This motion failed with Cecil Femling, Randall Mann and Steve Schierer, voting no. After additional discussion and consideration, Randall Mann made a motion, second by Steve Schierer and unanimously carried, to approve the placement of a screen porch no closer to the ordinary high water level than the existing main structure as depicted on the applicants’ drawing. The structure is 616’ from the lake edge, 15’ from the western lot line and 15’ from the road right-of-way. The audience was polled with no one speaking for or against the variance as requested. After discussion and consideration, Paul Larson made a motion, second by Michael Harris and carried, with Randall Mann, Steve Schierer and Rick Wilson voting no, to deny the variance as requested. After additional consideration and discussion, Steve Schierer made a motion, second by Randall Mann and carried with Michael Harris voting no and with Cecil Femling and Paul Larson abstaining, to approve a variance of 5’ from the required road right- of-way setback of 20’ for the location of a 30’ by 60’ maintenance building 15’ from the road right-of- way, 15’ from the lot line and 616’ from the lake edge with the condition that written approval from Hobart Township must be obtained by the applicant. Those voting in support of the motion to approve the variance as requested noted the unique size and shape of the lot, the distance the structure is from the lake, the fact that the road is on the side of the structure and ingress and egress to the structure is not from the road side of the structure. Roger A and Marilyn L.Zellmann - Approved the requested variance as modified. (9:10 p.m.) Roger A and Marilyn L Zellmann, Lot 22 and part of Reserve Lot A, Hoffman’s Beach, West McDonald Lake in Dora Township, requested a variance of 3’ from the required road right-of-way setback of 20’, a variance of 65’ from the required ordinary high water level setback of 100’, and a variance of 15’ from the required shore impact zone setback of 50’ for the placement of a 28’ by 36’ dwelling 35’ from the ordinary high water level and 17’ from the road right-of-way. The proposed dwelling will be ahead of the string line and will be the second structure placed in the shore impact zone. The applicants noted that the proposed dwelling will be 38’ from the ordinary high water level instead of the 35’ as indicated in the application. The audience was polled with no one speaking for or against the variance as requested. After discussion and consideration, Steve Schierer made a motion, second by Rick Wilson and carried with Cecil Femiing voting no, to approve a variance of 3’ from the required road right-of-way setback of 20’ placement of a dwelling 17’ from the road right-of-way and no closer to the ordinary high water level than what would be permitted by the sightline.
