Motion was made by Cecil Femling, second by Steve Schierer and unanimously carried, to approve a 10’ road right-of way setback, instead of the required 20’ setback, from a road which has never been constructed and exist only on a plat created in 1912. Hardship is a substandard lot of record. The granting of the variance will allow the applicants the ability to enjoy the same rights and privileges as other in the immediate area who are either closer or perhaps even in the dedicated road area. Hardship is a substandard lot of record and the terrain features of the applicant’s property. Marilyn R. Froelich and James C. Beckstrom - Approved as requested. Marilyn R. Froelich and James C. Beckstrom, Fargo, ND, requested a variance to “authorize the usual 10 foot side setback on the northeasterly lot line, instead of requiring a 20 foot side setback where the street exists only on the plat created in 1912 and has never been constructed.” The property is described as Lots 1 and 15, Block 2, the northeasterly Vz of Lot 2, Block 2, and the northeasterly Vz of Lot 14, Block 2, Pelican Beach, Big Pelican Lake in Scambler Township. The audience was polled with no one speaking for or against the request. After discussion and consideration, motion was made by Cecil Femling, second by Steve Schierer and unanimously carried, to approve a 10’ road right-of-way setback, instead of the required 20’ setback, from a road which has never been constructed and exist only on a plat created in 1912. Jack and Diane Strickland, Frazee, MN, requested a variance of 10’ from the required side lot line setback of 10’ for the placement of pole barn 0’ from the property line. The property is described as part of Government Lot 6, Section 26 of Maplewood Township by Bracket Lake. The audience was polled with no one speaking for or against the request. After discussion and consideration, motion was made by Randall Mann, second by Rod Boyer and unanimously carried, to deny the variance as requested as no adequate hardship unique to the property had been shown that would permit the granting of the variance as requested. It was noted that this is a larger parcel, which should offer other sites that can meet the required 10’ side lot line setback. It was also noted that the Board of Adjustment would not have approved the requested variance even if it had been requested before the structure was constructed. After additional discussion and consideration, motion was made by Randall Mann, second by David Holmgren and unanimously carried, to grant the applicants until June 1, 2002 for either the removal or placement of the structure in a location which complies with the setback requirements of the ordinance. Royces Resort - Approved with condition. Royces Resort, Richard and Priscilla Stegman, Frazee, MN, requested a variance of 12’ from the required side lot line setback of 50’ for the placement of an attached garage 38’ from the side lot line. It should be noted that an existing boathouse located 8’ from the lot line would be removed. The property is described as Lots 1, 2, and 3, Birch Dale Resort, Wymer Lake in Hobart Township. The audience was polled with no one speaking for or against the request. After discussion and consideration, motion was made by Steve Schierer, second by Cecil Femling and unanimously carried, to approve a variance of 12’ from the required side lot line setback of 50’ for the placement of an attached garage 38’ from the side lot line with the condition that an existing 12’ by 32’ structure must be removed by September 1, 2002. It was noted that the granting of this variance in exchange for the removal of the12’ by 32’ structure located 8’ from the lot line is a good improvement. Hardship is the terrain of the applicant’s property.
