Minnesota This letter is in response to your request for a variance from Minnesota Rules, Chapter 4725 to construct a water-supply well less than 50 feet from a sealed septic tank, 7 feet from a pressurized sewer line, and 11 feet from an untested buried gravity sewer line and to construct a portable deck over the subject well. Minnesota Rules, part 4725.4450 requires that a water-supply well must be located no less than 50 feet from a septic tank or a buried sewer line. Minnesota Rules, part 4725.4450 does allow a well to be located a minimum of 20 feet from a buried sewer line that is pressurized and serves one single-family residence or is a gravity sewer which is not a collector or municipal sewer, and that meets the materials and pressure testing specifications of Minnesota Rules, parts 4715.0530 and 4715.2820. Minnesota Rules, part 4725.2185 requires that a well must be located at least 3 feet horizontally from the farthest exterior projection of a building, including decks. Inspections of the subject site were conducted by Mr. Jeffrey Grugel of the Minnesota Department of Health (MDH) Fergus Falls district office on November 29, and December 4, 1995. During these inspections and based on the information provided, it was determined that an alternative well location between the house and the garage exists on this property that is farther from potential contamination sources. This alternative well location is approximately 16 feet from a pressure-tested pressurized sewer line, 18 feet from a sewage sump in the basement of the house, and 18 feet from an untested buried gravity sewer line located beneath the concrete basement floor of the house. On May 14, 1996,'diie to the inability of the existing well on this property to produce enough water to meet the Waite’s needs, a verbal approval w£is given to construct the subject well at the alternative well location, between the garage and the house. This verbal approval was conditional upon the locating and the successful pressure testing of the buried pressurized sewer line. Mr. Grugel has obtained documentation verifying the location of the pressurized buried sewer line, the materials used to construct this sewer line, and that this buried sewer line has passed a 5-psi-for-15-minutes air pressure test. > IW The subject well was constructed on May 20, 1996, by Traut Wells - Park Rapids at the alternative well location. Mr. Grugel was on site during the construction of the subject well and verified that the well was properly constructed using the cable tool method to a depth of 63 feet. During this inspection Mr. Grugel also noted that an unused cesspool exists approximately 23 feet from the newly constructed well. Information regarding this cesspool indicates that it was removed from service approximately 19 years ago and it appears to not contain contaminated soil at this time. Based on the inspections, information provided in the variance request and supplemental conversations, and in accordance with Minnesota Rules, Chapter 4725, a variance is granted to construct the subject well 18 feet from an untested gravity sewer line located beneath the basement floor of the house on this property, 18 feet from the sewage sump located in the basement of the house on this property, and 16 feet from a successfully pressure-tested pressurized sewer line constructed of approved materials located on the subject property. The variance is granted because there is no location on the subject property which satisfies all required isolation distances. The proposed well location, between the garage and the house and approximately 1 foot from the southeast property' line, appears to provide the greatest available separation between the well and known contamination sources. The additional construction requirements listed below should reduce the potential for contamination from the decreased separation allowed between the nonpressure-tested buried gravity sewer line, sewage sump, the buried pressurized sewer line, and the subject well. The variance is granted with the following conditions: 1. The well casing must extend to a depth of at least 50 feet or must penetrate at least 10 feet of impervious material (clay). 2. Any visually contaminated soil that may remain in the unused cesspool located less than 75 feet from the subject well must be removed and the space filled with clean fill. The existing well located on the property must be permanently sealed by a licensed well contractor in accordance with Minnesota Rules, Chapter 4725. 4. All other provisions of Minnesota Rules, Chapter 4725, shall be in effect. 5. You must contact Mr. Grugel at 218/739-7585 or Mr. Mark Malmanger at 218/723-4642 following the completion of the work specified in these conditions so that an MDH representative can verify that these conditions have been fulfilled. Alternative measures or conditions attached to a variance have the force of rule and effect of applicable rule. If a party violates the alternative measures or conditions attached to the variance, the party is subject to enforcement actions and penalties provided in the applicable law or rule. This variance is conditioned upon the applicable acceptance of and compliance with the conditions of the variance. Failure by the applicant to comply with the conditions prescribed in the variance will result in the immediate expiration of the variance. I have contacted you by telephone on December 15 and 16, 1995, in an attempt to explain what additional information this Department needs in order for us to continue to process your variance application. During those telephone conversations you indicated that you are unwilling to provide additional information regarding this site. This letter is intended to summarize the Minnesota Department of Health’s (MDH) position regarding an acceptable well location on this property and to identify the specific information you need to provide to the MDH to continue to process your variance application. I inspected the subject site on November 29, 1995 and on December 4, 1995 following a verbal request by Bruce Pulkrabek. The written variance application, which was received December 5, 1995, requested a variance to construct a well on this property 42 feet from your septic tank, 7-8 feet from a buried pressurized sewer line serving your home, 11 feet from a buried sewer line in your basement and placement of a removable deck over the proposed well. During the site inspections I noted, and explained to you, that an alternative location between the garage and the house appears to be a better location for the well based on the information provided to me. This alternative location provides the required 50 foot separation between the new well and the septic tank and also provides additional separation between the new well and the buried sewer lines located in your basement. In addition, this alternative location is not directly down gradient from the septic tank and sewage drainfield as the proposed well location appears to be. Since groundwater flow typically follows surface topography flowing from an area of higher elevation to areas of lower elevation, it is important to consider constructing wells at locations which are not directly between sewage systems and lakes. This especially holds true when there is a need to reduce the separation distance between a well and known sources of contamination. An Equal Opportunity Employer Robert J. On December 8, 1995, I informed you that you should attempt to contact a contractor with equipment small enough to access the alternative location. Please complete the following items in order for the MDH to continue to process your variance application: Verify in the presence of a representative of the MDH the exact location of the buried pressurized sewer line located on your property and provide evidence that this buried pressurized sewer line is capable of holding an internal air pressure of 5 pounds per square inch (PSI) for 15 minutes.
