Mary Kuppich, Fargo, ND, requested a variance “for construction of a 4/12 sloped roof on existing one
story flat roof lake cabin. Home on East & West side are one-story houses. Any construction is above
8’ to 9’ - viewing site from next door.” The property is described as Lot 11, Oak Haven Beach, Tamarac
Lake in Scambler Township. It was noted the next day after the meeting that a letter from James E.
and Janice M. Venaas opposing the applicant’s request was placed in the file. The audience was
polled with no one speaking for or against the request. After consideration, motion was made by John
Everts, seconded by Cecil Femling and unanimously carried to approve a variance for the construction
of a 4/12-sloped roof on an existing one-story flat roof cabin. It=was noted that the footprint of the
original structure would not be increasing.
Lyman A. Trutna - Approved
Lyman A. Trutna, Battle Lake, MN, requested a'variance of 5’ from the required 18’ maximum height of
a non-dwelling structure for the placement of a 40’ by 80’ pole barn, with 14’ side walls, having an
overall height of 23’. The property is described as a 6.73 acre tract in Sub Lot 4 and Sub Lot 5 of
Government Lot 2, Section 14 of Clitherall Township by Clitherall Lake. The audience was polled with
William Gray speaking for the request. After consideration, rnotiomwas made by John Everts,
seconded by David Holmgren and unanimously carried, to approve a variance of 5’ from the required
18’ maximum height of a non-dwelling structure for the construction of a 40’ by 80’ pole barn having an
overall height of 23’. It was noted that the structure will be used for equipment storage and that the
proposed location will not restrict the view from the adjacent properties.
Elsie Griffith - Approved
Elsie Griffith, ColfaxfND, requested a variance of 7’ from the required lot line setback of 10’ for the
construction of an addition to an existing dwelling 3’ from the lot line. The property is described as Lot
24, Recreation Beach and part of Government Lot 4, Section 28 of Amor Township by Otter Tail Lake.
The audience was polled with no one speaking for or against the request. After consideration, motion
was made by Randall Mann, seconded by John Everts and unanimously carried, to approve a variance
of 5’ from the required lot line setback of 10’ for the construction of an addition to an existing dwelling 5’
from the lot line. It should be, noted that.the applicant’s proposed developmenLcannot exceed 25% of
the total lot area. Hardship is a substandard lot of record.
Mark and Dani Dahlstrom - Approved
Mark and Dani Dahlstrom, Oakes, ND; requested a variance of 4’ from the required lot line setback of
10’ for the addition of a screened porch to an existing cabin 6’ from the lot line. In the same line with
existing cabin. The property is described as the East 50’ of the South 249.5’ of Lot 1, Robinson’s
Addition, Clitherall Lake in Nidaros Township. The audience was polled with no one speaking for or
against the request. After consideration, motion was made by John Everts, seconded by Dave Trites
and unanimously carried, to approve a variance of 4’ from the required lot line setback of 10’ for the
addition of a screened porch to an existing cabin 6’ from the lot line. It was noted that the proposed
addition would be no closer to the ordinary high water level than the existing structure. Hardship is a
substandard lot of record. It was noted that the granting of this variance would not establish
precedence in this immediate area.

SUBJECT: Mary Kuppich Application for Variance, November 5, 1998 meeting
Gentlemen:
This is in response to a notification that I have received informing me of an “Application
for Variance” submitted for property in the name of deceased owner Mary Kuppich.
I own lot 10 which adjoins the subject property lot 11. lam unable to attend the
November 5 meeting in person, but in lieu of my personal appearance I am listing
hereafter the items that the “Board of Adjustment” should take into consideration when
reviewing this application:
I. Mary Kuppich passed away many years ago.
2. The address listed for Mary Kuppich, “1422-lOth Ave So, Fargo, ND 58103” is
incorrect and is no longer a family residence.
3. The construction on the subject property commenced without applying for a “Site
Permit Prior to Construction.”
4. After the “Department of Land &. Resource Management” inspected the property and
stopped the construction, a family member “back dated” (to 3-30-98) an Application for
Variance and then submitted same, which was received by Land Resource on October 2,
1998.
Question: Does “BACKDATING” an Application for Variance” forgive the
penalty and the “After the Fact Permit Fee” of at least $500?
5. There is a “Water Oriented Structure” (see enclosure) located 6 feet from the OHWL
(Should be 20 feet from OHWL & 65 feet from lotline). This structure was NOT shown
on the Application for Variance that was submitted.
6. This property has been ABANDONED and UNOCCUPIED for at least 8 years.
7. The sewer tank is only 8 feet (or less) from the property line. (Should be at least 10
feet)

8. The sewer tank is less than 35 feet from the lake. (Minimum distance standard is 75
feet).
9. The measurements as submitted to the Board of Adjustment (see enclosure) were
incorrect. (WHY?)

o m30 ro omm10. The slope of the roof and overhang are being changed. This requires that a building ^
(site) permit be obtained “prior” to construction.rri§ 1 ° O oo ».m11. Because this property has a “water oriented structure,” is it legal to extend an
overhang towards the lake, on the screen porch?
12. By putting a peaked roof on the screen house (porch), the roof on the screen house
will be in excess of the maximum allowable height of 10 feet.
As detailed in the foregoing listed items, there are numerous irregularities concerning
this property. The “Board” must ascertain that all improprieties have been corrected and
that items such as the sewage tank being relocated to a proper location and updated,
correct site measurements submitted to the Board and that the building height, water well
and the other regulated items are in full compliance with ordinance standards.
Please consider this letter at your November 5,1998 “Board of Adjustment” meeting. I
would appreciate receiving your response as to the decision of the Board regarding the
failure to obtain a building permit, and all of the inconsistencies regarding this parcel.
