Lange, part of Government Lots 2 and 3, Section 33 of Tumuli Township by South Ten Mile Lake, requested a variance of 50' from the required ordinary high water level setback of 100' for the placement of a new dwelling 50’ from the ordinary high water level. The existing cabin is located 38’ from the ordinary high water level. The proposed structure would be 38’ wide and would be setback 50’ from the ordinary high water level and 30’ from the road. The property is 118’ deep and contains 24,780 square feet of area. The applicant noted that the depth of the lot is 125’. The audience was polled with Larry Goetzinger speaking for the variance as requested. After discussion and consideration, Steve Schierer made a motion to deny the variance as requested. The motion died for lack of a second. After additional discussion, Les Estes made a motion, second by Michael Harris, to approve the variance as requested. This motion failed with Randall Mann, Steve Schierer and Carl Zick voting no. After additional discussion and consideration, motion was made by Steve Schierer, second by Paul Larson and carried with Michael Harris voting no, to approve a variance of 50’ from the required ordinary high water level setback of 100’ for the placement of a new dwelling 50’ from the ordinary high water level with the understanding that the Board’s approval is based on the applicant voluntarily agreeing to remove the top portion of the existing boathouse. Meeting the existing setback would obstruct our lake view due to the existing structures on the adjacent properties. At the time this deck was constructed, this property was owned by me. In August of 2007, the property was sold to David and Joyce Ramage. Prior to the building of the deck, I contacted the Department of Land and Resource Management in Otter Tail County to discuss my situation. I was informed that I should apply for a site permit for the deck. On January 23, 2007,1 filed an application for site permit and described the project and the location of the deck. The permit was granted and in April of 2007, Premium Deck Builders commenced building stairs and a deck. Originally the intent was to move the existing stairs to the East, but upon further review of the situation, it was decided to keep the location of the steps where presently located. Prior to the building of the deck I met with the builder and we reviewed the site permit and walked the bluff. The existing stairs were in a state of disrepair and were in need of replacement. As part of the process in building the deck, the stair system was replaced. We attempted to place the deck in a part of the bluff where the grade was less severe and to place the deck in an area where it was not visible to either the neighbor to the East or the neighbor to the West. It should be noted that there is approximately 30 feet of dense vegetation which separates my lot from the lot to the East. The deck, in its present location, is not visible from my neighbors’ lots. During the process of building the stairs and the deck, the builder made some adjustments to the placement of the deck, which included the direction the deck faced. The reason for the changes was to take into consideration the terrain and for ease of construction. The lot is approximately 140 feet wide at the shoreline and tapers back to 25 feet wide at the back of the lot, which is approximately 450 feet from the lake. Because of the vegetation on the East side of the deck and also the incline of the bluff, it was somewhat difficult to measure from the lot line, but appeared that even with the changes the deck was still 40 feet from the lot line. I have had numerous discussions with Eric Babolian from your office regarding the lot line and he has measured the deck as 33 to 34 feet from the lot line. I respectfully request that a variance be approved for this deck. Unfortunately, after the construction started and with the changes which took place regarding the placement of the deck, it appears that the 40 foot setback requirement has not been met. It should be noted that approximately 30 feet of dense vegetation separates the lot from the lot to the East so that during the summer the deck is not visible from my neighbor’s lot. In addition, in conjunction with the building of the steps and deck, I planted shrubs bordering the steps and next to the deck to prevent any erosion. At the time the deck was constructed I thought we had met the setback requirement. Thank you for your consideration of this matter.
