Allan Anderson November 12, 1991 ‘J t Mr. Robert Poolman R.R. 4, Box 273 Pelican Rapids, MN 56572 RE; Variance and Building Permit Dear Mr. Poolman: As we discussed in my office, I am writing to inform you that we could find no authority that would require Otter Tail County to withhold your building permit pending any appeal of the Board of Adjustment's decision to grant you a five foot variance from the right-of-way setback. At this time, you must remain 15 feet from the alley right- of-way and 10 feet from the side lot line. However, you face two uncertainties. If the variance is vacated on appeal, you will again be required to be 20 feet from the alley. When the disputed side lot line is determined by the Court, your garage will have to be 10 feet away. If you construct your garage now, you face the risk of having to move it in the future to comply with changing circumstances. Another concern I should alert you to is that, if your neighbor does file an appeal, she may also seek an injunction or stay of the variance, which will prevent you from constructing the garage until the Court has decided the appeal. You will probably hear about that after you start construction. If she seeks such an injunction, it would probably be to prevent the County from issuing a building permit, since the County is the proper party in the appeal. As I told you, our office will represent Otter Tail County and the Board of Adjustment. You will not have to have your own attorney to defend the variance on appeal.
