Application for removal of taper between house and neighbor on west and garage and neighbor on east. Taper removed by
Construction of 1 foot 8 inch retaining wall beginning near road and continuing lakeward on each side of the property for a
distance of approximately65 to 70 feet. A narrow taper of approximately 5 feet running from east to west beginning in
front of the house sidewalk and continuing post the septic tank in front of the garage would return the front portion of the
lot to it's original elevation. Fifty to sixty yards of fill will need to be removed for this project.

the Board regarding a culvert in County Ditch No. 37. This culvert on Elks Lake Road in
Dane Prairie Township was repaired at one time, is a deep system, and has a 36” culvert in
place. Kevin Brennan, of the U.S. Fish & Wildlife Service, stated that the Fish & Wildlife
Service recommends a 72” culvert be placed in the ditch, for safety reasons, at this time, as
other repair work is also needed. Motion by Mosher, second by Nelson, and unanimously
carried to approve that a 72” culvert on Elks Lake Road, Ditch 37, be installed for safety
reasons, and encourage the partnership between the U.S. Fish & Wildlife Service and Dane
Prairie Township with this repair project.
Friends of Phelps Mill Donation
The “Friends of Phelps Mill” donated a picture of the Mill which is hanging outside of the
Phelps Mill conference room at the Government Services Center. Commissioners and
members of Friends of Phelps Mill had a picture taken to recognize the donation.
Shoreland Rules Revision Internal Committee Update
Land & Resource Director, Bill Kalar, reported on the Shoreland Rules Revision Internal
Committee Meeting of July 28, 2005. Areas of discussion included; 1) reducing impervious
surface coverage, 2) consider existing resorts differently than clusters, 3) revise Cluster/PUD
Density Calculation, 4) increase water frontage requirements, 5) require density calculation to
be based on continuous land, 5) clarify open space use, 6) no change to current multipliers,
and, 7) no change to Tier System other than changing the language so if a portion of a
project is located in a Shoreland Area and a portion outside of the Shoreland Area, the Non-
Shoreland Area will be considered as if it is all within the SMO area.
Conditional Use Permit Extension
Motion by Lee, second by Mosher, and unanimously carried to extend Conditional Use Permit
#6159, to October 15, 2005, for Jay Samuelson, Pelican Lake, for an earthmoving project.

Reconvene - Closed to the Public
At 11:12 a.m., Chairman Block declared the meeting of the Otter Tail County Board of
Commissioner recessed for a Personnel Committee Meeting. At 11:28 a.m.. Chairman Block
declared the meeting of the Otter Tail County Board of Commissioners closed to the public
for the purpose of evaluating the performance of MIS Director, Tim Brand, pursuant to
M.S. Chapter 13D.05 Subd. 3. All five seated commissioners were present for the
evaluation. A summary of performance conclusions will be provided at the next regular
County Board meeting.
Recess & Reconvene
At 11:55 a.m.. Chairman Block recessed the County Board meeting for lunch break. At
1:15 p.m., Vice-Chairman Froemming reconvened the Board of Commissioners meeting with
Commissioners Froemming, Mosher, Nelson, and Lee present.
City Watch Program
Emergency Services Director, Tiny Holm, explained that City Watch is a company functioning
similar to a Reverse 911 company, which deals with communications to the public. He stated
that the County has obtained a $31,000.00 grant to install an eight (8) port system, which
includes three (3) years of maintenance cost. Chief Deputy, Stacy Paulseth, stated that this
is a computer telephone-based program designed to notify large numbers of people in a short

Dear Mr, Kalar,
I am writing in regard to my permit to install retaining walls on my
property and improve a lake drainage, which crosses my property on Pelican
Lake, Summer Haven Beach. The permit for this work expires on September
1, 2005 and I would like to do work during the last week of September or
the first week in October.
In order to install walls I may make a mess on my neighbor's property.
I hove assured them I will clean up and restore any grass ruined by means of
sod. This is a suitable arrangement with my neighbors however, they would
prefer I do this work after mid-September when they are not using their
cabins.
Also, the drain, which crosses my property, has a culvert running
beneath Summer Haven Road. This culvert should be lowered 12-16"which
would make the road impassable for a couple of hours. While that is a short
period of time, it would be more suitable in late September when the road is
seldom used.

If you could grant me a 6- week extension on my permit, I believe the
interest of everyone involved would be better served, I do not expect this
entire project to take more than 4-5 days.

Motion by Lee, second by Block, and unanimously carried to approve a Conditional Use
Permit to remove taper by construction of retaining walls with a condition as recommended

Preliminary Plat - “Tomlinson OaksVDon Tomlinson:
Motion by Nelson, second by Block, and unanimously carried to approve the Preliminary Plat
of Don Tomlinson known as “Tomlinson Oaks” consisting of three (3) non-residential backlots
with a condition as recommended by the Planning Commission. The property is described as
Ptof GL 1...(5.1 AC), Section 31 of Corliss Township; Little Pine Lake (56-142).
Conditional Use Permit - Shady Grove ResortAA/es & Theresa Jeltema:
Motion by Nelson, second by Lee, and unanimously carried to approve a Conditional Use
Permit for a five-year plan to remodel resort with a condition as recommended by the
Planning Commission. The property is described as Lots 3 & 4 of Snodgrass’s Basswood
Grove and Lot 1, Section 26 of Rush Lake Township; Rush Lake (56-141).
Final Plat
Motion by Lee, second by Block, and unanimously carried to approve the Final Plat of Bothan
Properties LLC known as “Get-A-Way Bay Estates on Norway Lake” located in Section 25 of
Aurdal Township on Norway Lake (56-569).
Request for Extension of Conditional Use Permit
Motion by Lee, second by Block, and unanimously carried to deny the request of Phillip M.
Douglas to extend Conditional Use Permit #6141 for construction of a road, because the
condition to review the need for culverts with the Land & Resource office has not been met.

(Resolution) that has been reached by the Townboard and the developer are followed. 2.
The reconstruction of Road #273 is completed by September 1, 2005. 3. The outlets are
renamed to conform with the Lot//Block nomenclature. 4. The proposed driveway may be
constructed this fall provided it is completed by November 1, 2004. Voting: All Members in
favor.

Chad Tabutt had questions and concerns regarding the amount of fill, the potential for
erosion & the elevation being higher than the road. Lucy Tabutt expressed concerns
regarding the erosion and run-off. Nancy Stromen expressed concerns regarding the
erosion.

Helen Friend expressed concerns regarding the roadway and the possibility of a cluster
development. Howard Otteson indicated he has concerns regarding the possibility of a
cluster development and additional development. Margaret Otteson had questions
regarding the proposed use of the lots. Rod Smith expressed concerns with the addition of
backlot storage buildings in the area. Jerry Klein expressed concerns with the request for
residential lots (the onsite sign says storage).
Applicant Withdrew The Request: The Applicant withdrew his request.
