This is to confirm our telephone conversation of Thursday, June 12, 2003. I
am returning the Variance Application materials and your check #11120
($175.00). As I explained, in addition to showing the three existing properties you
also need to show the location of aU existing improvements (structures, septic
systems, etc.) on these lots.
I offer the following suggestions before you resubmit your Variance
Application:
According to the computer records Lot 25 is the only “improved” lot. Since
the copy of the plat map you provided is not in “scale” you should, provide a
scale drawing of the layout for Lot 25.

On the copy of the plat map you highlighted Lots 23, 24 8b 25 rather than
Lots 24, 25 8b 26. This could be misleading for. the Board of Adjustment
Members.
2.
Provide all three parcel numbers on the application as well as the complete
E-911 Address. You may wish to indicate which lot has the E-911 address.
3.
The variance request should be more specific. Provide a description of each
lot (total square footage and lot width at the lake) rather than the water
frontage for the t^ee lots combined. You should specify that you want to
sell these lots for residential use.

The computer records indicate that the other property owners are Arthur
and Esther Grimstad. If one or both of them are still living their name(s)
should appear on the application and at least one of their signatures would
be required.

I have enclosed an application form, another copy of the plat map (without
highHghts) andmore grid sheets. You only need to provide one set of original
documents plus six copies of any maps and scale drawings.

WARRANTY DEED
This Indenture effective the 1st day of September, 2004, from Grantor to Grantee:
Definitions. For the purpose of this Indenture:
"Grantor" shall collectively mean Michael Lee Stevens and Jennifer Rebecca Stevens,
husband and wife, whose mailing address is 3101 36th Avenue SW, Fargo, North
Dakota 58103.

"Grantee" shall collectively mean Kenneth W. Schwanke and Linda J. Schwanke,
whose mailing address is 2950 28th Avenue South, Fargo, North Dakota 58103, and
whose receipt of the Property shall be as joint tenants with the right of
survivorship and not as tenants in common.
"Indenture" shall mean this warranty deed between Grantor and Grantee.
"Property" shall mean the following described real estate, together with all
improvements, hereditaments and appurtenances, in the County of Otter Tail, in the
State of Minnesota:

Lots Twenty-four (24), Twenty-five (25) and Twenty-six (26), Block One
(1), Oak Haven Beach Second Addition, situated in Section Twenty-
three (23), Township One Hundred Thirty-seven (137), Range Forty-
three (43).
2. Consideration and Conveyance. For a valuable consideration, the receipt of which is hereby
acknowledged, Grantor hereby conveys and warrants the Property to Grantee, in Joint tenancy with the
right of survivorship and not in tenancy in common.

3. Warranty of Title. Grantor does covenant with Grantee that Grantor is well seized in fee of
the Property and has good right to sell and convey the Property in the manner and form set forth in this
Indenture.
Warranty of Encumbrances. Grantor does covenant with Grantee that the Property is free
from all encumbrances, except installments of special assessments or assessments for special
improvements which have not been certified to the County Treasurer for collection.
Warranty of Quiet Possession. Grantor does warrant, and will defend, the quiet and
peaceful possession of the Property by the Grantee against all persons lav\/fully claiming the whole or any
part of the Property.

Minnesota State Deed Tax. Minnesota State Deed Tax shall be due in the amount of Four
Hundred Ninety-five and 00/100 ($495.00) Dollars.
Benefit This Indenture shall benefit, and shall be binding upon, the parties and their
respective successors in interest.
