September 2nd. 1993. with the following persons In attendance: Craig Anderson John Everts Cecil Femling Dan Oehler Berton Olson George Walter T1m Griep. Land and Resource Management Kyle Westergard. Land and Resource Management Wally Senyk. County Attorney CALL TO ORDER - The meeting was called to order at 7:00 p.m, by Chairman George Walter, MINUTES APPROVED-AuQust 5th, 1993 Hearing no corrections or additions the minutes of the August 5th, 1993 meeting were declared approved as mailed. The following variance requests were heard: Thomas and Mary Lawler - Approved Thomas and Mary Lawler, Vining, MN, requested a variance to construct a 26' by 40' addition to an existing structure In the bluff Impact zone. The applicant needs to excavate approximately 140 cubic yards of material In the bluff Impact zone. The property Is described as part of Government Lot 5 , Section 3 of Nidaros Township on Stuart Lake, The audience v/as polled with no one speaking for or against the request. After consideration, motion was made by Craig Anderson, seconded by John Everts and unanimously carried, to approve a variance to construct a 26' by 40' addition to an existing structure 1n the bluff Impact zone. It should be noted that the structure Is In the toe of the bluff. The structure will not be located 1n the restricted zone of the lake. The applicant has agreed to remove a 16' by 20' structure and two outhouses. The applicant has Indicated that the excavation required will be approximately 105 cubic yards of material. Hardship being the terrain of the applicant's property. Donald Albert Bistodeau - Denied Donald Albert Bistodeau, Henning, MN, requested a variance from the required 50’ side lot line setback for cluster developments for the location of a 14' by 52' mobile home, an 8' by 8' shed, a 10' by 32' park model with an 8’ by 8' addition, and an 8' by 6’ shed. The property Is described as part of Government Lot 1, Section 25 of Girard Township on East Battle Lake, The audience was polled with David Bode speaking against the granting of this variance request. After consideration, motion was made by John Everts, seconded by Cecil Femling and unanimously carried, to deny the applicant's request and require that the applicant comply with the 10' side lot line setback requirement that was in force when the units were originally placed on the property. The applicant must have the situation brought Into compliance by June 1st, 1994, The variance was denied as no adequate hardship had been shown. SQptQinber 2nd, 1 QQ3 Page 2 Larry Walker - Approved Larry Walker, Wadena, MN. requested a variance of 25' from the required ordinary high water level setback of 75' for the construction of a 60' by 28' structure. The house on the adjacent lot is located 50' from the ordinary high water level. The property is described as Lot 15. St. Lawrence Beach. Rush Lake in Rush Lake Township, Eugene Pier represented the applicant at the hearing. The audience was polled with Scott Norton speaking in favor of granting the variance request. After consideration, motion was made by Craig Anderson, seconded by Dan Oehler and unanimously carried, to approve the construction of a structure, not exceeding 30' in width, 20' from the road right of way. The granting of this variance will provide the applicant with the same rights and privileges as the owner of Lot 16, Duane I. Fraki - Tabled Duane I, Fraki, New York Mills, MN, requested a variance to construct an 8' by 22' deck to an existing structure 45' from the ordinary high water level. The property is described as Lots 21 and 22, Block 2, Jackson and Mckee's Addn., Big Pine Lake in Pine Lake Township, The applicant was not present at the hearing. After consideration, motion was made by Bert Olson, seconded by John Everts and unanimously carried, to table the variance request until the October 7th, 1 993, meeting. Earl S. Strinden - Approved Earl S, Strinden, Grand Forks. ND, requested a variance of 4' from the required side lot line setback of 10' for the location of a 20' by 22' structure 6' from the side lot line. The applicant plans on changing the use of this structure by adding a second story. The property is described as Lot 19, Sandee Cove Beach, Lake Lida in Lida Township. A letter from Janice Strinden in favor of granting this variance request was read for the record. The audience was polled with Conard Posz speaking in favor of this variance request. After consideration, motion was made by Dan Oehler, seconded by Berton Olson and carried with John Everts voting no, to grant a variance of 4' from the required side lot line .setback of 10' for the 20' by 22' structure and to approve a variance of 4' from the required side lot line setback of 10' for the 12' by 18' structure, if the applicant decides to add a second story to the 20' by 22' structure then the 12' by 18' structure cannot be used as a dwelling and must not have water or sewer connections. The applicant's structures will be no closer to the lake than the existing structures. Hardship being a substandard lot of record, Donald L. Moll - Approved Donald L, Moll, Bismarck, ND. requested a variance of 66' from the required ordinary high water level setback of 100' and a variance of 16' from the required shore impact zone setback of 50' for a 24' by 40' - 1 1 /2 story addition to an existing structure. The addition will be constructed above an existing boat and storage house which is attached to the existing structure. The property is described as Lot 9, 3rd Addition to Kozelnik Beach, Big McDonald Lake in Edna Township. The audience was polled with no one speaking for or against the request. After consideration, motion was made by Craig Anderson, seconded by Cecil Femling and unanimously carried, to approve the construction of a 1 1 /2 story addition up to what the string line test would permit. The string line is to be determined by the Land and Resource Department. Elvin 0, Arntson - Denied Elvin 0, Arntson, Pelican Rapids, MN. requested a variance of 4' from the required side lot line setback of 10' for the construction of a 14' by 22' garage 6' from the side lot line. The property is described as Lot 5. Rundle Addition, Pelican Lake in Scambler Township, The audience was polled with no one speaking for or against the request.
