April 5, 2012 Meeting - The audience was polled with no one speaking for or against the variance as requested. After discussion and
consideration, Randall Mann, with the verbal agreement of the applicants made a motion, second by Thomas Lee and unanimously carried, to
table the applicants’ request until the next scheduled meeting of the Board of Adjustment to provide the applicants with an opportunity to
consider other possible alternatives that would substantially reduce the amount of impervious surface coverage on the applicants’ property.
May 3, 2012 meeting - After discussion and consideration, Steve Schierer made a motion, seconded by Thomas Lee and unanimously carried,
to approve a variance of 8’ from the required 20’ road right-of-way setback and a 2’ variance from the required 10’ septic tank setback for the
placement of a 20’ by 20’ car closed vehicle shelter 12’ from the road right-of-way and 8’ from the septic tank with the condition that no more
than 30.5% of the total eligible lot area can be covered with impervious surfaces. It was noted that the granting of the variance as requested will
provide the applicants with a reasonable use of their property and will provide the applicants with an opportunity to enjoy the same rights and
privileges as others in this immediate area as there are many properties in this immediate area which have impervious surface coverage in
excess of 25% and structures that are closer to the road right-of-way than the required 20’ setback. The applicants must have the impervious
surface coverage reduced to 30.5% on or before September 1,2012. It was noted that the applicants have a difficult lot and they are doing the
best they can with the lot.

The audience was polled with no one speaking for or against the variance as requested. After consideration and
discussion, Steve Schierer made a motion, seconded by Michael Harris and unanimously carried, to approve the
variance as stated in the application and as depicted on the drawing submitted with the application and dated as of
April 6, 2012.
Steven and JoAnne Knutson Lynk - Approved the requested variance as modified. (6:50 p.m.)
Steven and JoAnne Knutson Lynk, Lots 38 and 39 Lindenwood, East Leaf Lake in Leaf Lake Township, requested a
variance of 40’ from the required ordinary high water level setback of 100’ for the construction/placement of a 6’ by 8’
storage structure 60’ from the ordinary high water level. The audience was polled with no one speaking for or against
the variance as requested. After consideration and discussion, Randall Mann made a motion, seconded by Michael
Harris to deny the variance as requested as the applicants can obtain a reasonable use of their property without the
granting of the variance as requested, the granting of the variance as requested would establish precedence and
there are other locations available for the placement of the proposed structure that would not require a variance. The
motion to deny failed with Marion Gill, Thomas Lee and Steve Schierer voting no. After additional discussion and
consideration, Steve Schierer made a motion, seconded by Thomas Lee and carried with Randall Mann voting no, to
approve placement of the proposed 6’ by 8’ storage structure immediately next to the steps in front of the retaining
wall as noted on the drawing dated April 10, 2012. The proposed structure can be placed on either side of the steps,
but must be placed immediately adjacent to the steps. The variance as approved will place the proposed structure as
close to the center of the lot as reasonably possible. The placement of the proposed structure in this location will
allow the applicants to enjoy the same rights and privileges as others in this immediate area, will not obstruct the view
from the adjacent properties and is no closer to the ordinary high water level than the neighbor’s deck.

Henry and Mary Ditterich, Lot 6 Block 2 Woodland Acres, East Loon Lake in Candor Township, requested the
following: Proposing to have Lot 6 Block 2 of Woodland Acres be declared buildable for single family residential use.
The lot was created September 23, 1980. The lot does not meet the size requirements for a back lot on a recreational
development lake. The lot only has 78,664.45 square feet and is required to have 80,000 square feet with 300' of lot
width. Jason the applicants' contractor appeared with the applicants at the public hearing. The audience was polled
with no one speaking for or against the variance as requested. After consideration and discussion, Steve Schierer
made a motion, seconded by Paul Larson and unanimously carried, to declare Lot 6 Block 2 Woodland Acres
buildable for single family residential use. The variance as granted is consistent with past actions of the Board of
Adjustment.

William E. Martinson - Tabled (7:23 p.m.)
William E. Martinson, Lot 11 Tonseth Heights, Tonseth Lake in Friberg Township, requested the following: We are
requesting a variance to do an expansion of the existing cabin which will include: a second story, a new roof, two
additions, and a deck. Cabin is approximately 42’ from the ordinary high water level and eight feet from the lot line.
The 12’ by 18’ existing portion will get a six foot extension and a new roof. The second expansion is a 28’ by 32’ 2-
story addition attached to the 12’ by 18’ existing structure. The proposed project will not be any closer to the lake than
the existing structure. We are also requesting a new garage located as follows: minimum required 20 foot setback
from road right-of way and about 120 feet from ordinary high water level. April 5, 2012 meeting - The audience was
polled with no one speaking for or against the variance as requested. An email from Linda Bowhall expressing
concern with the variance as requested was read for the record. After discussion and consideration, Steve Schierer,
with the verbal agreement of the applicants made a motion, seconded by Michael Harris and unanimously carried, to
table the applicants’ request until the next scheduled meeting of the Board of Adjustment to provide the applicant with
an opportunity to consider other possible alternatives that would substantially reduce the variance requested. May 3,
2012 meeting - The office received a letter from Mr. Martinson prior to the meeting requesting the tabling of his
application until a future meeting date. After consideration and discussion, Steve Schierer made a motion, seconded
by Thomas Lee and unanimously carried, to table, as requested by the applicant, the variance hearing until the next
scheduled meeting of the Board of Adjustment.

Judy L. Steffes - Approved the requested variance as modified. (7:31 p.m.)
Judy L. Steffes, Lot 2 Morningside Beach, Pelican Lake in Dunn Township, requested the following: Requesting
variances as follows to add an attached garage and utility area.
1. Variance of 9’ to place addition T from lot line. Existing developments in this area do not meet setbacks due to
property line misidentification in the past.
2A. Impervious surface variance of 13% to allow 38% coverage. Existing coverage is at 41.2%. Removal of existing
coverage will reduce coverage by over 3%.
2B. Or apply to vacate old road and add 1200 square feet of lot size to property. Impervious surface coverage would
then be reduced to 34%, requiring a 9% variance to impervious surface coverage.
The audience was polled with no one speaking for or against the variance as requested. After consideration and
discussion, Paul Larson made a motion, seconded by Marion Gill and carried with Michael Harris voting no, to
approve a variance of 5’ from the required side lot line setback of 10’ for the placement of the proposed development
5’ from the east side lot line at it closest point and to allow the applicant to include the non-vacated road area when
making the impervious surface coverage calculation, which means that no more than 34% of the total modified eligible
lot area can be covered with impervious surfaces after completion of the proposed development. The applicant’s
proposed development will reduced the overall impervious surface coverage from 41.2% to 34%. It was noted that it
is only practical to allow the applicant to use the non-vacated portion of the road when making the impervious surface
calculation as all existing impervious materials will be removed from this area.

Laura Peterson - Denied (6:57 p.m.)
Laura Peterson Et Al, Lot 2 Block 2 First Addition to Engstrom Beach, Big McDonald Lake in Edna Township,
requested the following: 8’ by 12’ shed to sit on exact corner as old 8’ by 8’ pre-existing deteriorating shed. Any
added dimension extends to inside of lot owners property. Not pushing towards line in either direction. Proposed 10’
variance for shed to set 10’ from road right-of-way and 4' variance for shed to sit 6’ from lot line. Appearing at the
public hearing was Colleen, daughter of Laura Peterson, Margaret Rhoades (property owner) and Sharon Schoon
(property owner). The audience was polled with no one speaking for or against the variance as requested. After
discussion and consideration, Michael Harris made a motion, second by Steve Schierer and unanimously carried, to
deny the application for variance as requested as no adequate hardship/practical difficulty unique to the property had
been shown that would allow for the granting of the variance as requested and it was the general consensus of the
Board of Adjustment that there is adequate area on the property to comply with the setback requirements of the
ordinance and a reasonable use of the property can be obtained without the granting of the variance as requested.
M. Faye Engkjer - Approved as requested with conditions. (7:15 p.m.)
M. Faye Engkjer, part of the Southwest Quarter of the Northwest Quarter, the Northwest Quarter of the Southwest
Quarter and Government Lots 5 and 6, Section 4 of Dunn Township by Pelican Lake, requested the following:
Parcels 17000040063000 and 17000040063002 are in the same ownership. Parcel 17000040063002 is considered
substandard and the Shoreland Management Ordinance considers them attached as one parcel. I am requesting to
allow each parcel to be considered buildable for residential purpose. There is a building over the line. The common
lot line will be adjusted to maintain a 10 foot setback. I intend on selling the 6.5 acre parcel. I would like to build a
cold storage building on the other parcel. Dave Anderson, Surveyor appeared with the applicant at the public hearing.
The audience was polled with no one speaking for or against the variance as requested. After discussion and
consideration, Steve Schierer made a motion, second by Thomas Lee and unanimously carried, to approve the
proposed subdivision as depicted on the drawing submitted with the variance application dated February 9, 2012 with
the following conditions: 1) a registered surveyor’s drawing must be provided at the time of conveyance, 2) the 1.4
acres parcel (17000040063002) must be permanently attached to the lake front property, which is currently
represented by Parcel Numbers 17000040062002 and 17000990856000, 3) the area within the 1.4 acre parcel
cannot be used when determining/calculating impervious surface coverage for future front lot development and 4) only
non-residential use structures, such as the proposed cold storage building, can be placed on the 1.4 acre parcel since
this parcel is being permanently attached to the lake front property and a residential home is already located on the
lake front property. It was noted that the 6.5 acre parcel meets and or exceeds all of the minimum size requirements
of both the Shoreland Management Ordinance and the Subdivision Controls Ordinance; therefore, it is considered
buildable for residential purposes.
Kevin Cochran - Withdrawn
Kevin Cochran, Lot 7 Hawes Addition, Buchanan Lake in Otter Tail Township, requested the following: Add 24’ by 30’
attached garage to south side of existing house (connection point 79’ from lake). Add 5' to back and side walls
(Southeast) of existing house (connection point 70’ from lake). Extend deck on lake side 30’ by 7’ 6” to the west
(closet point being 38>2’). Existing roof will be removed and pitch changed from 6 to 2 pitch matching all roofs. Roof
peak will be approximately 4’ lower than it is now. Qriginal setback is 75’, new setback be will be 38/4’, request is
3614'. Prior to the scheduled hearing, the office had received both an email and a letter advising the County that the
application for variance was being withdrawn; therefore, the audience was not polled and no action on this request
was taken by the Board of Adjustment.
