Printers • Fergus Falls, MN • 1-800-346-4070RJT___n*;n*; MINUTES OF THE OTTER TAIL COUNTY BOARD OF COMMISSIONERS Government Services Center, Commissioners’ Room 500 Fir Avenue W., Fergus Falls, MN Tuesday, October 31, 2006 9:30 a.m. Call to Order The Otter Tail County Board of Commissioners convened Tuesday, October 31, 2006, at 9:30 a.m. at the Otter Tail County Government Services Center with Commissioners Roger Froemming, Chair; Dennis Mosher, Vice-Chair, Bob Block, and Syd Nelson present. Approval of Agenda Motion by Nelson, second by Mosher, and unanimously carried to approve the County Board agenda of October 31,2006, with the following additions: Land & Resource Director - Wetland Appeal & Final Plat Extension Request Cancel - Insurance Recommendation Approval of Minutes Motion by Mosher, second by Block, and unanimously carried to approve the County Board minutes of October 24, 2006, as mailed. Approval to Pay Bills Motion by Froemming, second by Nelson, and unanimously carried to approve payment of the County Board bills per Attachment A of these minutes. Conditional Use Permit - Tim Crompton Land & Resource Director, Bill Kalar, reported that the after-the-fact Conditional Use Permit application of Tim Crompton on Pelican Lake was tabled for further information and a site inspection. Upon consideration of the applicant’s revised proposal, Mr. Kalar stated the agreement as follows: lowering of the walls along with some reshaping between the walls and using deep rooted vegetation with the westerly wall remaining as constructed except for the last 15’ which would be lowered to match grade and then deep rooted vegetation would be planted. This work would not be completed this fall, but, rather next spring due to potential erosion concerns. Motion by Nelson, second by Mosher, and unanimously carried to deny the after-the-fact Conditional Use Permit as written and approve a Conditional Use Permit for the site restoration as outlined in the Engineering Report submitted to the Land & Resource Office and modified by the Land & Resource Director’s report. The property is described as R GL 3 Bg NW Cor Lot 12, Anderson Beach Addn N 26 Degrees W 35’ N 41 degrees E 72’ to lake SELY along LK 35’ SWLY 72’ to Bg remains one parcel #504 & #71- 005 not to be split; Scambler Township, Pelican Lake (56-786). Conditional Use Permit - Ethanol Plant Mr. Kalar stated that Ag Enterprises is requesting reinstatement of the Conditional Use Permit application now that the Environmental Assessment Worksheet has been completed. Mr. Kalar advised that the County has not analyzed the route of non-contact waste water that would flow to the South and into the Otter Tail River; however, this route may be in the City of Fergus Falls jurisdiction. Motion by Block, second by Mosher and unanimously carried to approve the Conditional Use Permit application for the Ethanol Plant as previously requested. Discussion followed regarding timelines. Commissioner Block and Mosher amended the OTC 5oard of Commissioners’ Minutes ; October 17, 2006 Page 7 Commission meeting, provides a method for finding facts to determine if an EAW should be prepared, 3) the County simply decides that an EAW must be completed in response to the petition. Mr. Kalar noted that these are the options in response to the petition and the issue of “may the project have the potential for environmental impact”. Applicant, Jim Morken, spoke regarding the notice issues and the October 11, 2006, Planning Commission meeting. Applicant, Dan Passoult, spoke regarding the current EAW, v\/hich was found to have no significant impact with a large project, and now, with a reduced project to roads and driveways only, he argued that an EAW is already completed. Commissioners directed the County Attorney and Land & Resource Director to return to the County Board in two weeks with information to determine if there is potential for significant environmental effects for the Conditional Use Permit request of Homeland Investment Co. #1. The property is described as Pt Lot 6 & of SE>4 SW% S of river, Section 17 and NE% NW% & E 10 rd of SE% NW% and EV2 NE% ex trs & SW% NE% & GL 1 ex trs. Section 20 of Dunn Township; Fish Lake (56-768). Conditional Use Permit - Tim Crompton: Mr. Kalar stated that the County Board tabled a request from Tim Crompton for a Conditional Use Permit for retaining walls on Pelican Lake. This request was heard by the Planning Commission on September 13, 2006, and the Planning Commission recommended denial for lack of engineering and questionable soil conditions. This was an after-the-fact request and was considered by the County Board on September 20, 2006, and the County Board tabled the request for additional information. Mr. Kalar stated that a letter has been received from an Engineering and Architectural Firm located in Fargo. The letter does not indicate that the walls will remain but did contain some soil data and a recommendation for reduction/modifications in the height of several walls with no additional earthmoving. Commissioners requested that the Land & Resource Director view the project again. Final Plat “The Point At Rivers Bend” Motion by Nelson, second by Lee, and unanimously carried to approve the Final Plat of Robert D. and Susan L. Mitchell known as The Point At Rivers Bend” in Section 6, Township 135N, Range 38W, Otto Township, Otter Tail River. Performance Evaluation Summary Motion by Block, second by Nelson, and unanimously carried to approve the positive Performance Evaluation Summary of Public Health Director, Diane Thorson, as presented, and to direct that the summary be placed in her personnel file. Highway Department Project Motion by Lee, second by Froemming, and unanimously carried to approve removal and replacement of cement steps at the Phelps Mill House by Stan Zierke Construction of Detroit Lakes, in the amount of $3,650.00. Reclassification Approval Motion by Mosher, second by Lee, and unanimously carried to approve a reclassification of the position of Employee Benefits/Safety Specialist in the Coordinator’s Office from a Grade 11 to a Grade 12, effective August 1,2006, as presented by the County Coordinator. Conditional Use Permit-Linden Park Resort/Jerrv & Linda Loofe & Bob LeSaae: Motion by Froemming, second by Block, and unanimously carried to deny a Conditional Use Permit request for a resort conversion, as recommended by the Planning Commission. Reasons for the denial are as listed in the Planning Commission minutes dated September 13, 2006. The property is described as Hursh’s 1®* Addn-Linden Park, Lots 6 & 7 BIk B & vac alley adj & Pt GL 1 & 2, Section 26 of Girard Township: East Battle Lake (56-138). Conditional Use Permit - Lake Five Resort/Fair Hills Inc: Motion by Nelson, second by Lee, and unanimously carried to approve a Conditional Use Permit for a dwelling replacement on the resort as presented. Conditional Use Permit - Larry Ahifs and Dwayne & Lisa Augustus: Motion by Froemming, second by Mosher, and unanimously carried to deny a Conditional Use Permit to build a storage and boat and motor repair facility as requested by the Applicant by letter dated August 29, 2006. Conditional Use Permit - Timothy T. Crompton: Motion by Lee, second by Block, to deny a Conditional Use Permit for this after-the-fact request for a retaining wall. Discussion followed regarding the process after a denial to fix the situation. Applicant, Timothy Crompton, stated that he has contacted an Engineering Firm in Fargo for their professional opinion on this project. He stated that he has some water issues with the property and a good size hill where the water runs onto the property. He requested time to work with the Land & Resource Office for a resolution. County Attorney, David Hauser, advised the Board that they may table the CUP request and look at additional information or deny the CUP request and the issue is left to enforcement action and resulting solutions/restoration. Commissioner Lee and Block withdrew their motion and second respectively. The applicant waived the 60-day requirement for a decision and Commissioner Lee offered a motion, seconded by Block, to table this after-the-fact Conditional Use Permit request for further engineering information. Gene Albers (East Battle Lake Watershed Association) indicated that they are opposed to the project, and expressed concerns regarding too much pressure on the lake, too many people and boats, the sewer system, and he requested an environmental impact statement be completed. Jim Thompson expressed concerns regarding the impact on the lake (number of boats) and the impact on the adjacent property (a deeded access to the lake). Gerald Haberer (adjacent neighbor) indicated that this proposal would be an improvement. Keith Rafos stated that while he was not opposed to change, he had concerns regarding traffic, surface water drainage and vegetative screening. Robert Dungray expressed concerns regarding modifying the plan and retaining two of the existing trailers. Don Jurs had questions regarding surface water drainage, and the existing terrain.
