Minnesota I August After consideration and discussion, motion was made by John Everts, seconded by Cedi Femling and unanimously carried, to approve a variance of 2’ from the required side lot line setback of 10’ for a 12' by 24' addition to an existing garage located 8’ from the side lot line and 6’ from the septic tank. It was noted that the addition will be no closer to the lot line than the existing structure and that there is adequate area for the maintenance of the septic tank. It was also noted that the variance from required septic tank setback is granted because the proposed addition is an unoccupied building. Randy and Bonita Huckeby - Denied Mandy and Bonita Huckeby, Barnesville, MN, requested a variance of approximately 20’ from [the required ordinary high water level setback of 100’ for the placement of a 12’ by 14’ boathouse approximately 80’ from the ordinary high water level and approximately 30’ from the south side lot line. It should be noted that the proposed structure is approximately 60’ from a lagoon. The Department of Natural Resources will be determining if the lagoon is a part of Tamarack Lake. The property is described as Lot 1, Oak Haven Beach, Tamarack Lake in Scambler Township. The audience was polled with no one speaking for or against the request. A letter from Steven and Becky Freije supporting the variance request was read for the record. A letter from the Department of Natural Resources opposing the granting of a variance and indicating that the wetland area on the lot is not a part of the lake, therefore, setback distances should be measured from the main lake body and not from the wetland boundary was read for the record. After consideration and discussion, motion was made by Craig Anderson, seconded by John Everts and unanimously carried, to deny the variance as requested as no adequate . hardship had been shown and the applicant has a very large lot which should allow for the ^ placement of a structure without the granting of a variance. Steven Dean Torgerson - Denied Steven Dean Torgerson, Richville, MN, request a variance of approximately 53’ from the required ordinary high water level setback of 200’ for the construction of a 44’ by 68’ garage located approximately 147’ from the ordinary high water level. The property is described as Lot 4, Larsen’s Minisha-Da Subdivision, Dead Lake in Dead Lake Township. The audience was polled with no one speaking for or against the request. After consideration and discussion, motion was made by Randall Mann, seconded by Robert Schwartz and carried with George Walter voting no, to deny the variance as requested as no adequate hardship had been shown. Clarification - James B. Crouse - July 3,1997 Board of Adjustment Meeting. Clem Henrickson, Surveyor, appeared on behalf of James B. Crouse to request an amendment and/or clarification of the Board of Adjustment’s action of Thursday, July 3, 1997. Clem Henrickson explained that due to the slant/angle in the front and rear property lines a conveyance of 17.16’ instead of the approved 15.65’ is needed in order for the adjacent property owner to end up with a parcel having 100’ of width and water frontage. After consideration and discussion, motion was made by Craig Anderson, seconded by Randall Mann and unanimously carried, to approve changing the July 3, 1997 motion to reflect 17.16’ instead of the previously approved footage of 15.65’. It was noted that the change in the footage did not significantly change the original variance as requested or the intent of what was originally approved. The wetland area on the lot was separated from the lake by a grass ridge with a top elevation higher than the Ordinary High Water Level. Therefore setback distances should be measured from the main lake body and not from wetland boundary. The Department does not support the issuance of a variance because the applicant has proven no hardship. Although I feel badly for the Huckeby’s who have invested time and money in the cement slab, financial considerations alone do not constitute a hardship. Sincerely, Julie A.
