MN 56537 To Whom It May Concern; I will not be able to attend the hearing on the variance to the Shoreland Management Ordinance requested by Gerald Hall on Steptember 1, 1988. Nevertheless, I want to enter a statement for the record regarding the matter. My family has owned the cottage next to the Hall's (Lot 2 Block 2 Oak Grove Summer Resort) for over 80 years. I have spent every summer there since birth, some 59 years. I can testify that the new screen porch which the Halls have built does indeed replace, in part, an existing structure. Originally their cottage had a screen porch the full length of the cottage on the east side and across the entire width in front. The side portion of this porch has been closed in and made a permanent part of the house. The front porch was removed, and part of it has now been replaced by the new structure. It is the same distance from the water's edge as the old structure but does not extend the full width of the cottage. We have photographs of the original front porch, if the board should wish to see them. In addition, my wife and I wish to go on record as approving of the structure the Halls have built and urge the board to grant them their variance. Donald R. Keyworth Professor Of Philosophy cc: Gerald Hall PO Box 2781 Fargo. ND 58108 1 1 September 1, 1988- 2 -Board of Adjustment Lavern A. & Barbara J. Johnson, Bismarck, ND, requested permission to rebuild and enlarge 45 year old boathouse, in present location on Lot 31, Provan Beach, Dunn Township on Pelican Lake, motion was made by Craig Anderson, seconded by Carl Johnson, to approve, but motion was withdrawn prior to vote. Motion was then made by John Everts to deny. The motion died for lack of a second. After futher consideration, motion was made by JOhn Everts to deny, no adequate hard ship shown. The motion was seconded by Craig Anderson and carried. June Bergeson, Pelican Rapids, MN, requests permission to place garage with a O' setback from an unused portion of road right-of-way, on Lot 2, Block 1, Pikes Beach, Tamarack Lake in Scambler Township. After consider ation, motion was made by Carl Johnson to approve, hardship being the terrain, and on the basis that that portion of the road right-of-way will perhaps never be used because it is 80' x 150' in spots, and that section makes better access than any other spot. The motion was seconded by Craig Anderson and carried unanimously. Virgil G. Martinson, Underwood, MN, requested permission to construct a 24' X 26' car garage 3' from the side lot line at the southeast corner of the structure on Lot 7, Block 1 of Lakeside Rolling Woodlands on South Turtle Lake in Sverdrup Township. was made by George Walter to approve no closer to property line than 7' at one end of the garage, 10' at other end, hardship being terrain. The motion was seconded by Craig Anderson and carried unanimously. LAVERN JOHNSON DENIED After consideration JUNE BERGESON APPROVED VIRGIL MARTINSON LIMITED APPROVAL After consideration, motion Walter Joseph Grigas, Battle Lake, MN, requested permission to build a storage shed and well enclosure on lot line, on E^s of Lot 6 of Segar Beach, on Otter Tail Lake in Everts Township. After consideration, motion was made by John Everts to grant a 7' variance on an 8' x 10' structure, hardship being able to enjoy the same rights and privileges as others in the area enjoy. The motion was secondSd by Craig Anderson and carried unanimously. Donald W. Pick, Fergus Falls, MN, requested permission to retain an 8' X 12' storage building 2h feet from lot line, on Lots 110, 111, 112 Sater Humphrey Ranch Camp, on Ten Mile Lake in Tumuli Township. After consideration, motion was made by John Everts to deny, no adequate hard ship shown; even though there are pre-ordinance sheds in violation, there is sufficient room to place the storage shed and be in compliance. The motion was seconded by Craig Anderson and carried unanimously. WALTER GRIGAS APPROVED DONALD W. PICK DENIED EDWARD HILBER TABLED Edward Hilber, Pelican Rapids, MN, requested permission to construct a privacy fence on his property in G.L. 3, Section 29, Lida Township on Lake Lida. Appearing and speaking were Mrs. Jack Hilber, Bill Steinhoff, and Ron Barton. AFter listening to the various interested parties, motion was made by Craig Anderson, seconded by John Everts and unanimously carried, to table for further information. Gerald Hall, Fargo, ND, requested permission to replace existing struc ture with new roof and screened sidewalls, on Lot 3, Block 2, Oak Grove Summer Resort, on Pelican Lake in Scambler Township, listening to the various interested parties, motion was made by Craig Anderson to grant the request, based on unsolicited testimony from a 59 year resident, testifying a screened porch, with roof was previously attached to said residence. The motion was seconded by Carl Johnson and carried with George Walter voting "no". t ^ GERALD HALL APPROVED I After ROGER BERGRLN DLNILD Roger Bergren, Pelican Rapids, UN, requested permission to construct a boathouse into the bank, one foot above highwater mark, on property in G.L. 8, Section 31, Dunn Township, on Lake Lizzie. AFter consider ation, motion was made by John Everts to deny, no adequate hardship shown; to allow would establish a precedence in a relatively new devel opment. The motion was seconded by Craig Anderson and carried unani mously.
