looking at his property, there is a two inch drain
pipe sticking horizontally out of the ground east of the house. I'm not sure if it is drain tile or a sump pump drain, but if
the property is covered in concrete, all the more water to run through that pipe into the lake. The mega bedroom shed
on the back lot takes up a ridiculous amount of property. Add to it a potential concrete driveway, where is the water to
go ??

My name is Lori Ishaug and my sisters and I have the back lot property next to Mr. Biffert. If the
concert slab if approved we have a concern that we would have standing water or flooding. Mr.
Biffert's driveway is sloped and has rock on the whole driveway. This summer when it rained
our property by the driveway always had standing water. We want to make sure if you approve
this it won't happen. This was a reason the variance was denied.
Is this allowable to have a permanent slab on the country's 40 feet of dedicated roadway?

Minutes of April 12. 2017: A motion by Wilson, second by Gabe to approve the April 12,
2017 Minutes as presented. Voting: All members in favor.
Kevin Biffert - Denied:
A Conditional Use Permit Application (as stated by the Applicant on the Application): Concrete an
area located in the right of way being 65 feet by 75 feet at the existing grade. Road and
parking area will be completed in two phases to allow passage of traffic during construction.

Good Afternoon,
We are writing in response to the request of the conditional use permit that Mr. Kevin Biffert has requested to pave/and
or concrete the road, and to add a concrete apron.
We understand the want, and need for the apron to his building. We are however concerned with the need for a water
mitigation plan, and for that to be in place before anything is done. His new building was built much higher than the
surrounding properties, and if he lays concrete at the current grade, we believe there is a great chance of run off to us,
and it will saturate our poperty.
